To hire and pay an independent contractor, you generally need four IRS forms: Form W-9 to collect the contractor’s taxpayer information before you pay, Form 1099-NEC to report annual payments of $2,000 or more, Form 1096 as a paper transmittal if you don’t file electronically, and Form 945 if you had to withhold federal tax because the contractor’s tax ID was missing or wrong. Depending on what you paid for, Form 1099-MISC may replace or accompany the 1099-NEC. The $2,000 reporting threshold applies to payments made after calendar year 2025 under P.L. 119-21 and will adjust for inflation starting in 2027.1Internal Revenue Service. Publication 15 (2026), (Circular E), Employer’s Tax Guide
The list is short, but the order matters. Collecting the W-9 late is the single most common reason a business ends up owing backup withholding it didn’t plan for.
First, Confirm the Worker Is Really a Contractor
The forms below only apply to independent contractors. If the IRS decides the person is actually your employee, you owe payroll taxes, not a 1099. The common-law test weighs three categories of evidence: behavioral control (whether you direct when, where, and how the work is done), financial control (whether the worker invests in their own equipment and can profit or lose on the job), and the type of relationship (written contract, benefits like insurance or a pension).2Internal Revenue Service. Independent Contractor (Self-Employed) or Employee? No single factor decides it. If you’re unsure, you or the worker can file Form SS-8 and ask the IRS for a formal determination.3Internal Revenue Service. About Form SS-8, Determination of Worker Status for Purposes of Federal Employment Taxes and Income Tax Withholding
Filing 1099s consistently for the workers you treat as contractors also matters if the classification is ever challenged. Skipping the 1099 removes one of the conditions for Section 530 relief from back employment taxes.4Internal Revenue Service. Worker Reclassification – Section 530 Relief
Form W-9: Collect It Before You Pay
Form W-9 is how you request the contractor’s taxpayer identification number. The contractor fills in their legal name as it appears on their tax return, their business entity type, their address, and either a Social Security number or Employer Identification Number. They sign under penalty of perjury certifying the number is correct and stating whether they’re subject to backup withholding.5Internal Revenue Service. Instructions for the Requester of Form W-9 You keep the form. Nothing gets sent to the IRS.
Get the W-9 before the first payment goes out. If you pay someone without a valid W-9 on file, you may be required to start backup withholding at 24% immediately.5Internal Revenue Service. Instructions for the Requester of Form W-9 You can also verify the name and TIN combination through the IRS TIN Matching service, which is open to payers listed in the IRS Payer Account File database and offers both interactive and bulk lookups.6Internal Revenue Service. Form 1099-NEC: Reporting What You Paid
Form 1099-NEC reports nonemployee compensation. You must file one for a contractor when all of the following are true: the payment was to someone who is not your employee, it was for services in the course of your trade or business, the recipient is an individual, partnership, estate, or in some cases a corporation, and the total for the year reached $2,000 or more.7Internal Revenue Service. Reporting Payments to Independent Contractors The gross amount for fees, commissions, and other service compensation goes in Box 1.8Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
One additional trigger: if you withheld any federal income tax from the contractor under the backup withholding rules, you must file a 1099-NEC regardless of the payment amount.9Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return?
Payments Through Credit Cards, PayPal, and Venmo Don’t Count
Amounts you paid through a credit card, debit card, or third-party payment network are reported by the payment processor on Form 1099-K, not by you. Excluding those payments prevents duplicate reporting.8Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC The practical result is that Form 1099-NEC only tracks what you paid by check, cash, ACH transfer, or wire. If you paid a contractor $3,000 for the year but $2,500 of it went through a payment app, only the $500 balance counts toward your 1099-NEC threshold, and at $500 you’re below the $2,000 line.
When You Use Form 1099-MISC Instead
Not every payment to a non-employee belongs on the 1099-NEC. Rent, royalties, medical and health care payments, crop insurance proceeds, and attorney settlement proceeds (as distinct from fees for legal services) go on Form 1099-MISC, each in its own designated box.9Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return? Putting an amount in the wrong box, or on the wrong form entirely, can generate automated IRS notices for you and the recipient.
Backup Withholding and Form 945
If a contractor gives you an incorrect TIN, doesn’t give you one at all, or the IRS notifies you that the contractor is subject to backup withholding, you must withhold 24% from each payment.1Internal Revenue Service. Publication 15 (2026), (Circular E), Employer’s Tax Guide Withholding is not optional once triggered. You deposit the withheld amounts with the IRS on the same schedule as other federal tax deposits, and at year’s end you file Form 945 to report all nonpayroll withholding for the year.10Internal Revenue Service. About Form 945, Annual Return of Withheld Federal Income Tax The withheld amount also goes in Box 4 of the contractor’s 1099-NEC.
The way to avoid all of this is to collect a valid W-9 before the first payment and verify the TIN through the IRS matching service.
Form 1096: Only for Paper Filers
Form 1096 is a transmittal cover sheet that summarizes the paper forms you’re mailing to the IRS. Each form type needs its own 1096, so if you’re sending both 1099-NEC and 1099-MISC forms, prepare two separate 1096 transmittals.11Internal Revenue Service. General Instructions for Certain Information Returns (2025) If you file electronically, you don’t need Form 1096 at all.
Filing Deadlines and Methods
Both the contractor’s copy of Form 1099-NEC (Copy B) and the IRS copy (Copy A) are due January 31 of the year following payment. For Form 1099-MISC, the contractor copy is also due January 31, but the IRS copy is due February 28 on paper or March 31 electronically.8Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC There is no automatic extension for Form 1099-NEC.12Internal Revenue Service. If you file 10 or more information returns of any type in a calendar year, you must file electronically.13Internal Revenue Service. E-File Information Returns The count combines W-2s, all 1099 varieties, and other information returns, so a business with six contractors and four employees already crosses the line. The IRS offers two electronic systems:
- IRIS (Information Returns Intake System) is a free web portal. You can key in forms directly or upload a CSV, e-file up to 100 returns at a time, and download payee copies for distribution.14Internal Revenue Service. E-File Information Returns With IRIS
- FIRE (Filing Information Returns Electronically) is the older system and requires software that can produce files in the format specified by IRS Publication 1220.11Internal Revenue Service. General Instructions for Certain Information Returns (2025)
Both require a Transmitter Control Code (TCC), obtained through an online application. Each system has its own TCC; a code for one won’t work on the other.15Internal Revenue Service. About Information Returns (IR) Application for Transmitter Control Code (TCC) for Filing Information Returns Electronically (FIRE) Apply well before the January deadline because processing takes time. For most small businesses new to e-filing, IRIS is the easier route.
Businesses that qualify for a hardship waiver from electronic filing can request one on Form 8508. First-time waiver requests are granted automatically; later requests require documentation, such as cost estimates showing that electronic filing would cost more than paper.16Internal Revenue Service. Application for a Waiver from Electronic Filing of Information Returns
Penalties for Late or Missing Filings
For returns due in 2026, per-form penalties increase the longer you wait:17Internal Revenue Service. Information Return Penalties
- Filed within 30 days of the deadline: $60 per form.
- Filed after 30 days but by August 1: $130 per form.
- Filed after August 1 or not filed at all: $340 per form.
- Intentional disregard: $680 per form, with no annual cap.
The same tiers apply to failing to furnish a correct copy to the payee. Annual maximums apply to the first three tiers and are lower for small businesses (gross receipts of $5 million or less) than for larger filers. The intentional disregard penalty has no maximum; if the IRS determines you knowingly ignored the requirement, the $680 minimum applies to every form, and the penalty can climb to 10% of the total amount you should have reported.18Internal Revenue Service. 20.1.7 Information Return Penalties
State Filings Are Separate
Federal 1099-NEC filing does not automatically satisfy state reporting. Some states require a filing whenever state income tax was withheld, some follow the federal threshold, and some have no state 1099-NEC requirement. If you e-file through FIRE, the IRS Combined Federal/State Filing Program can forward your data to participating states, but the IRS acts only as a forwarding agent, so confirm each state’s requirements and whether it participates.19Internal Revenue Service.
