If your Employment Authorization Document (Form I-766) is stamped “NOT VALID FOR REENTRY TO U.S.” on an EAD, the card authorizes you to work inside the country and nothing more. It is not a travel document. Leaving the United States and trying to come back with only this card will not work, and for many immigration categories, departing without the right travel paperwork can destroy the underlying application you are waiting on. To travel and return, you need a separate document called advance parole.
What the Card Does and Doesn’t Do
The EAD proves to employers that you are authorized to accept a job and satisfies identity verification for Form I-9.1U.S. Citizenship and Immigration Services. The “NOT VALID FOR REENTRY” language is USCIS telling you, along with every airline gate agent and border officer, that this card is not a travel document.
Presenting it at an airport or land port of entry will not get you back into the country. Customs and Border Protection officers require documentation that specifically authorizes your return, such as a visa, a green card, or an advance parole document. Boarding an international return flight with only an EAD marked this way will typically end at the gate.
Combo Cards Look Different
Not every Form I-766 carries the reentry restriction. USCIS also issues a version sometimes called a “combo card” that works as both a work permit and an advance parole document. If that language is missing and “NOT VALID FOR REENTRY TO U.S.” appears instead, your card is a standalone work permit with no travel privileges. This usually happens because your immigration category doesn’t automatically include advance parole, or because you didn’t file for travel authorization alongside your work permit application. Read the front of the card carefully before making any international travel plans.
Who Needs Advance Parole
Several groups need advance parole before leaving. The specifics differ, but the common thread is that leaving without it can undo an application you have waited years to process.

- Asylum applicants with a pending Form I-589. Leaving without advance parole creates a presumption that you have abandoned the claim. - TPS holders who want to travel abroad. Permanent residents planning to be abroad for a year or more need a different document, a reentry permit rather than advance parole. Both use Form I-131, but advance parole is for people whose immigration cases are still pending.3U.S. Citizenship and Immigration Services. Travel Documents
Dual-Intent Visa Exceptions
Not everyone with a pending I-485 needs advance parole. Federal regulations carve out exceptions for people holding certain nonimmigrant visas that already contemplate a future green card application. If you fall into one of these categories, your departure does not automatically abandon your pending adjustment:6eCFR. 8 CFR 245.2 – Application
- H-1B and H-4 holders returning to work for the same sponsoring employer, still eligible for H status, and holding a valid H visa stamp if one is required.
- L-1 and L-2 holders who maintain L eligibility and hold a valid visa if needed.
- K-3 and K-4 holders traveling with a valid K visa.
- V visa holders who remain admissible in V status on return.
The exception is narrower than it sounds. If your H-1B has expired, if you have switched employers since filing I-485, or if you cannot show a valid visa stamp on return, CBP can still deny entry. When there is any doubt, filing for advance parole as a backup is the safer choice.
What Happens If You Leave Without It
The consequences of leaving without the right document are immediate and hard to undo.

For asylum applicants, departure without advance parole creates a legal presumption that you have abandoned the application.4eCFR. 8 CFR 1208.8 – Limitations on Travel Outside the United States
There is a second layer of risk. If you have accrued more than 180 days of unlawful presence, leaving normally triggers a three-year bar on returning, and unlawful presence of a year or more triggers a ten-year bar. Advance parole offers important protection here: under a 2012 Board of Immigration Appeals decision that USCIS follows, a person who departs after obtaining advance parole is not considered to have triggered these bars, even if substantial unlawful presence accrued during the stay.8U.S. Citizenship and Immigration Services. How to Apply for Advance Parole
The application is Form I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records.5U.S. Citizenship and Immigration Services. Two passport-style color photographs are required, along with a photocopy of a government-issued photo ID and a copy of the receipt notice for your underlying application (such as your pending I-485 or I-589).
Most advance parole applicants must file on paper and mail Form I-131 to the designated USCIS lockbox. Online filing is available only for limited categories, primarily certain parole and re-parole applicants under specific humanitarian programs.9U.S. Citizenship and Immigration Services. Fees vary by filing category and were restructured under the 2024 USCIS fee rule, with additional inflationary adjustments taking effect on January 1, 2026.10Federal Register. The median processing time for advance parole applications is roughly 7 months as of early 2026, though individual cases can run longer.12U.S. Citizenship and Immigration Services. Historic Processing Times Do not book international travel around a guess about when the document will arrive. You need the physical document in hand before you leave.
Emergency Travel
If a family member dies, someone is critically ill, or you have an urgent medical need abroad, USCIS has a process for travel in fewer than 15 days. Contact the USCIS Contact Center at 800-375-5283 (TTY 800-767-1833) to request emergency processing. If your situation qualifies, USCIS will schedule an appointment at a local field office where you can receive an expedited travel document.13U.S. Citizenship and Immigration Services. Bring a completed and signed Form I-131 with the applicable filing fee, evidence supporting your eligibility for the travel document, proof of the emergency, and two passport-style photos. Supporting documentation depends on the reason: a death certificate or funeral home letter for a death in the family, a doctor’s letter for a medical emergency, or similar evidence.14U.S. Citizenship and Immigration Services. What Reentry With Advance Parole Actually Looks Like
Advance parole is permission to ask for reentry. It is not a guarantee that CBP will let you back in. When you arrive at a U.S. port of entry with an advance parole document, you are legally an “applicant for admission,” and CBP has full discretion to grant or deny your parole into the country.2U.S. Citizenship and Immigration Services. Officers review your immigration history, check for criminal records, and confirm the document is valid and unexpired. If they find grounds of inadmissibility, they can deny entry despite the document. Being paroled in is also not the same as being “admitted” in the legal sense; parole is a temporary permission that does not change your underlying immigration status. Carry your advance parole document along with your EAD, the receipt notice for your pending application, and any other immigration paperwork. Organized documents make inspection go faster.
