What Does It Mean When Your Account Is Restricted?

When your account is restricted, it means the bank or brokerage has limited some or all of the normal functions on it, and the cause can be anything from a routine hold on a deposited check to a federal tax levy that locks the balance for weeks. A mild restriction might block a single feature like wire transfers or margin trading. A full freeze blocks deposits, withdrawals, and trades. Brokerages often use a middle setting called liquidation-only, where you can sell holdings but not buy anything new. What you do next depends entirely on why the restriction was placed.

Who Placed the Restriction Matters More Than the Label

The first thing worth sorting out is whether the hold came from inside the institution or from outside it. An internal restriction means your bank or broker flagged something under its own policies: an unusual login, a bounced deposit, a compliance review, an expired ID on file. You resolve those by working directly with the institution. An external restriction means a court, the IRS, or another government authority ordered the freeze, and your bank has no choice but to comply. No amount of escalation inside customer service will move an external hold, because the bank cannot legally lift it on its own.

That single question—internal or external—determines who you call, what documents matter, and how long the freeze will last.

Deposit Holds Are the Most Common Reason

Most people who suddenly see “restricted” on their balance are looking at a hold on a recent deposit. Under federal Regulation CC, banks must make the first $275 of a check deposit available by the next business day, and cash deposited in person or funds arriving by direct deposit also follow next-business-day availability.1eCFR. 12 CFR Part 229 – Availability of Funds and Collection of Checks

Holds get longer when the deposit is large, when the account is less than 30 days old, when the bank has reason to believe a check will not clear, or when a previously returned check is being redeposited. In every case, the bank must tell you a hold is in place and when the money will be available. If the restriction on your account is a deposit hold, it will clear on its own within a few business days.

Compliance and Identity Restrictions

Federal rules require banks to verify who you are and to monitor whether your activity matches the profile you established when you opened the account. Those obligations produce a whole category of restrictions that are harder to read from the outside.

Identity Verification Failures

If the driver’s license or passport on file has expired, or a periodic review turns up a discrepancy, expect a restriction until you submit updated documents. The same applies when the bank asks you to verify the source of a large or unusual deposit. Ignoring that request does not make it go away. Customers flagged as higher risk face more intensive scrutiny, which can include income documentation, business financial statements, or paperwork on international transactions. Politically exposed persons, cash-intensive businesses, and customers with frequent international wires routinely face enhanced due diligence.2FFIEC. Customer Due Diligence Overview

Anti-Money Laundering Investigations

Banks run automated systems that flag unusual patterns: a sudden spike in cash deposits, rapid movement between unrelated international accounts, or transactions structured just under reporting thresholds. When something trips the system, the bank files a Suspicious Activity Report with the government. Federal law explicitly prohibits the bank from telling you a report has been filed or that you are under investigation.3Office of the Law Revision Counsel. 31 U.S. Code 5318 – Compliance, Exemptions, and Summons No employee, officer, or director may notify anyone involved in the transaction.

This is why some account holders hit a wall when asking for the reason behind a hold. The representative on the phone may genuinely be unable to say more than “your account is under review.” If the bank refuses to explain the restriction and cannot give you a checklist of documents to fix it, an active AML investigation is a likely explanation. The freeze stays until the investigation concludes, and there is no set timeline for that.

OFAC Sanctions

The Office of Foreign Assets Control maintains lists of sanctioned countries, organizations, and individuals. If your name, a counterparty, or a business you are associated with matches an entry, the bank must block the account or reject the transaction.4FFIEC BSA/AML InfoBase. BSA/AML Manual Office of Foreign Assets Control Blocked funds sit in a segregated interest-bearing account and stay frozen until the person or entity is delisted, the program ends, or you get a specific license from OFAC. False positives happen, especially with common names, and resolving one runs through OFAC’s administrative process rather than the bank’s complaint line.

Legal Holds From Outside the Bank

The most disruptive restrictions come from a court or a government agency. Your bank has no discretion in these situations.

IRS Levies

If you owe back taxes and have not responded to prior collection notices, the IRS can issue a Notice of Levy directing your bank to turn over the funds in your account. The bank must freeze the money and hold it for 21 days before sending it to the IRS.5Office of the Law Revision Counsel. 26 USC 6332 – Surrender of Property Subject to Levy That 21-day window exists to give you time to resolve things before the funds leave the account.

The IRS must release a levy if you pay in full, enter an installment agreement, or show that the levy creates an economic hardship preventing you from meeting basic living expenses.6Internal Revenue Service. How Do I Get a Levy Released? Once released, the IRS issues Form 668-D, which you then bring to your bank to lift the hold.7Internal Revenue Service. 5.11.2 Serving Levies, Releasing Levies and Returning Property A release does not erase the underlying tax debt. You still owe the balance, and a new levy can follow if you fall out of compliance with whatever arrangement you agreed to.

Court-Ordered Garnishments

A creditor who wins a judgment can obtain a writ of garnishment ordering your bank to freeze funds to satisfy the debt. State law governs the procedures, exemptions, and timelines, so the details vary by where you live.

One protection applies everywhere. When your bank receives a garnishment order, it must review the account and identify federal benefit payments deposited in the previous two months, then calculate a protected amount equal to the lesser of those deposits or the current balance.8eCFR. Part 212 Garnishment of Accounts Containing Federal Benefit Payments You keep full access to the protected amount without filing anything. Protected benefits include Social Security, SSI, veterans’ benefits, federal retirement pay, military pay, and FEMA assistance.9Consumer Financial Protection Bureau. Can a Debt Collector Take My Federal Benefits, Like Social Security or VA Payments SSI is shielded even from government debts and child support. Social Security and SSDI can be garnished for back taxes, federal student loans, and child or spousal support, but not for ordinary private debts.

Joint accounts complicate things. When only one holder owes the debt, whether a creditor can reach funds in a joint account depends heavily on state law and how the account is titled. In some states only the debtor’s share is exposed; in others the whole balance is. If you share an account with someone facing a judgment, a consultation with a local attorney is worth the fee.

Brokerage-Specific Restrictions

Investment accounts have their own set of triggers that do not apply to ordinary checking or savings.

Margin Calls

If you borrow from your broker to buy securities, FINRA requires account equity to stay at or above 25% of the market value of your holdings, and most brokerages set a higher house requirement.10FINRA.org. 4210. Margin Requirements If your positions drop and equity falls below the maintenance line, you get a margin call. Fail to meet it and the account goes to liquidation-only, with the brokerage selling positions to bring the balance back into compliance. You generally have up to 15 business days to cover the deficit, but brokers can and do sell sooner in a falling market.

Settlement Violations

Stock trades settle the next business day, known as T+1.11U.S. Securities and Exchange Commission. Shortening the Securities Transaction Settlement Cycle In a cash account, if you buy a stock with unsettled funds and then sell it before the original purchase settles, that’s a good faith violation. Three of those within 12 months restricts the account to settled-cash-only trading for 90 days. Freeriding, which is buying and selling at a profit without ever having the cash to cover the original purchase, triggers the same 90-day restriction on a single occurrence.12Fidelity. Avoiding Cash Account Trading Violations

Pattern Day Trading

Four or more day trades within five business days in a margin account, if they exceed 6% of your total activity in that period, get you classified as a pattern day trader. That classification comes with a $25,000 minimum equity requirement.13FINRA.org. Day Trading If your equity drops below $25,000 on any day you day trade, you’re locked out of further day trading until the balance recovers.

Fraud, Overdrafts, and Involuntary Closure

When fraud detection spots unauthorized access, or you report suspicious charges yourself, the bank typically freezes the account immediately to stop further losses. Protective holds like this usually resolve within a few days once legitimate transactions are verified and a new card or account number is issued.

A high volume of chargebacks or disputes can also trigger a restriction. Repeated disputes can look like first-party fraud from the bank’s side, so keep documentation for each one and be ready to explain the pattern.

A negative balance from an overdraft, a returned deposit, or accumulated fees leaves the account in deposit-only mode until you bring it back to zero. If the deficit lingers, the bank may close the account. Involuntary closures get reported to ChexSystems, and a record stays on file for five years, during which many banks will refuse to open a new account for you.14ChexSystems. ChexSystems Frequently Asked Questions Second-chance checking accounts exist at some institutions but carry higher fees and fewer features.

When the Account Holder Has Died

If the account belonged to someone who has died, the bank freezes it to protect the estate. No one—spouse, adult child, joint user—can access the funds until proper legal paperwork is filed. That normally means a certified death certificate and letters testamentary from the probate court. Most states offer a simplified small estate affidavit for smaller estates, usually available 30 to 40 days after death and only when no formal probate case is open. Even where the affidavit is legally sufficient, many banks require it notarized.

Getting the Restriction Lifted

How you resolve a restricted account depends entirely on what caused it. A deposit hold clears on its own. An IRS levy requires negotiating with a federal agency. Treating them the same wastes time.

Call the Right Department

Skip general customer service. Ask for fraud, risk, or compliance depending on the nature of the hold. Front-line agents often cannot see the details of a compliance restriction, let alone lift one. Get a case number and direct contact information for the person handling your file. If the representative says they cannot disclose the reason, that itself tells you something: it points toward a regulatory investigation where disclosure is legally forbidden.

Submit the Full Set of Documents at Once

Once you know what’s required, gather everything before submitting anything. Typical requests include an updated government-issued photo ID, statements showing the source of a large deposit, or business formation documents. Send materials in the exact channel the institution specifies, whether that’s a secure portal, fax, or certified mail. Using the wrong channel is a surprisingly common cause of delay.

Work With the Authority That Issued a Levy or Garnishment

Your bank cannot release funds held under a government levy or court garnishment. You have to deal with the authority that ordered it. For an IRS levy, contact the IRS about paying in full, an installment plan, or a hardship release.6Internal Revenue Service. How Do I Get a Levy Released? You have 21 days from when the bank receives the notice before the money is transferred.5Office of the Law Revision Counsel. 26 USC 6332 – Surrender of Property Subject to Levy For a court garnishment, you may need to file a claim of exemption with the court to protect wages or benefits that are legally exempt. Once the hold is resolved, obtain the formal release document (IRS Form 668-D, or a court order vacating the garnishment) and deliver it to the bank yourself rather than waiting for official channels.

Your Rights on Unauthorized Electronic Transactions

If your account was restricted because of unauthorized electronic transactions, federal law gives you specific protections. Once you notify the bank, it has 10 business days to investigate and resolve the issue. It can extend the investigation to 45 days, but only by provisionally crediting your account within the first 10 business days and giving you full access to those funds while it finishes.15eCFR. 12 CFR 1005.11 – Procedures for Resolving Errors New accounts and certain international or point-of-sale transactions get extended timelines of 20 and 90 days. Missing the provisional credit deadline is a regulatory violation you can escalate.

Escalating to a Regulator

When the bank is the problem—ignoring documentation, missing its own timelines, or refusing to explain a restriction that is not covered by SAR nondisclosure—there are options beyond the institution’s complaint process. The Consumer Financial Protection Bureau accepts complaints and forwards them to the institution, which generally must respond within 15 days.16Consumer Financial Protection Bureau. Learn How the Complaint Process Works For national banks and federal savings associations, the Office of the Comptroller of the Currency runs a Customer Assistance Group.17HelpWithMyBank.gov. File a Complaint Try the bank directly first, then file with the appropriate regulator if you get nowhere. If the OCC’s answer is unsatisfactory, an appeal is available.

Do Not Walk Away From the Account

If you abandon a restricted account rather than resolving it, you risk losing the funds. Most states classify a bank account as dormant after three to five years of inactivity, and the balance is then turned over to the state as unclaimed property.18HelpWithMyBank.gov. What Can You Tell Me About State Unclaimed-Property Programs The bank typically tries to notify you at your last known address first, but if you have moved, the notice may never reach you. You can eventually reclaim the money through your state’s unclaimed property office, though the process is slow and the funds do not earn interest while they sit with the state. Resolving the restriction now, even if it takes effort, is almost always better than dealing with escheatment later.
