When a bankruptcy is discharged, it means the court has issued the order that permanently erases your legal obligation to pay the debts covered by your case. Creditors on those debts can no longer sue you, garnish your wages, call you, or send collection letters. The discharge is the whole point of filing: everything before it is procedure, and everything after it is your life without those debts hanging over it.
What the Discharge Order Actually Does
The discharge does two things at the same time. It eliminates your personal liability on the covered debts, so you no longer owe the money as a legal matter. And it creates a permanent injunction, a standing court order that forbids creditors from taking any step to collect.1Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge Lawsuits, phone calls, dunning letters, wage garnishments: all off the table.
The order also voids any judgment a creditor won against you before the bankruptcy, to the extent that judgment covers a discharged debt.1Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge A creditor who sued you and won still has a piece of paper, but the paper has no legal force behind it anymore.
Discharge Is Not Dismissal
The words sound alike, and mixing them up is one of the most expensive mistakes a filer can make. A discharge means you finished the case and the qualifying debts are gone. A dismissal means the court shut the case down before it finished, your debts survive in full, and the automatic stay that had been protecting you vanishes. Creditors resume collection immediately.
Cases get dismissed when requirements are missed: paperwork deadlines, the meeting of creditors, plan payments in Chapter 13, or the required education courses. Reaching discharge is the goal of every filing.
Which Debts Get Wiped Out
Most unsecured debts, the kind with no collateral behind them, are dischargeable. Credit card balances, medical bills, personal loans, utility bills, past-due rent, deficiency balances left after a repossession or foreclosure, and most civil judgments arising from unpaid debts all fall into this group.
Some older income tax debts can also be discharged, but only if the return was due at least three years before you filed, you actually filed it at least two years before, the IRS assessed the tax at least 240 days before, and no fraud is involved. Miss any one of those and the tax survives.2Internal Revenue Service. Publication 908 (2025), Bankruptcy Tax Guide
Debts That Survive
Congress carved out categories that stay with you no matter which chapter you file:
- Child support and alimony.
- Recent income taxes, payroll taxes, and taxes tied to a fraudulent return.
- Debts you incurred through fraud, and debts for willfully injuring another person or their property.
- Liability for personal injury or death caused by driving while intoxicated.
- Criminal fines and restitution.
- Consumer debts over $500 for luxury goods within 90 days of filing, and cash advances over $750 within 70 days, which are presumed non-dischargeable.
Creditors who believe a debt fits one of these categories can go to court to challenge its discharge.3Office of the Law Revision Counsel. 11 US Code 523 – Exceptions to Discharge
Student loans sit in their own difficult spot. The Bankruptcy Code makes them non-dischargeable unless repayment would cause “undue hardship,”3Office of the Law Revision Counsel. 11 US Code 523 – Exceptions to Discharge a standard most courts test with a three-part inquiry into your current standard of living, whether the hardship is likely to persist, and your good-faith efforts to repay.4American Bar Association. Elements of Undue Hardship Discharge of Student Loans Checklist Since November 2022, the Department of Justice has used a standardized attestation-based process that has made federal student loan discharge meaningfully more accessible than before, though it still requires filing a separate action inside the bankruptcy case.5U.S. Department of Justice. Secured Debts: You Owe Nothing, but the Lien Stays
This is where “discharged” gets misread. The order kills your personal obligation to pay, but it does not remove a creditor’s lien on property.6Legal Information Institute. Bankruptcy Discharge If your car loan or mortgage gets discharged, the lender can no longer chase you for the money, but it can still repossess the car or foreclose on the house if the payments stop.
In Chapter 7, you generally have three ways to handle secured property. You can reaffirm the debt by signing a new agreement with the lender, which pulls the debt back out of the discharge and leaves you personally liable again; a reaffirmation has to be filed before the discharge is entered, and you get 60 days after filing it to back out.7Office of the Law Revision Counsel. 11 US Code 524 – Effect of Discharge You can redeem the property by paying the lender its current fair market value in a lump sum. Or you can surrender it and let any remaining balance go with the rest of your discharged debt.
When the Discharge Arrives
Timing depends on the chapter.
Chapter 7
Chapter 7 is the fast route. The meeting of creditors happens about 30 days after filing, and the discharge order typically comes down roughly 60 days after that meeting, putting most cases at three to four months from filing to discharge.8United States Courts. Discharge in Bankruptcy – Bankruptcy Basics
Chapter 13
Chapter 13 uses a repayment plan lasting three to five years, and the discharge does not arrive until you complete every payment. You also have to certify that any domestic support obligations are current and finish the financial management course.9Office of the Law Revision Counsel. 11 US Code 1328 – Discharge The tradeoff for the longer wait is a slightly broader discharge that can reach some debts Chapter 7 cannot.8United States Courts. Two Required Courses
Neither chapter will get you a discharge without two mandatory courses. A credit counseling session has to be completed within 180 days before you file.10Office of the Law Revision Counsel. 11 US Code 109 – Who May Be a Debtor A debtor education course of at least two hours, covering budgeting, money management, and responsible credit use, has to be completed after filing.11U.S. Department of Justice. Frequently Asked Questions (FAQs) – Debtor Education The judge will not sign the discharge until the certificate of completion is on file. Both usually cost $50 or less, and fee waivers exist for low-income filers.
If a Creditor Ignores the Discharge
Collecting on a discharged debt violates a federal court order. Under the Supreme Court’s decision in Taggart v. Lorenzen, a bankruptcy court can hold a creditor in civil contempt when there is no fair ground of doubt that the discharge barred what the creditor did. Sanctions can include actual damages, attorney fees, and in some cases punitive penalties.
If calls, letters, or lawsuits keep coming on a discharged debt, save every record of contact. Your case can be reopened and the court can enforce the injunction. Creditors tend to stop quickly once a contempt motion is on the table.
What Happens to Your Credit Report
A consumer reporting agency can report the bankruptcy for up to 10 years from the date of the order for relief, which is generally the filing date, regardless of the chapter.12Office of the Law Revision Counsel. 15 US Code 1681c – Requirements Relating to Information Contained in Consumer Reports In practice, the major bureaus often remove completed Chapter 13 cases after seven years, though nothing in law requires them to.13Consumer Financial Protection Bureau. How Long Does a Bankruptcy Appear on Credit Reports?
Individual discharged accounts should show a zero balance and be reported as “included in bankruptcy” or “discharged.” If an account still shows an outstanding balance or an active collection status after the discharge, that is an error worth disputing with the credit bureau.
One more piece of good news: debts erased in bankruptcy are excluded from your gross income for federal tax purposes. There is no 1099-C surprise the following year, unlike cancelled debt outside of bankruptcy.2Internal Revenue Service. Publication 908 (2025), Bankruptcy Tax Guide
Life After the Order
Pull your credit reports from Equifax, Experian, and TransUnion once the discharge is entered.14Consumer Financial Protection Bureau. Companies List Check that every discharged account shows the right status, and dispute anything that still shows a balance or active collection. Federal law also blocks government agencies from denying you employment, firing you, or refusing a license solely because you filed bankruptcy, and private employers cannot fire or discriminate against a current employee on that basis.15Office of the Law Revision Counsel. 11 US Code 525 – Protection Against Discriminatory Treatment Courts have generally read that private-employer rule as protecting existing employees, not applicants.
Rebuilding credit is straightforward in method, if slow in feel. Get a small line of credit, use it lightly, and pay on time every month. A secured credit card, where a cash deposit sets your limit, is the usual starting point, and some credit unions offer credit-builder loans that work the same way. Most people see meaningful score improvement within 12 to 18 months of consistent on-time activity, even while the bankruptcy remains on their report.
