When a federal job posting uses direct hire authority, the agency is allowed to fill the position without the usual competitive rating, ranking, and veterans’ preference procedures. Every applicant who meets the minimum qualifications can be sent to the hiring manager, who then picks whom to interview and hire. The Office of Personnel Management authorizes direct hire authority for federal jobs under 5 U.S.C. 3304 when there is a severe shortage of candidates or a critical hiring need.1Office of the Law Revision Counsel. 5 U.S.C. 3304 – Competitive Service; Examinations For you, it means a faster process and a wider pool, not a lower bar.
What Changes for You as an Applicant
In a standard federal hiring action, HR scores your application, adds veterans’ preference points where they apply, ranks everyone on a certificate, and forwards only the top-scoring names to the hiring manager. Direct hire authority takes those steps out.2U.S. Office of Personnel Management. Direct Hire Authority
Under this authority, agencies hire “without regard to” the competitive procedures in 5 U.S.C. 3309 through 3318.1Office of the Law Revision Counsel. 5 U.S.C. 3304 – Competitive Service; Examinations Three things drop out: competitive rating and ranking, veterans’ preference points, and the traditional “rule of three” that limited managers to the top few names.2U.S. Office of Personnel Management. Direct Hire Authority Instead, every applicant who meets the minimum qualifications for the grade can be referred.
Two practical consequences follow. First, the qualifications screening is now the whole game. There is no point score to make up for a weak match; either your resume shows you meet the announcement’s requirements or it does not. Second, veterans’ preference points do not tilt the referral. Veterans still apply and compete on the merits, but the numerical boost that normally moves eligible applicants up the certificate does not operate here.
The job still has to be posted publicly, generally on USAJOBS.3eCFR. 5 CFR 337.203 – Public Notice Requirements Displaced federal employees with priority under the Career Transition Assistance Plan (CTAP) or Interagency Career Transition Assistance Plan (ICTAP) still get selection priority under OPM’s standard government-wide authorities.2U.S. Office of Personnel Management. Which Federal Jobs Use Direct Hire Authority
OPM keeps several government-wide authorities that any agency with delegated examining authority can use. They cover fields where shortages run across the federal government rather than sitting inside a single department. The active government-wide authorities include:
- Medical occupations: medical officers, nurses, pharmacists, and diagnostic radiologic technologists at all grade levels and locations.
- Information technology (information security): IT management specialists in the GS-2210 series at GS-9 and above, at all locations.
- Veterinary medical officers, GS-11 through GS-15, nationwide, with no set expiration date.
- STEM positions: economists, biological scientists, engineers, physical scientists, actuaries, mathematicians, data scientists, and acquisition specialists at GS-11 through GS-15. Authorized through December 31, 2028.
- Cybersecurity positions: computer engineers, computer scientists, electronics engineers, criminal investigators, and IT cybersecurity specialists in cybersecurity roles at GS-12 through GS-15. Authorized through December 31, 2028.
- Artificial intelligence positions: IT specialists, computer scientists, computer engineers, and management and program analysts in AI roles at GS-9 through GS-15. Authorized through December 31, 2028.
Individual agencies may also hold their own direct hire authorities for positions specific to their missions. You can usually tell whether an announcement uses direct hire authority because it says so in the “How You Will Be Evaluated” section on USAJOBS, and it often adds that veterans’ preference does not apply.2U.S. Office of Personnel Management. Direct Hire Authority Filtering your USAJOBS search by an occupational series covered above, such as GS-2210 for IT, is a fast way to surface likely candidates.
One boundary to keep in mind: direct hire authority covers only competitive service positions. It cannot be used to fill excepted service or Senior Executive Service roles.2U.S. Office of Personnel Management. Direct Hire Authority
How to Apply
Because qualifications screening is the whole filter under direct hire, your federal resume has to make the match unmistakable. For each position, include your job title, employer name, start and end dates by month and year, hours worked per week, and your salary or wages. Describe your duties and accomplishments in enough detail that a reviewer can see you have the specific experience the announcement requires.4USAJOBS Help Center. How Do I Write a Resume for a Federal Job? Mirror the terminology in the job announcement. If the posting asks for a specific tool or skill, use its exact name.
When the announcement lists a positive education requirement, meaning a degree or coursework is mandatory and cannot be substituted with experience, you have to submit transcripts. Official or unofficial transcripts are typically both accepted at the application stage, but leaving them out generally leads to disqualification no matter how much experience you have.4USAJOBS Help Center. How Do I Write a Resume for a Federal Job? A degree from a foreign institution needs an evaluation from a recognized credential evaluation service showing it is comparable to a U.S. accredited degree. Document any professional certifications or licenses relevant to the role.
After the announcement closes, HR reviews each application to confirm you meet the basic qualifications for the grade. If you pass that screening, you receive a referral notice saying your name has gone to the hiring manager. The manager reviews the referral list, decides whom to interview, and makes a selection. Timelines vary by agency, but removing the scoring and ranking steps generally makes the process faster than a traditional competitive announcement. An offer follows a successful interview, background investigation, and, where the position requires it, security clearance adjudication.
Negotiating Your Starting Salary
An offer at a General Schedule grade does not lock you into step 1. Agencies can set your starting pay at a higher step, up to step 10, under the superior qualifications and special needs pay-setting authority. Factors the agency can weigh include the level and quality of your skills compared to other candidates, disparities between federal and private-sector pay for the role, labor market conditions, recent turnover in similar positions, and how critical the role is to the agency’s mission.5U.S. Office of Personnel Management. Superior Qualifications and Special Needs Pay-Setting Authority
One rule to know before the conversation: the agency cannot consider your current or prior non-federal salary when setting your pay, and it should not ask for that information.5U.S. Office of Personnel Management. Superior Qualifications and Special Needs Pay-Setting Authority Build your case on qualifications and market conditions, not on what a private employer is paying you.
What You Get After You’re Hired
Being hired under direct hire authority gives you a career-conditional appointment in the competitive service, the same appointment type most new federal employees receive through traditional hiring. It converts automatically to full career tenure after three years of substantially continuous creditable service.6eCFR. 5 CFR Part 315 – Career and Career-Conditional Employment Career tenure carries reinstatement eligibility if you later leave federal service, broader transfer rights, and stronger retention standing during a reduction in force.
Probationary Period
You serve a one-year probationary period, the same as other competitive service appointees.7eCFR. 5 CFR 315.801 – Probationary Period; When Required During that year the agency evaluates whether you can perform the duties satisfactorily, and it has broader authority to remove you than it would after probation ends.
Appeal Rights During Probation
If the agency terminates you during probation, your appeal rights to the Merit Systems Protection Board are narrow:8eCFR. 5 CFR 315.806 – Appeal Rights to the Merit Systems Protection Board
- Termination for partisan political reasons or based on marital status.
- Termination that required specific procedures the agency did not follow.
- Discrimination based on race, color, religion, sex, national origin, age, or disability, but only in combination with one of the two grounds above.
Once you finish your probationary year and earn full competitive status, you gain the broader due-process protections that apply to tenured federal employees, including advance notice of a proposed removal and a right to respond before the agency acts.
