What Are the Presumptive Conditions for Gulf War Veterans?

The VA recognizes a long roster of presumptive conditions for Gulf War veterans, meaning the agency will automatically connect these illnesses to your service without you having to prove how they started. The list covers undiagnosed illnesses, medically unexplained chronic multisymptom illnesses, several infectious diseases, and, since the PACT Act of 2022, more than twenty cancers and respiratory conditions tied to burn pits and other toxic exposures.¹ One category carries a hard deadline: undiagnosed illnesses and chronic multisymptom illnesses must reach at least 10 percent disabling severity by December 31, 2026.²

Who Counts as a Gulf War Veteran

The presumptions only help if your service fits the VA’s definition. You qualify if you served on active duty in the Southwest Asia theater of operations on or after August 2, 1990. There is no end date, so deployments from Desert Shield through current operations are included.³

Under 38 CFR 3.317, the qualifying locations are Iraq, Kuwait, Saudi Arabia, the neutral zone between Iraq and Saudi Arabia, Bahrain, Qatar, the United Arab Emirates, Oman, the Gulf of Aden, the Gulf of Oman, the Persian Gulf, the Arabian Sea, the Red Sea, and the airspace above these areas.⁴ Service in Afghanistan on or after September 19, 2001, also qualifies for certain presumptive conditions. The VA’s Gulf War illness eligibility page adds Egypt, Israel, Jordan, Lebanon, Somalia, Syria, Turkey, and Yemen to the recognized locations.³

Undiagnosed Illnesses and Chronic Multisymptom Illnesses

These two categories cover most of what people mean by “Gulf War illness.” Symptoms must persist for at least six months.⁵

The VA specifically recognizes three medically unexplained chronic multisymptom illnesses:

Chronic fatigue syndrome
Fibromyalgia
Functional gastrointestinal disorders, including irritable bowel syndrome, functional dyspepsia, and functional abdominal pain syndrome

Any other illness defined by a cluster of signs or symptoms without a clear diagnosis may also qualify under this category.⁵

Undiagnosed illnesses are symptoms a doctor can observe or measure but cannot fit to any recognized diagnosis. Recognized symptoms include:

Abnormal weight loss
Persistent fatigue
Cardiovascular symptoms
Muscle and joint pain
Headaches
Menstrual disorders
Neurological and neuropsychological problems
Gastrointestinal problems
Skin conditions
Respiratory symptoms
Sleep disturbances

The list is not exhaustive. What matters is that the symptoms are real and measurable even without a diagnosis.⁵

The December 31, 2026 Deadline

For everything in this section, the condition must become at least 10 percent disabling no later than December 31, 2026. VA rulemaking has extended this date several times, most recently in a 2022 Federal Register notice.² If your symptoms might qualify, filing sooner protects the claim. The deadline does not apply to the infectious diseases, cancers, or respiratory conditions covered below.

Presumptive Infectious Diseases

Nine infectious diseases are presumptive for Gulf War veterans. Seven of them must reach at least 10 percent disabling within one year of separation from service:⁶

Brucellosis
Campylobacter jejuni
Coxiella burnetii (Q fever)
Malaria
Nontyphoid salmonella
Shigella
West Nile virus

Two have no diagnosis deadline because they can lie dormant for years: mycobacterium tuberculosis and visceral leishmaniasis.⁶

Cancers Added by the PACT Act

The Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics (PACT) Act, signed in August 2022, added more than 20 conditions to the presumptive list and created a formal presumption that veterans who served in qualifying locations were exposed to burn pits and other airborne toxins.¹ That exposure presumption removes a step you would otherwise have to prove.

The presumptive cancers for qualifying service on or after August 2, 1990, are:⁷

Brain cancer
Gastrointestinal cancer of any type
Glioblastoma
Head cancer of any type
Kidney cancer
Lymphoma of any type
Melanoma
Neck cancer of any type
Pancreatic cancer
Reproductive cancer of any type
Respiratory cancer of any type

There is no time limit on when the cancer must be diagnosed after separation. That matters for cancers with long latency.

Respiratory and Other Chronic Conditions

The PACT Act also added these conditions to the presumptive list:⁷

Asthma diagnosed after service
Chronic bronchitis
Chronic obstructive pulmonary disease (COPD)
Chronic rhinitis
Chronic sinusitis
Constrictive or obliterative bronchiolitis
Emphysema
Granulomatous disease
Interstitial lung disease
Pleuritis
Pulmonary fibrosis
Sarcoidosis

If you were diagnosed with any of these after serving in a qualifying location, the service connection is presumed.

Filing and the 10 Percent Rating Floor

A presumptive claim uses the same VA Form 21-526EZ as any other disability claim, filed online at VA.gov, by mail, or in person at a regional office. What you need to show is narrower than a standard claim: proof of service in a qualifying location during the qualifying period, and a current diagnosis of a presumptive condition (or documented symptoms, for undiagnosed illnesses).⁸

You still need to meet baseline VA eligibility. Service must have been on active duty, active duty for training, or inactive duty training, and your discharge must be under conditions other than dishonorable. The condition also has to rate at least 10 percent disabling to trigger monthly compensation.⁹

One point of confusion worth naming. The Gulf War Registry Health Exam is a free health screening that helps the VA track exposure-related illness, but it is not a claim. Completing the registry exam does not file anything for you; you still have to submit Form 21-526EZ to get benefits.¹⁰
