What Are Perkins Loans? Cancellation, Deferment, and Discharge

Perkins Loans were low-interest federal student loans issued directly by colleges, carrying a fixed 5% rate, no origination fees, and interest subsidized by the government while borrowers were in school. The program stopped issuing new loans after September 30, 2017, with final disbursements allowed through June 30, 2018. If you borrowed before then, your loan still exists under its original terms, and you still have access to the program’s cancellation, deferment, and discharge options.

How Your Existing Perkins Loan Works

Your loan carries a fixed 5% interest rate for its full life, with no origination or disbursement fees.1Consumer Financial Protection Bureau. What Is a Perkins Loan Because the loan is subsidized, the federal government covered interest while you were enrolled at least half-time and during the grace period after you left school. Interest only starts accruing once repayment begins.

You get a nine-month grace period after graduating, leaving school, or dropping below half-time enrollment before your first payment is due.2Federal Student Aid. When Do I Have to Pay Back My Perkins Loan Re-enrolling at least half-time before the grace period ends pauses it, and the full nine months starts fresh the next time you leave school. Brief stop-outs don’t burn the grace clock.3FSA Partner Connect. Perkins Repayment, Forbearance and Deferment

The standard repayment window is 10 years once payments begin. Schools can require a minimum monthly payment of $40, or $30 for certain loans originated before October 1992.4FSA Partner Connect. Perkins Repayment Plans, Forbearance, Deferment, Discharge, and Cancellation You can prepay any amount at any time without penalty.

One quirk trips up a lot of borrowers: you repay the school that made the loan, not the Department of Education.3FSA Partner Connect. Perkins Repayment, Forbearance and Deferment Many schools contract with third-party servicers to handle billing, so the name on your statement may be unfamiliar. If you can’t figure out where to send payments, start with your school’s financial aid or student accounts office.

Cancellation for Public Service Work

Federal regulations allow up to 100% cancellation of a Perkins Loan for borrowers working full-time in specific public service professions. The qualifying categories are narrow:5eCFR. 34 CFR Part 674 Subpart D – Loan Cancellation

  • Full-time teachers at a public or nonprofit elementary or secondary school serving low-income students, or full-time special education teachers at any public or nonprofit school
  • Full-time nurses or medical technicians providing health care services
  • Full-time firefighters, law enforcement officers, or corrections officers
  • Full-time Head Start staff, or employees of public or nonprofit child and family service agencies working directly with high-risk children from low-income communities

Cancellation runs on a five-year schedule tied to your original principal balance: 15% is forgiven in each of the first two years, 20% in the third and fourth years, and the remaining 30% after the fifth year.6eCFR. 34 CFR 674.52 – Cancellation Procedures Interest that accrued on the cancelled portion is wiped out alongside the principal each year.

You can switch between qualifying professions without restarting the schedule. Teach for two years, move into law enforcement, and your cancellation rate picks up at the third-year 20% level rather than resetting.6eCFR. 34 CFR 674.52 – Cancellation Procedures The exception involves switching into a category under a different regulatory section (specifically §674.58 or §674.60), which does restart the clock.

Taxes on Cancelled Amounts

Debt cancelled through Perkins service-based programs is excluded from your gross income under federal tax law. The Internal Revenue Code treats student loan forgiveness tied to working for a certain period in certain professions for qualifying employers as nontaxable.7Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness That distinction has grown more important because the temporary blanket tax exemption on all student loan forgiveness expired at the end of 2025. Borrowers receiving forgiveness through income-driven repayment plans in 2026 may owe federal tax on the forgiven amount, but Perkins cancellation through public service remains tax-free.

Should You Consolidate Into a Direct Loan?

A standalone Perkins Loan doesn’t qualify for income-driven repayment plans or Public Service Loan Forgiveness. To reach those programs, you have to roll the Perkins debt into a federal Direct Consolidation Loan.8Federal Student Aid. Public Service Loan Forgiveness The consolidated loan’s interest rate is a weighted average of the loans being combined, rounded up to the nearest one-eighth of a percent.9U.S. Department of Education. Loan Consolidation in Detail – Federal Consolidation Loans Terms and Conditions A standalone 5% Perkins Loan won’t change rate meaningfully. Mixing it with higher-rate loans will push the blended rate up.

Consolidation is irreversible, and it permanently ends your eligibility for Perkins-specific cancellation.10Consumer Financial Protection Bureau. If I Have a Perkins Loan and I Am Interested in Public Service Loan Forgiveness, What Do I Need to Know A nurse three years into the five-year cancellation schedule who consolidates would wipe out that progress and the remaining 50% benefit.

The limited PSLF waiver that gave consolidating borrowers retroactive credit for past qualifying payments on the underlying Perkins Loan closed on October 31, 2022. If you consolidate now, qualifying PSLF payments count from the consolidation date forward, though a weighted-average calculation may apply for borrowers who consolidate after September 1, 2024.8Federal Student Aid. Public Service Loan Forgiveness

The decision usually comes down to timing and profession. PSLF requires 120 qualifying monthly payments (10 years). Perkins cancellation takes five years of qualifying service and doesn’t require specific payment counts. If you’re already several years into a Perkins cancellation category, consolidating is likely to cost you more than it saves. If you don’t fit any Perkins cancellation category but you do work for a qualifying PSLF employer, consolidation is the only path to forgiveness.

If You Can’t Make Payments

Deferment pauses both payments and interest accrual. Forbearance pauses payments but lets interest keep piling up. The difference matters: use deferment when you qualify for it.

Deferment

Qualifying situations include returning to school at least half-time, economic hardship, unemployment, and military service. Economic hardship deferment is available for up to 36 months total, granted in one-year increments, and requires that your monthly income fall below 150% of the federal poverty guideline for your family size. Perkins borrowers also receive an additional six-month post-deferment grace period after an economic hardship deferment ends, before payments resume.11Federal Student Aid. Economic Hardship Deferment Request

Forbearance

Schools must grant forbearance in certain situations even without a deferment qualifier. These include medical or dental residency programs, National Guard active duty lasting more than 30 consecutive days, service under a Department of Defense student loan repayment program, and situations where your total federal student loan payments equal or exceed 20% of your gross monthly income. Because interest accrues the entire time and gets added to your balance, forbearance works best as a last stop before default rather than a first option.

What Default Costs You

The regulatory definition of default is broad: any failure to make an installment when due. In practice, your servicer will report late payments to credit bureaus after 30 days, and you’re formally in default once you’re 240 days past due on monthly payments. At that point, the school can accelerate the loan, making the entire remaining balance due immediately, and begin adding collection costs.

Those costs are steep. The first collection effort can tack on charges equal to 30% of the principal, interest, and late charges collected. Subsequent collection efforts raise that cap to 40%. If the school sues, court costs come on top of the 40%.12FSA Partner Connect. Perkins Loan Billing, Collection, and Default The school can also assign the defaulted loan to the Department of Education, which opens up federal collection tools including wage garnishment and Treasury offset of tax refunds.

Rehabilitation requires nine consecutive on-time monthly payments at an amount the school sets. A payment counts as on time if it arrives within 20 days of the due date. Once you finish the nine payments, the school must return you to regular repayment status within 30 days. Rehabilitation is technically available a second time if you default again, but each cycle piles on more collection costs.

Discharge for Death or Disability

A Perkins Loan is discharged in full if the borrower dies. The school cancels the remaining balance after receiving a death certificate or verifying the death through an approved federal or state electronic database.13eCFR. 34 CFR 674.61 – Discharge for Death or Disability Under exceptional circumstances, the school’s chief financial officer can approve discharge based on other reliable documentation.

Borrowers who become totally and permanently disabled can apply for discharge through the Department of Education, not the school. The Secretary coordinates with all lenders to suspend collection for up to 120 days while the application is reviewed.13eCFR. 34 CFR 674.61 – Discharge for Death or Disability Qualifying documentation includes certification from a physician, a VA disability determination, or a Social Security Administration disability finding.
