VA IRRRL Refinance: Eligibility, Recoupment, and Costs

To qualify for a VA Interest Rate Reduction Refinance Loan, you need an existing VA-backed mortgage you have held long enough to satisfy the seasoning rules, a refinance that delivers a real benefit under federal standards, and closing costs low enough to be recovered within 36 months through your lower payment. Those are the VA IRRRL requirements at their core. Everything else — what your lender asks for on top, what fees you can be charged, whether you owe the funding fee — flows from those three anchors.

Who Can Use an IRRRL

The program is only available to refinance an existing VA-guaranteed loan. Federal law authorizes the VA to guarantee a refinance only when the borrower is replacing an existing VA-backed obligation.1Office of the Law Revision Counsel. 38 U.S.C. 3710 – Purchase or Construction of Homes Conventional, FHA, and USDA mortgages cannot be refinanced through this program. If your current mortgage is not VA-backed, the IRRRL is not the right product; a VA cash-out refinance is a separate product with different rules.

You must certify that you currently live in, or previously lived in, the home as your primary residence.2U.S. Department of Veterans Affairs. Interest Rate Reduction Refinance Loan That prior-occupancy allowance is important: veterans who moved, were reassigned, or now rent the property out can still refinance it through this program.

Surviving spouses of veterans who died from service-connected causes may also use an IRRRL if they already have a VA-backed loan on the property.3U.S. Department of Veterans Affairs. Home Loans for Surviving Spouses

Seasoning: How Long You Have to Wait

You cannot refinance the moment you close on a VA loan. Two conditions must both be met before the new loan closes:

  • At least 210 days must have passed since the first monthly payment came due on your current mortgage.
  • You must have made at least six consecutive monthly payments on that loan.

Both are measured as of the closing date of the refinance, not the application date.4Department of Veterans Affairs. Circular 26-19-22 – Clarification and Updates to Policy Guidance for VA IRRRLs The VA audits for a payment history or credit supplement showing every payment during that window was made on time. These seasoning rules exist because the VA saw a pattern of rapid-fire refinancing where lenders churned borrowers into new loans every few months, collecting origination fees each time while the veteran’s principal balance grew.

The Net Tangible Benefit Test

Every IRRRL must pass a net tangible benefit test proving the new loan actually improves your financial position. The regulation lays out specific qualifying scenarios: your new monthly principal and interest payment is lower, the loan term is shorter, or you are converting from an adjustable-rate mortgage to a fixed rate.5eCFR. 38 CFR 36.4307 – Interest Rate Reduction Refinancing Loan Converting from an adjustable rate to a fixed rate counts as a benefit even if the new rate is slightly higher, because you gain payment predictability over the remaining life of the loan.

The regulation also permits an IRRRL that slightly increases your payment if the extra cost comes from rolling in up to $6,000 in energy-efficient home improvements.6U.S. Department of Veterans Affairs. Energy Efficiency and VA Home Loans The VA Secretary can also approve a loan that otherwise fails the test if it is necessary to prevent imminent foreclosure.5eCFR. 38 CFR 36.4307 – Interest Rate Reduction Refinancing Loan

The 36-Month Recoupment Rule

On top of the net tangible benefit test, a separate federal statute requires that every fee and closing cost you incur be recoverable within 36 months through your lower monthly payment.7Office of the Law Revision Counsel. 38 U.S.C. 3709 – Refinancing of Housing Loans This is the math that kills borderline refinances. If your closing costs total $3,000 but your monthly payment drops only $70, you would need roughly 43 months to break even. The VA cannot guarantee that loan.

The recoupment calculation excludes taxes, escrow amounts, and the VA funding fee itself. Only the reduction in your principal and interest payment counts toward recouping costs.7Office of the Law Revision Counsel. 38 U.S.C. 3709 – Refinancing of Housing Loans The lender must certify the recoupment period to the VA before the loan can close. If a lender tells you not to worry about the math, that is exactly when you should worry.

What an IRRRL Costs

The 1% Origination Cap

The VA tightly controls what lenders can charge. The primary limit is a 1% origination fee based on the payoff amount of the existing loan.8eCFR. 38 CFR 36.4313 – Charges and Fees That flat charge has to cover all origination-related costs. If a lender charges less than the full 1%, it may add other fees, but the combined total still cannot exceed 1%.9U.S. Department of Veterans Affairs. Circular 26-14-10 – Policy Clarification on Unallowable Fees

Allowable Third-Party Costs

Separately from origination, you can be charged for a limited set of third-party costs: recording fees and taxes, the credit report, title examination and title insurance, flood zone determination, and a survey if one is requested.8eCFR. 38 CFR 36.4313 – Charges and Fees Most of these can be rolled into the new loan balance, but doing so increases what you owe and extends the time to recoup under the 36-month rule.

The VA Funding Fee

The VA charges a funding fee on every IRRRL, set at 0.5% of the total loan amount.10U.S. Department of Veterans Affairs. VA Funding Fee and Loan Closing Costs Unlike purchase loan fees, this rate does not vary based on your down payment or how many times you have used the VA loan program. On a $250,000 refinance, the fee is $1,250. You can pay it upfront or roll it into the loan balance.11Office of the Law Revision Counsel. 38 U.S.C. 3729 – Loan Fee

Three groups are exempt from the funding fee entirely: veterans receiving VA disability compensation for a service-connected condition (including those found eligible through a pre-discharge exam), surviving spouses of veterans who died from a service-connected disability, and active-duty service members awarded the Purple Heart who provide evidence of the award before loan closing.11Office of the Law Revision Counsel. 38 U.S.C. 3729 – Loan Fee If you qualify, make sure your lender has the documentation before closing. Paying a fee you are exempt from means chasing a refund afterward.

What Your Lender Requires Beyond the VA’s Rules

The “streamline” label can mislead. The VA itself does not require income verification, employment documentation, a debt-to-income calculation, or a minimum credit score for an IRRRL. Its rules focus on the loan’s terms: seasoning, net tangible benefit, and 36-month recoupment.

You are not borrowing from the VA, though. You are borrowing from a private lender that sets its own conditions on top of the VA’s. These lender overlays commonly include a minimum credit score between 580 and 640, verbal verification of employment, and sometimes full income documentation. Overlays vary significantly, so a denial from one lender does not mean the program is unavailable to you. The VA advises borrowers to contact several lenders to compare options.2U.S. Department of Veterans Affairs. Interest Rate Reduction Refinance Loan

Situations That Complicate an IRRRL

Second Mortgages

If you have a second mortgage or home equity line of credit on the property, the holder of that second lien must agree to subordinate its position so the new VA loan remains the first mortgage.2U.S. Department of Veterans Affairs. Interest Rate Reduction Refinance Loan This is non-negotiable. Without subordination, the VA will not guarantee the new loan. Start the request early; some second-lien holders agree quickly, others drag their feet or refuse.

No Cash at Closing

An IRRRL is strictly a rate-and-term refinance. You cannot pull equity out of your home through this program.12U.S. Department of Veterans Affairs. Refinancing Options – VARO St. Paul The new loan amount is limited to the payoff balance of your existing mortgage plus allowable fees and costs. If you need cash out, the VA cash-out refinance is the separate product designed for that, with its own eligibility rules and a higher funding fee.

Divorce and Joint Loans

A divorce decree awarding the home to one spouse does not remove the other spouse from the VA loan. Both borrowers remain liable to the lender until the loan is refinanced into one person’s name or paid off. An IRRRL can replace a joint loan with one in the veteran’s name alone if the veteran keeps the home. If the non-veteran spouse keeps the home, an IRRRL is not available to them because they have no VA eligibility of their own.

Predatory Solicitation Warnings

If you have a VA loan, you have probably received unsolicited mailers or calls promising impossibly low rates, skipped payments, or thousands in cash back. The VA and the Consumer Financial Protection Bureau have issued joint warnings about these tactics.13U.S. Department of Veterans Affairs. VA and the Consumer Financial Protection Bureau Warn Against Home Loan Refinancing Offers That Sound Too Good To Be True Common red flags include advertised rates that turn out to apply only to 15-year terms or adjustable products, promises that you can skip payments as a “benefit,” and mailers designed to look like official government correspondence.

The VA specifically prohibits lenders from advertising skipped payments as a way to obtain cash from an IRRRL.13U.S. Department of Veterans Affairs. VA and the Consumer Financial Protection Bureau Warn Against Home Loan Refinancing Offers That Sound Too Good To Be True Closing costs advertised as “no out-of-pocket” are generally being rolled into your loan balance, which increases what you owe. If a lender is pressuring you to refinance a month or two after your last closing, walk away. The seasoning rules exist precisely to prevent that kind of churn.
