The VA claims backlog is the group of disability compensation and pension claims that have been sitting at the Department of Veterans Affairs for more than 125 days without a decision, and it currently holds about 88,000 claims out of roughly 575,000 pending overall.1Department of Veterans Affairs. You can lock in your effective date, request priority handling if you qualify, and prepare for a decision review the moment your letter arrives.
What Counts as Backlogged
The VA tracks two numbers on its public dashboard. Total inventory is every claim in the system, from ones filed yesterday to ones nearly finished. The backlog is the subset pending more than 125 days, which is the VA’s own performance standard for how long a claim should take.3U.S. Department of Veterans Affairs. These numbers move constantly. If you want a current snapshot rather than whatever figure a news article happens to quote, the VA’s detailed claims data page updates on a regular schedule.1Department of Veterans Affairs. Detailed Claims Data – Veterans Benefits Administration Reports
Why Claims Get Stuck
The biggest recent driver was the PACT Act, signed in August 2022, which created presumptive service connection for conditions tied to burn pits, Agent Orange, and other toxic exposures. Veterans no longer had to build the causal link themselves, and nearly 3 million PACT Act–related claims were filed between August 2022 and September 2025.4Department of Veterans Affairs. Compensation and Pension exams are where individual claims most often stall. The VA schedules these medical evaluations to document how severe your conditions are, and they’re often run by third-party contractors. If you need to reschedule with a contractor, the new appointment has to land within five days of the original, or the scheduling process restarts.5Veterans Affairs. VA Claim Exam (C&P Exam)
Missing a C&P exam is one of the worst things you can do. The VA can decide your claim on whatever evidence it already has, which usually means a lower rating or a denial.5Veterans Affairs. VA Claim Exam (C&P Exam) Treat the scheduling notice like a court date.
Where Your Claim Is in the Process
The VA breaks the process into eight steps, and knowing which one your claim is in tells you whether it’s moving or truly stuck:6Veterans Affairs. The VA Claim Process After You File Your Claim
- Claim received. Online filings confirm on-screen; paper filings take about a week plus mail time.
- Initial review. Staff check for missing basics like name and Social Security number.
- Evidence gathering. Usually the longest step. The VA collects records and orders your C&P exam.
- Evidence review. A reviewer checks what came in. Gaps push the claim back to Step 3.
- Rating. A specialist assigns your disability percentage. Gaps here also push the claim back to Step 3.
- Preparing decision letter. The VA drafts your rating, monthly amount, and payment start date.
- Final review. A senior reviewer double-checks the decision.
- Claim decided. Your letter becomes available online, with a paper copy following in about 10 business days.
Most claims that cross the 125-day line got there because they cycled between Steps 3 and 5 while evidence gaps were filled. Submitting complete medical records at filing and showing up to your first scheduled C&P exam are the two things most within your control.
Protecting Your Effective Date
Here is the part of the backlog most veterans misunderstand: waiting does not cost you money on your monthly award. Your effective date is when your payments start, and it is usually the date the VA received your claim or the date your disability began, whichever is later.7Office of the Law Revision Counsel. 38 USC 5110 – Effective Dates of Awards If your claim takes 200 days and gets approved, your back pay covers the entire period from your effective date to the decision.8Veterans Affairs. Disability Compensation Effective Dates
File within one year of leaving active duty and your effective date can reach back to the day after discharge. For PACT Act claims filed within one year of the law’s effective date, the effective date may be the date the law changed rather than your filing date.8Veterans Affairs. File an Intent to File Before You’re Ready
If you are still collecting medical records, do not wait until the file is complete. Submit an Intent to File using VA Form 21-0966. That sets a potential effective date immediately and gives you a full year to file the completed claim.9Veterans Affairs. Your Intent to File a VA Claim If your claim is later approved, retroactive payments can cover the gap between the Intent to File and the final decision.10Veterans Affairs. VA Form 21-0966
You can only have one active Intent to File at a time, and each one applies to a single benefit type. Filing for both disability compensation and pension takes two separate filings.9Veterans Affairs. Your Intent to File a VA Claim
Requesting Priority Processing
Certain situations let you jump the standard queue. Submit VA Form 20-10207 with supporting documentation, and the VA will move your claim to priority handling if you fall into one of these categories:11Veterans Affairs. About VA Form 20-10207
- Extreme financial hardship. Attach an eviction notice, foreclosure statement, past-due utility bills, or collection notices.
- Terminal illness. Attach medical records showing the diagnosis is terminal.
- Age 85 or older. Proof of date of birth is the only documentation needed.
- Very Seriously Injured or Ill. Applies to injuries from military operations likely to result in discharge. Provide military personnel records and medical evidence of the severe disability.
- Medal of Honor recipients and former Prisoners of War. Priority granted as a matter of policy.
The financial hardship category is the one most veterans overlook. If a utility shutoff is looming or creditors are sending collection notices while your claim waits in line, file the form with copies of those notices attached.12Department of Veterans Affairs. If You Are Denied or Underrated
A decision you disagree with is not the end. The VA’s decision review system gives you three paths, and which one you pick depends on what went wrong:13Veterans Affairs. Choosing a Decision Review Option
- Supplemental Claim (VA Form 20-0995). Use this when you have new and relevant evidence the VA did not consider. The VA will help gather records you identify. Supplemental Claims averaged about 61 days to complete as of early 2026.14Veterans Affairs. Supplemental Claims
- Higher-Level Review (VA Form 20-0996). Use this when you believe the original decision contains an error and you have no new evidence. A more senior reviewer examines the existing record. An optional informal conference is available and may add processing time.13Veterans Affairs. Choosing a Decision Review Option
- Board Appeal (VA Form 10182). A Veterans Law Judge reviews your case. You pick from three dockets: Direct Review, Evidence Submission, or Hearing. Board Appeals take significantly longer, with the VA’s target at 365 days for Direct Review and longer for the other dockets.13Veterans Affairs. Choosing a Decision Review Option
The deadline that matters most: you have one year from the date on your decision letter to request a Higher-Level Review or Board Appeal. Supplemental Claims can technically be filed at any time, but filing within that one-year window preserves your original effective date.15Veterans Affairs. Decision Reviews FAQs Miss it, and a later filing resets your effective date to the date the VA receives the new claim.7Office of the Law Revision Counsel. 38 USC 5110 – Effective Dates of Awards Mark the date on your calendar the day the letter arrives.
Tracking Your Claim
The VA.gov claim status tool shows which of the eight steps your claim is on, whether the VA needs anything from you, and whether a decision has been made.16Veterans Affairs. Check Your VA Claim, Decision Review, or Appeal Status The same portal tracks decision reviews and appeals, and a separate resource page explains what each status term means.17Veterans Affairs. What Your Claim Status Means
Once your claim reaches “Claim decided,” you can download the decision letter as a PDF before the paper copy arrives.18VA News. View and Download Your VA Decision Letters Online Getting the letter immediately means your one-year deadline for a review is not eaten into by postal delivery.
If your claim looks stuck in “Evidence gathering” for weeks with no visible movement, a Veterans Service Officer can look inside the system and tell you exactly what the holdup is: a records request to a private doctor, a pending exam, or something waiting on another agency. Officers with organizations like the VFW, DAV, and American Legion work for free, and having one involved is often the only way to get a specific answer when the online tool just keeps showing the same status.
