The USPTO trademark fee schedule starts at $350 per class for an electronically filed application and layers on per-class charges at every later stage, from statements of use through five-year maintenance filings and ten-year renewals.1United States Patent and Trademark Office. Application Filing Fees
Every electronically filed trademark application costs $350 per class of goods or services. Before January 2025, the USPTO offered two tracks: TEAS Plus at $250 per class and TEAS Standard at $350 per class. That distinction is gone. There is now one base fee, and choices you make inside the application decide whether you owe more on top of it.2United States Patent and Trademark Office. Summary of 2025 Trademark Fee Changes
Two add-ons can push the cost higher. Writing your own description of goods or services instead of picking pre-approved entries from the USPTO’s Trademark ID Manual adds $200 per class. If a free-form description runs longer than 1,000 characters, each additional 1,000-character block costs another $200 per affected class. A separate $100-per-class fee applies when the USPTO determines an application was filed with insufficient information.4eCFR. 37 CFR 2.6 – Trademark Fees Pulling descriptions straight from the ID Manual keeps the application at $350 per class; a custom description starts you at $550.
Paper applications cost $850 per class.4eCFR. 37 CFR 2.6 – Trademark Fees
Why Classes Multiply Every Fee
The international classification system divides commercial goods and services into 45 categories. Goods sit in Classes 1–34 and services in Classes 35–45.5United States Patent and Trademark Office. Goods and Services You pay the filing fee for each class in your application, so a business selling clothing (Class 25) that also runs a retail store (Class 35) pays twice.
That per-class structure runs through nearly every fee on the schedule. Maintenance filings, statements of use, oppositions, and appeals all multiply by the number of classes on the registration. A three-class filing that feels manageable at the outset gets noticeably more expensive at the ten-year renewal.
Intent-to-Use Costs
If you have not yet used the mark in commerce, you can file based on a bona fide intention to use it.6Office of the Law Revision Counsel. 15 US Code 1051 – Application for Registration; Verification The $350 base fee is the same, but you will owe more later to prove actual use.
Once the USPTO approves the mark and it publishes without opposition, you receive a Notice of Allowance. You then have six months to file a Statement of Use showing the mark is in commerce. The Statement of Use costs $150 per class.1United States Patent and Trademark Office. USPTO Fee Schedule If you are not ready, you can buy a six-month extension for $125 per class. Up to five extensions are allowed (three years total from the Notice of Allowance), and any extension beyond the first requires a showing of good cause.4eCFR. 37 CFR 2.6 – Trademark Fees
Maintenance and Renewal Fees
Registration is not permanent. The USPTO requires periodic proof that the mark is still in commercial use, and missing a deadline means cancellation.7Office of the Law Revision Counsel. 15 US Code 1058 – Duration, Affidavits and Fees
Section 8 Declaration (Years 5 to 6)
Between the fifth and sixth anniversaries of registration, you must file a Section 8 Declaration confirming the mark is still in use. The fee is $325 per class. A six-month grace period is available with a $100-per-class surcharge. Miss the grace period and the registration is cancelled with no way to revive it.1United States Patent and Trademark Office. USPTO Fee Schedule
Section 9 Renewal (Year 10, Then Every 10 Years)
Between the ninth and tenth anniversaries, you file a combined Section 8 Declaration and Section 9 Renewal Application. The Section 9 fee is $325 per class, the Section 8 declaration is another $325 per class, for a combined $650 per class electronically. The same six-month grace period and $100-per-class surcharge apply to a late renewal, and the combined filing repeats every ten years.9eCFR. 37 CFR 2.6 – Trademark Fees
Section 15 Declaration of Incontestability
After five consecutive years of post-registration use, you can file an optional Section 15 Declaration of Incontestability for $250 per class.8United States Patent and Trademark Office. Summary of 2025 Trademark Fee Changes It significantly limits the grounds on which someone can later challenge the registration. Many owners file it alongside their Section 8 Declaration because the timing lines up.
TTAB Filing Fees
The Trademark Trial and Appeal Board handles disputes over trademark registrations. Its filing fees are among the highest on the schedule, and all three apply per class:
- Notice of Opposition to block a published application: $600 per class.
- Petition for Cancellation of an existing registration: $600 per class.
- Ex Parte Appeal from an examiner’s final refusal: $225 per class.
Opposing a three-class application therefore costs $1,800 in filing fees before any other litigation expense.1United States Patent and Trademark Office. USPTO Fee Schedule
Petitions and Other Administrative Fees
Several fees cover situations where something goes wrong during examination or after registration:
- Petition to revive an abandoned application: $250 electronically.
- General petition to the Director: $400.
- Letter of protest filed by a third party during examination: $150.
Each of these rose in January 2025. The petition to revive went from $150 to $250, and the letter of protest tripled from $50 to $150.2United States Patent and Trademark Office. Summary of 2025 Trademark Fee Changes Paper versions of each cost $100 more.4eCFR. 37 CFR 2.6 – Trademark Fees
Assignments, Corrections, and International Filings
Recording an assignment when a trademark is sold or transferred costs $40 for the first mark in a document and $25 for each additional mark in the same document.1United States Patent and Trademark Office. USPTO Fee Schedule A new certificate of registration (for example, reflecting a name change) costs $100, as does a certificate of correction when the error is the registrant’s.4eCFR. 37 CFR 2.6 – Trademark Fees
To extend U.S. protection abroad through the Madrid Protocol, the USPTO charges a certification fee of $100 per class when the international application is based on a single U.S. application or registration, or $150 per class when it is based on more than one.1United States Patent and Trademark Office. USPTO Fee Schedule Separate international fees are paid directly to the World Intellectual Property Organization and vary by country.
Paper Filing Surcharges
Nearly every fee on the schedule has a higher paper rate. A few examples:
- Application: $850 per class on paper versus $350 electronically.
- Statement of Use: $250 per class on paper versus $150 electronically.
- Section 9 Renewal: $525 per class on paper versus $325 electronically.
- Petition to Revive: $350 on paper versus $250 electronically.
The paper premium ranges from $100 to $500 depending on the document.4eCFR. 37 CFR 2.6 – Trademark Fees
What a Single Trademark Costs Over Ten Years
A one-class trademark filed electronically with ID Manual descriptions and no intent-to-use complications costs $350 to file, $325 to maintain between years five and six, and $650 for the combined declaration and renewal at year ten. That is $1,325 in USPTO fees across the first decade, before any attorney fees. Add a second class and the total roughly doubles. Add an intent-to-use filing with a couple of extensions and you are past $2,000 before the mark registers.
