USPTO trademark application fees start at $350 per class of goods or services for a standard electronic filing, and that per-class structure runs through nearly every later fee the office charges. What you actually pay depends on how many classes you file in, whether you write custom descriptions, whether the mark is already in use, and whether you keep the registration alive through the required maintenance filings.
The Base Filing Fee
As of January 18, 2025, the USPTO charges a single base application fee of $350 per class for electronic filings under Sections 1 and 44 of the Trademark Act.1United States Patent and Trademark Office. How you describe your goods or services still moves the price. If you write a custom free-form description instead of picking entries from the USPTO’s Trademark ID Manual, an extra $200 per class applies, bringing the total to $550 per class.2United States Patent and Trademark Office. How Classes Multiply the Cost
Every trademark fee is charged per class, and total cost scales directly with how many classes you file. The USPTO follows the Nice Classification, which covers goods in Classes 1 through 34 and services in Classes 35 through 45.5United States Patent and Trademark Office. Three classes at the base rate is $1,050. Add the custom-description surcharge to each and it becomes $1,650. Picking the wrong class leaves gaps in protection; selecting unnecessary classes wastes money on coverage you don’t need. Time spent with the Nice headings and the ID Manual before filing is the cheapest thing you can do.
Extra Fees If You File Before Using the Mark
You can file based on a bona fide intent to use the mark in commerce, but this path adds later fees. The base $350 per class still applies. After the USPTO approves the mark and issues a Notice of Allowance, you have six months to file a Statement of Use, which costs $150 per class.3United States Patent and Trademark Office. If you need more time, extensions cost $125 per class per request.3United States Patent and Trademark Office. USPTO Fee Schedule You get up to five extensions, giving you a maximum of 36 months from the Notice of Allowance to file the Statement of Use.6United States Patent and Trademark Office. Trademark Applications – Intent-to-Use (ITU) Basis Using all five extensions for a single-class application costs $625 in extension fees, plus the $150 Statement of Use. That’s $775 on top of your original $350, and many applicants don’t plan for it.
Maintenance and Renewal Fees
Getting registered isn’t the finish line. The USPTO requires periodic filings to prove the mark is still in use. Miss a deadline and you lose the registration.
Section 8 Declaration of Use
Between the fifth and sixth anniversaries of the registration date, file a Section 8 Declaration of Use with a specimen showing the mark in commerce.7United States Patent and Trademark Office. Section 15 Declaration of Incontestability
You can file an optional Section 15 Declaration of Incontestability for $250 per class alongside the Section 8.2United States Patent and Trademark Office. Ten-Year Renewal
Every ten years, renew by filing a combined Section 8 declaration and Section 9 renewal. Electronic filing is $650 per class ($325 for each filing).2United States Patent and Trademark Office. Fees If Something Goes Wrong
Not every application clears examination cleanly, and disputes can surface at any stage. The USPTO charges separate fees for each of these:

TTAB opposition and cancellation proceedings function like mini-trials, and attorney fees typically dwarf the $600 filing cost.
How to Pay
The USPTO accepts four payment methods for electronic trademark filings: Visa, Mastercard, American Express, and Discover credit cards; electronic funds transfer from a U.S. bank account through ACH; and USPTO deposit accounts, which are prepaid balances useful for frequent filers.
