USCIS expedited processing is a discretionary, no-fee way to move a pending immigration application ahead of others in line when your circumstances meet one of a handful of narrow grounds. There is no guaranteed timeline and no guaranteed approval — the officer reviewing your request decides whether the facts you present are compelling enough to pull your case out of order.
Check Premium Processing First
USCIS will not consider an expedite request if premium processing is available for your form type.1U.S. Citizenship and Immigration Services. Expedite Requests Premium processing currently covers Form I-129 (nonimmigrant worker petitions), Form I-140 (employment-based immigrant petitions), certain categories of Form I-765 (employment authorization), and certain classifications of Form I-539 (change or extension of nonimmigrant status).2U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service If your application falls into one of those categories, you file Form I-907 with the applicable fee instead of asking for an expedite.
One narrow exception: an IRS-designated nonprofit organization seeking to bring in someone whose services further the cultural or social interests of the United States can request an expedite even when premium processing exists for the form, and does not have to pay the premium fee.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests
Premium processing guarantees USCIS action within a set number of business days, though the action may be an approval, a denial, a request for evidence, or a notice of intent to deny.4U.S. Citizenship and Immigration Services. How Do I Request Premium Processing Expedite requests carry no equivalent guarantee. When both are technically available to you, premium processing is almost always the more reliable route.
Grounds USCIS Will Consider
The USCIS Policy Manual lists specific categories that may justify an expedite. Meeting a category does not guarantee approval; each request is evaluated at the agency’s sole discretion.
Severe Financial Loss
A company or individual can request an expedite by showing that continued delay would cause serious financial harm.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests A business might point to a major contract about to be lost, forced layoffs, or significant revenue loss. For individuals, the standard is that the delay would prevent them from meeting basic needs. Important catch: USCIS will not accept the argument if the financial urgency exists because you filed late or missed a deadline to respond to a request for evidence.
Emergencies and Urgent Humanitarian Situations
This category covers pressing circumstances tied to human welfare, including serious illness or disability, a family death, or extreme living conditions caused by natural disaster or armed conflict.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests USCIS has also used the category to expedite employment authorization for healthcare workers during a pandemic. A difficult but stable situation rarely qualifies; the operative word is “pressing.”
Nonprofit Furthering U.S. Cultural or Social Interests
An IRS-designated nonprofit can request an expedite by showing that a specific beneficiary’s role at the organization furthers the cultural or social interests of the United States.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests USCIS focuses on the individual’s role, not the organization’s general mission. A broad staffing shortage is not enough. The employer needs to explain why this particular person is urgently needed — a medical researcher on a socially significant project, a professor tied to an imminent cultural program, a religious worker central to a specific outreach effort.
Government Interests
A government entity — federal, state, tribal, territorial, or local — can identify a case as urgent based on public safety, national security, or another pressing government interest. The request must come from someone authorized to represent that agency on the matter, such as an official, manager, or tribal leader.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests Where a federal agency identifies an articulable federal interest, USCIS generally defers to that agency’s assessment.
Clear USCIS Error
If USCIS made a mistake — issuing an employment authorization document with wrong information, losing a file, failing to send a required notice — and that error is creating an urgent problem, you can request an expedite to correct it.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests Documenting real harm caused by the error matters; showing the mistake alone does not.
Evidence That Carries the Request
The strength of your documentation is what separates approved expedites from denied ones, and your evidence needs to connect directly to the specific ground you claim. USCIS will ask for supporting documents after you initiate the request, so organizing everything in advance saves time.
For humanitarian or medical situations, gather hospital records, a physician’s letter describing the condition and its urgency, and proof of your relationship to the affected person (birth or marriage certificate). Financial loss claims call for bank statements, contracts at risk, projected revenue losses, or a letter from an employer explaining the business impact. Government interest requests need a formal letter on official letterhead signed by an authorized representative.
Before contacting USCIS, have your 13-character receipt number ready — it is the identifier on your Form I-797 Notice of Action that USCIS uses to locate the case.5U.S. Citizenship and Immigration Services. Checking Your Case Status Online Any supporting document not in English needs a certified translation with the translator’s signed statement of accuracy and competence.
A short cover letter that summarizes your situation, names the expedite criterion you are invoking, and lists what you are enclosing gives the officer a roadmap. Label each document so it matches the criterion without guesswork.
How to Submit the Request
Three channels initiate an expedite request. All of them create a service request that routes to the USCIS office holding your case.
The most common method is calling the USCIS Contact Center at 1-800-375-5283. Live representatives are available Monday through Friday, 8 a.m. to 8 p.m. Eastern time.6U.S. Citizenship and Immigration Services. USCIS Contact Center When the automated system asks why you are calling, say “expedite” to reach a live agent. Have the receipt number ready before you dial.
You can also use the “Emma” virtual assistant on the USCIS website. Typing “expedite” into the chat connects you to a live assistant during business hours who can create the service request.1U.S. Citizenship and Immigration Services. Expedite Requests
If you have a USCIS online account with secure messaging, you can select “expedite” as the reason for your inquiry and submit the request in writing, uploading supporting evidence directly through the account.1U.S. Citizenship and Immigration Services. Expedite Requests Some case types follow different expedite procedures. Asylum, humanitarian parole, T and U visa cases, and appeals each have their own process, so check the USCIS expedite page for those specifics.
Travel Documents: Special Rules
Expedite requests for Form I-131 travel documents are among the most common, and they have their own standard. USCIS will consider the request when you show a pressing or critical need to travel outside the United States. A vacation does not qualify.1U.S. Citizenship and Immigration Services. Expedite Requests
Travel situations USCIS recognizes, and the evidence each one calls for:
- Death of a family member or close friend — a letter from a funeral home or hospital, a death certificate or obituary, and proof of your relationship to the deceased.
- Serious illness of a family member or close friend — a doctor’s letter stating the medical situation is pressing, plus proof of the relationship.
- Your own medical treatment abroad — a doctor’s letter explaining why the treatment is critical and cannot wait.
- Professional commitment — a letter on company letterhead, a meeting agenda or formal invitation, and an explanation of why the commitment is pressing.
- Academic commitment — a letter from your institution and documentation showing why attendance is time-sensitive.
Submit travel-related expedite requests at least 45 days before your planned departure. If you have a USCIS online account, upload the evidence there in addition to contacting the Contact Center.1U.S. Citizenship and Immigration Services. Expedite Requests
What Happens After You Submit
Once the request is logged, USCIS typically sends instructions for submitting supporting evidence, often by upload through your online account or by fax to a designated number. The agency does not publish a guaranteed response time for expedite decisions.
Approval of the expedite is not approval of the underlying application. Your case moves ahead of the standard queue, and then USCIS decides it on the merits, which can still include a denial.1U.S. Citizenship and Immigration Services. Expedite Requests
Even after an expedite is granted, several things can slow the case down:1U.S. Citizenship and Immigration Services. Expedite Requests
- Pending biometrics, interviews, or medical exams that must be completed before adjudication.
- Background and security checks run through third-party agencies on their own timeline.
- On-site inspections required for some petition types.
- Dependent applications tied to a principal applicant’s petition that has not yet been decided.
If the Request Is Denied
USCIS generally does not explain why it denies an expedite request, and there is no formal appeal.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests You can file a new request if your circumstances change or you obtain stronger evidence. Resubmitting the same arguments with the same documents rarely produces a different outcome.
Congressional Inquiry
Contacting the office of your U.S. Senator or Representative is one of the more effective escalation paths when a case has stalled. Most congressional offices keep casework staff for immigration matters, and they submit an inquiry to the USCIS office handling your file after you sign a privacy release. For email inquiries, congressional offices can typically expect an initial response within five business days and resolution within 30 calendar days.7U.S. Citizenship and Immigration Services. Congressional Inquiries Refresher for Legislative Staff The inquiry does not force USCIS to approve anything, but it puts eyes on the case.
CIS Ombudsman
The DHS Office of the Citizenship and Immigration Services Ombudsman can help when you have exhausted normal channels. To qualify for assistance with a processing delay, you must have submitted an inquiry to USCIS through one of its customer service tools within the past 90 days and given the agency at least 60 days to respond.8Department of Homeland Security. Types of Cases the CIS Ombudsman Can and Cannot Help With The Ombudsman focuses on delays, not on reversing discretionary denials of an expedite request.
Assistance is requested through DHS Form 7001, which asks for your receipt number, copies of correspondence with USCIS, documentary evidence of hardship caused by the delay, and a description of the steps you already took to resolve the issue directly with USCIS.9Department of Homeland Security.
