If a genuine emergency forces you to leave the country while an immigration application is pending, USCIS can issue an emergency advance parole document at a local field office, sometimes within days, so you can travel and return without abandoning your case. The threshold for this fast track is a pressing need to depart within 15 days, documented well enough to satisfy an officer.1U.S. Citizenship and Immigration Services. Emergency Travel You request the appointment through the USCIS Contact Center, then show up with a completed Form I-131, proof of the emergency, photos, and the fee.
Who Actually Needs This
Advance parole matters most if you have a pending Form I-485 adjustment of status application. Federal regulation treats departure without advance parole as abandonment of that application, and USCIS will terminate it.2eCFR. 8 CFR 245.2 – Application Years of waiting and thousands in fees can end at the airport gate.
There are narrow exceptions. Applicants holding valid H-1B, H-4, L-1, L-2, K-3, or K-4 status who meet certain conditions (such as returning to the same employer) can travel without advance parole and keep the I-485 alive.2eCFR. 8 CFR 245.2 – Application Outside those categories, advance parole is the only safe path.
Before you file anything, check whether you already have a combo card. Many I-485 applicants receive a card that functions as both an employment authorization document and an advance parole document; it carries the text “Serves as I-512 Advance Parole.” If yours is still valid on both your departure and return dates, you can travel on it without filing a new I-131.
What Counts as an Emergency
USCIS issues advance parole for urgent humanitarian reasons or significant public benefit.3U.S. Citizenship and Immigration Services. - Serious illness of a parent, spouse, or child, particularly at end-of-life stage, where your presence is needed.
- Death of a close family member and attendance at funeral or memorial services.
- A medical condition requiring treatment that cannot be obtained in the United States.
- Urgent professional obligations where failure to attend would cause severe financial loss or job loss.
That last category catches people off guard, but USCIS policy explicitly recognizes severe financial loss to a company or person, including inability to travel for work resulting in job loss, as a basis for expedited processing.4U.S. Citizenship and Immigration Services. Every request is discretionary. Officers look at how pressing the circumstances actually are, how badly you would be affected without parole, and whether the situation was genuinely unforeseeable.5U.S. Citizenship and Immigration Services. How to Request Emergency Advance Parole
There are two tracks. Which one you use depends on how quickly you need to leave.1U.S. Citizenship and Immigration Services. Emergency Travel
Travel Within 15 Days
Call the USCIS Contact Center at 800-375-5283 (TTY 800-767-1833) or request an appointment through the USCIS “My Appointment” online tool.1U.S. Citizenship and Immigration Services. Emergency Travel Describe the emergency and the evidence you have. If your situation qualifies, USCIS schedules an in-person appointment at a local field office where an officer can issue the travel document that day.
Walk-ins are not accepted. The appointment has to come through the Contact Center or My Appointment. Call volume runs high, so be persistent and use the online tool as a backup if you cannot get through by phone.
Travel More Than 15 Days Out
If your travel date is further away but standard processing still will not deliver a document in time, you can ask USCIS to expedite an already-pending Form I-131. Submit the expedite request through the Contact Center, the “Ask Emma” chatbot, or a secure message in your USCIS online account.6U.S. Citizenship and Immigration Services. If you have a USCIS online account, upload the supporting documents there in addition to calling. The Contact Center flags cases, but the adjudicating office moves faster on documents it can actually see in the file.
What to Bring to the Field Office Appointment
Arrive with everything. There is no meaningful chance to supplement a thin package before your travel date. USCIS requires:1U.S. Citizenship and Immigration Services. Emergency Travel
- A completed and signed Form I-131 with the applicable filing fee. Even if you already have a pending I-131, you file a new one at the appointment with a separate fee.
- Evidence of eligibility for the travel document (proof of the pending application or your immigration status).
- Evidence of the emergency, showing the pressing or critical need to travel.
- Two passport-style photos.
Anything not in English needs a certified English translation. The translator must certify in writing that the translation is complete and accurate and that they are competent to translate from the foreign language into English, with their name, signature, address, and date of certification attached to each document.1U.S. Citizenship and Immigration Services. Evidence That Actually Persuades an Officer
This is where emergency requests are won or lost. Officers are looking for a documented emergency, not a described one.
For a medical emergency, bring a letter from the treating physician that identifies the patient, describes the condition and its severity, explains why your presence is necessary, and specifies the time-sensitive nature of the situation.3U.S. Citizenship and Immigration Services. For a death or funeral, bring documentation of the death and proof of your familial relationship: a death certificate, obituary, or hospital records, together with a birth certificate, marriage certificate, or other evidence of the family connection.3U.S. Citizenship and Immigration Services. For a work emergency, document both the professional obligation and the consequences. That usually means an employer letter describing the event, its date, and why attendance is critical, plus concrete evidence of what happens if you do not go: contract loss, financial damage, or job loss. Affidavits from family or others familiar with the situation, letters from community leaders or religious officials, and any records that corroborate the timeline all help. The package should tell one complete story.
Filing Fees
The Form I-131 fee for an advance parole document is $630 for paper filing and $580 for online filing on the current fee schedule.7U.S. Citizenship and Immigration Services. G-1055 Fee Schedule Applicants with approved T-visa or U-visa petitions owe no filing fee.
A separate Immigration Parole Fee required by Pub. L. 119-21 appears on the current fee schedule at $1,020.7U.S. Citizenship and Immigration Services. G-1055 Fee Schedule It is triggered when parole is granted, not when the application is filed. Several exceptions cover most emergency advance parole situations:
- Lawful applicants for adjustment of status under INA section 245 returning after temporary travel abroad.8Federal Register. Immigration Parole Fee Required by HR-1 Reconciliation Bill
- Medical emergencies where treatment cannot be obtained abroad and time is too short for normal visa processing, imminent death of a close family member, funeral attendance, and organ donation situations.8Federal Register. Immigration Parole Fee Required by HR-1 Reconciliation Bill
If no exception fits your situation, budget for this fee on top of the I-131 cost. Fee waivers on Form I-912 are available for the base I-131 fee only for humanitarian parole applicants, not for advance parole tied to a pending I-485.9U.S. Citizenship and Immigration Services. Coming Back Into the Country
An advance parole document is not a guarantee of re-entry. At the port of entry, a Customs and Border Protection officer inspects you and decides whether to parole you into the country.10U.S. Customs and Border Protection. Advance Parole You can be sent to secondary inspection like any other arriving traveler.
Legally, parole is not admission. If your adjustment application is later denied, you are treated as an applicant for admission and evaluated under the inadmissibility grounds of INA section 212.2eCFR. 8 CFR 245.2 – Application For most people with strong adjustment cases, this risk is far smaller than the risk of abandoning the application.
Confirm your document is still valid on your return date. If it expires while you are abroad, replacing it from outside the country is significantly harder than renewing before departure.
What Happens If You Skip Advance Parole
Leaving without advance parole, when you needed it, has two levels of consequence.
The first is abandonment. A pending I-485 is deemed abandoned the moment you depart without advance parole, unless you fall within the H, L, or K exceptions.2eCFR. 8 CFR 245.2 – Application There is no warning and no grace period. You would refile from scratch, if you can get back in at all.
The second is the unlawful presence bars. If you accrued more than 180 days but less than one year of unlawful presence before departing, you face a three-year bar on re-entry. One year or more triggers a ten-year bar.11Office of the Law Revision Counsel. 8 USC 1182 – Inadmissible Aliens A waiver on Form I-601 exists but requires proving extreme hardship to a U.S. citizen or lawful permanent resident spouse or parent; hardship to yourself does not count, and applicants without a qualifying relative cannot use the waiver at all.12U.S. Citizenship and Immigration Services. Special Rules for DACA and TPS Holders
DACA
DACA recipients can request advance parole, but only for employment, humanitarian, or educational purposes, not for personal travel. Even with an approved document, international travel carries real risk: CBP retains discretion at the port of entry, and any unlawful presence accrued before DACA can trigger the three-year or ten-year bar on departure, potentially making return impossible. TPS
If you have approved Temporary Protected Status, you do not use advance parole. You apply for a TPS travel authorization on Form I-131, which operates under a different framework and lets you travel and be inspected and admitted back into TPS on return.13U.S. Citizenship and Immigration Services. If your TPS application is pending and not yet approved, you can request advance parole to travel while waiting for a decision.13U.S. Citizenship and Immigration Services.
