You can submit a USCIS case inquiry once your application has been pending longer than the agency’s estimated processing time for your form type, and USCIS expresses that threshold as a personalized USCIS Case Inquiry Date that you calculate on the agency’s website using your form, field office or service center, and receipt date. If the tool gives you a date in the past, you can file the inquiry today. If it gives you a future date, the system will not let you submit until that day arrives.
How the Case Inquiry Date Is Calculated
The Case Inquiry Date is not a fixed number of months. USCIS calculates it individually using the time it takes to complete 93% of adjudicated cases for your specific form type, minus the time your case has already been pending. If 93% of cases for your form finish within 13 months and yours has been pending 12 months, your Case Inquiry Date is one month from now. The tool on the USCIS website runs the calculation and returns the exact date.1U.S. Citizenship and Immigration Services. More Information About Case Processing Times
To use it, enter your form type, the field office or service center handling your case, and your receipt date. A past date means you can proceed; a future date means you wait.2U.S. Citizenship and Immigration Services. USCIS Simplifying, Improving Communication of Case Processing Data
One detail catches people out. USCIS treats your case as actively processing if within the past 60 days you received a notice, responded to a request for evidence, or saw an online status update. When that’s true, an inquiry may not change anything even if your Case Inquiry Date has passed.3U.S. Citizenship and Immigration Services. e-Request – Check Case Processing
If your form type isn’t listed in the processing time table at all, USCIS aims to decide within six months and asks that you wait six months before inquiring.3U.S. Citizenship and Immigration Services. e-Request – Check Case Processing
Finding the Right Receipt Date
The receipt date drives the whole calculation, and confusing it with the notice date on the same document is the most common mistake. Your Form I-797, Notice of Action, shows both. The Receipt Date is the day USCIS logged your application into its system. The Notice Date is when the receipt notice was printed, usually a few days later. Using the notice date in the tool produces the wrong Case Inquiry Date and can lead you to file too early or wait longer than you need to.4U.S. Citizenship and Immigration Services. Form I-797 Types and Functions
Your 13-character receipt number is on the same notice. It begins with three letters (EAC, WAC, LIN, SRC, NBC, MSC, or IOE) followed by 10 digits, and it’s the unique identifier USCIS uses to track your case.5U.S. Citizenship and Immigration Services. Receipt Number
What to Have Ready
The e-Request portal doesn’t let you save and return, so gather everything before you start:
- The 13-character receipt number from your Form I-797.5U.S. Citizenship and Immigration Services. Receipt Number
- The receipt date (not the notice date).
- The form number, such as I-130 for a family-based petition or I-485 for adjustment of status.
- The form category, since processing times differ within a form type (employment-based versus family-based, for example).2U.S. Citizenship and Immigration Services. USCIS Simplifying, Improving Communication of Case Processing Data
- Current mailing address and a monitored email address, matching what USCIS has on file.
How to Submit the e-Request
Open the USCIS e-Request page and choose the option for cases outside normal processing times.3U.S. Citizenship and Immigration Services. e-Request – Check Case Processing Enter your receipt number, receipt date, form type, and contact details. Review everything carefully before you submit. A typo in the receipt number routes your inquiry nowhere useful.
After you click submit, the system generates a confirmation screen with a unique inquiry tracking number. That’s different from your receipt number, so save it separately. The portal typically offers a downloadable PDF of your submission; keep it in case you need to reference the exact date and details later.
Cases That Follow Different Timing Rules
A few situations don’t use the standard Case Inquiry Date at all.
H-2A petitions. Form I-129 petitions for temporary agricultural workers that have been pending more than 15 days without a decision or a request for evidence qualify for a phone inquiry at 800-375-5283.3U.S. Citizenship and Immigration Services. e-Request – Check Case Processing

Premium processing. If you filed Form I-907, the standard case inquiry system doesn’t apply. Premium processing commits USCIS to an adjudicative action within a set number of business days (15 for most I-129 and I-140 classifications, 30 for I-765 and certain I-539 change-of-status requests, and 45 for I-140 multinational executive and manager and national interest waiver classifications), and USCIS refunds the fee if it misses the deadline. Missing card. If your case was already approved but the physical green card or EAD never arrived, that’s a separate “Non-Delivery of Card” inquiry, not a processing-time inquiry. Wait at least 90 days after your approval notice and check your online status for a USPS tracking number before submitting.7USCIS. Non-Delivery of Card For a Form I-765 approval where the EAD card itself hasn’t arrived, USCIS asks that you wait 30 days from approval before inquiring.6U.S. Citizenship and Immigration Services. What Happens After You Submit
USCIS doesn’t publish a guaranteed turnaround for e-Request responses. Replies usually come by email, though the agency may mail a letter to the address on file. The most common answer is a notice that your case is under active review and no action is needed from you. Not satisfying, but it does confirm the file hasn’t fallen through the cracks.
Sometimes the response is more substantive. The inquiry can prompt an officer to look at the file and issue a Request for Evidence because something is missing. It can also reveal that your case was transferred to a different field office or service center, which resets certain internal timelines. If you don’t hear back and want to follow up, you can call the USCIS Contact Center at 800-375-5283.8U.S. Citizenship and Immigration Services. USCIS Contact Center
Keep Your Address Current
A surprising number of inquiries go wrong here. You submit with your current address, USCIS answers, and the reply goes to a different address entirely. That’s because USCIS does not update your address of record based on information in a service request. If you moved after filing, USCIS still has your old address until you formally change it.9U.S. Citizenship and Immigration Services. If the Inquiry Doesn’t Resolve Things
The e-Request is the first step, not the last. Three further paths exist, and each has prerequisites.
Expedite Request
An expedite request asks USCIS to move your case ahead of others. The recognized grounds are severe financial loss to a person or company (where the urgency wasn’t caused by the applicant’s own failure to file on time), emergencies or humanitarian situations such as serious illness or natural disasters, requests from nonprofit organizations furthering U.S. cultural or social interests, government interests or public safety, and clear USCIS errors that need urgent correction. Simply needing work authorization doesn’t qualify on its own. USCIS decides these case by case and generally requires supporting documentation.12U.S. Citizenship and Immigration Services. Expedite Requests
CIS Ombudsman Case Assistance
The DHS CIS Ombudsman’s office helps people whose cases are stuck, but not as a first stop. You must have contacted USCIS within the last 90 days and given the agency at least 60 days to resolve the issue. For processing delays where no expedite has been approved, the Ombudsman also requires that your Case Inquiry Date has already passed. Requests use DHS Form 7001. The Ombudsman cannot give legal advice, overturn a denial, or force USCIS to act, but they can investigate why a case hasn’t moved.13U.S. Department of Homeland Security. Congressional Inquiry
Your member of Congress can inquire on your behalf. To authorize release of your case information, you’ll need to provide a privacy release with your name, address, date of birth, form number, and a handwritten signature made under penalty of perjury or notarized. Digital signatures are not accepted.14U.S. Citizenship and Immigration Services. Congressional Inquiries Refresher for Legislative Staff Pick one escalation path and let it run.
