USCIS advance parole is a travel document that lets certain people with pending immigration applications leave the United States and come back without having their case treated as abandoned. If you have a pending Form I-485 and step onto an international flight without it, U.S. Citizenship and Immigration Services will generally close your green card application.1U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS That is the reason to understand this document before you book anything.
Who Needs It
The typical applicant has a pending Form I-485 (adjustment of status) and needs to travel internationally before the green card interview or approval. Leaving without advance parole tells USCIS you have given up on adjusting status, and the agency closes the case.1U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS
USCIS also issues advance parole to Temporary Protected Status (TPS) holders, who need it to leave and return without breaking their continuous physical presence, and to Deferred Action for Childhood Arrivals (DACA) recipients, who can request it only for humanitarian, educational, or employment reasons.2U.S. Citizenship and Immigration Services. Consideration of Deferred Action for Childhood Arrivals (DACA) Asylum applicants with pending cases may also qualify.
Who Doesn’t Need It
A few pending-I-485 applicants can travel on their existing visa and keep their case alive. H-1B specialty workers and L-1 intracompany transferees, along with their H-4 and L-2 dependents, can leave and return on valid H or L visas if they are maintaining that nonimmigrant status. The same exemption applies to K-3/K-4 nonimmigrants with valid K visas and V nonimmigrants in valid V status.3U.S. Customs and Border Protection. Advance Parole If the underlying status lapses or the employer withdraws the petition, the exemption disappears.
Lawful permanent residents do not use advance parole. A green card holder planning to be abroad a year or more applies for a reentry permit, which uses the same Form I-131.4U.S. Citizenship and Immigration Services. Travel Documents
How to File Form I-131
Advance parole is requested on Form I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records.5U.S. Citizenship and Immigration Services. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records The form covers several different travel benefits, so the category you select in Part 1 matters. Include two identical passport-style color photographs and a copy of the receipt notice for your underlying application, typically the I-485 receipt. Mail the package to the USCIS lockbox address in the current I-131 instructions. The correct address depends on your underlying application and state of residence.
Filing Fees

Frequently Asked Questions on the USCIS Fee Rule Adjustment applicants who want both travel and work authorization now pay both fees on top of the I-485 filing fee.
If your household income is at or below 150% of the federal poverty guidelines, you may qualify for a fee waiver by filing Form I-912 with your application.9U.S. Citizenship and Immigration Services. Poverty Guidelines Receipt of a means-tested government benefit or documented financial hardship can also qualify you. Not every I-131 category is fee-waiver eligible, so check the I-912 instructions for your situation.
How Long It Takes
After USCIS accepts the application, you receive a Form I-797C receipt notice with a 13-character receipt number, which you can enter on the Case Status Online tool at egov.uscis.gov to track progress.10U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action11U.S. Citizenship and Immigration Services. Case Status Online USCIS may schedule a biometrics appointment; if so, a separate notice arrives by mail.
Processing times vary by service center and shift over time. Waits of several months are common, and some applicants wait over a year. Check the USCIS processing times page for the office handling your case, and file as early as you can if travel is likely.
Emergency and Expedited Processing
If travel comes up while an I-131 is pending, USCIS offers two faster tracks.
Expedite Requests
You can ask USCIS to expedite a pending Form I-131 for a pressing or critical need. The agency evaluates requests case by case and generally requires documentation. Qualifying reasons include an unexpected family death or serious illness, a medical procedure only available abroad, employment obligations, or an academic commitment that cannot be postponed.12U.S. Citizenship and Immigration Services. Expedite Requests Vacation does not qualify. Supporting evidence might be a death certificate, a doctor’s letter, an employer letter on company letterhead, or documentation from a school.
Emergency Advance Parole
When you need to travel within about 15 days and cannot wait even for an expedited decision, a USCIS field office can issue emergency advance parole in person on the same day. You must be lawfully present and show a pressing need. Call USCIS at 800-375-5283 or use your online account to request an InfoPass appointment. Bring a completed Form I-131, the filing fee, two passport photos, your unexpired passport, proof of lawful status such as your I-485 receipt notice, and documents showing why the travel is urgent.12U.S. Citizenship and Immigration Services. What You Actually Receive
Advance parole comes in one of two forms. One is a standalone paper document called Form I-512L. The other, more common for adjustment applicants, is a credit-card-sized combination card that serves as both an Employment Authorization Document and an advance parole document. The combo card carries the text “Serves as I-512 Advance Parole.”13U.S. Citizenship and Immigration Services. USCIS to Issue Employment Authorization and Advance Parole Card for Adjustment of Status Applicants – Questions and Answers Validity can extend up to five years, though the actual period depends on the case.
Do not confuse the approval notice with the travel document itself. The notice confirms the I-131 was approved and tells you the card or paper document will come separately by mail. You cannot travel on the notice alone.
Using It at the Border
Carry both the advance parole document (or combo card) and a valid passport. At the U.S. port of entry, present them to the Customs and Border Protection officer, whose job is to decide whether to parole you back into the country.
Being paroled in is not the same as being admitted. Your Form I-94 will show a parolee class of admission rather than a standard nonimmigrant or immigrant category.14Social Security Administration. RM 10211.195 Evidence of Parolee Status When an Alien Submits Form I-94 or Unexpired Foreign Passport For most adjustment applicants, the practical effect is minimal: parole gets you back in and the I-485 keeps processing. It does mean, though, that you have not been formally admitted in a visa category.
CBP officers may send you to secondary inspection, where they review your immigration history using government databases and may ask about your trip and your pending applications. This can be triggered by prior records, documentation questions, or random selection. Secondary inspection is routine and does not by itself mean something is wrong with your case.
The Unlawful Presence Shield
This part matters most for people who spent time out of status before filing to adjust. Under federal law, someone unlawfully present for more than 180 days but less than a year who then departs is inadmissible for three years. A year or more of unlawful presence followed by departure triggers a ten-year bar.15Office of the Law Revision Counsel. 8 U.S. Code 1182 – Inadmissible Aliens The bars are triggered by leaving the country.
The Board of Immigration Appeals held in Matter of Arrabally and Yerrabelly that leaving on approved advance parole is not a “departure” for purposes of these bars.16U.S. Department of Justice. Matter of Arrabally and Yerrabelly, 25 I&N Dec. 771 (BIA 2012) USCIS applies this to both the three-year and ten-year bars, and the same protection reaches TPS holders traveling with TPS travel authorization.17U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility
The protection is specific. It covers the unlawful presence bars. Other grounds of inadmissibility, including certain criminal convictions and prior removal orders, remain on the table when the CBP officer decides whether to parole you back in.
Risks Worth Planning Around
Advance parole is not a guaranteed reentry. The CBP officer at the port of entry has final authority and can deny parole if they find you inadmissible on grounds unrelated to unlawful presence.13U.S. Citizenship and Immigration Services. USCIS to Issue Employment Authorization and Advance Parole Card for Adjustment of Status Applicants – Questions and Answers If that happens abroad, options are limited.
A few problems come up repeatedly:
- Document expires while you are outside the country. A lapsed advance parole generally cannot be used to reenter, and the I-485 would likely be treated as abandoned. Book travel well within the validity period, with a buffer for cancellations or medical issues.
- USCIS notices land in your U.S. mailbox while you are away. Interview notices, requests for evidence, and other time-sensitive correspondence keep coming. Missing an interview because you were abroad is not excused, and a missed I-485 interview can end the case.
- Removal proceedings change everything. Advance parole is generally not available if you are in proceedings, and travel carries extreme risk. Get individualized legal advice before considering any trip.
- Immigration history follows you. Arrabally handles the unlawful presence bars, not the rest of your record. Prior deportation orders, fraud findings, or criminal issues can independently make you inadmissible on return.
DACA and TPS Specifics
Both groups use Form I-131, but the rules differ.
DACA
A DACA recipient can request advance parole only for humanitarian, educational, or employment reasons. You must already have DACA approval; you cannot apply while an initial DACA request is still pending. Travel on approved advance parole does not interrupt continuous residence, but leaving without it and reentering without inspection can lead USCIS to terminate DACA after a notice of intent to terminate.2U.S. Citizenship and Immigration Services. Consideration of Deferred Action for Childhood Arrivals (DACA) DACA travel policy has shifted with different administrations, so confirm what is currently available before filing.
TPS
A TPS beneficiary applies for TPS travel authorization on Form I-131. If approved, USCIS issues Form I-512T for TPS-authorized travel. If the initial TPS application (Form I-821) is still pending when the I-131 is approved, USCIS issues a Form I-512L advance parole document instead.5U.S. Citizenship and Immigration Services. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records Traveling while a TPS re-registration or initial application is pending carries the risk of missing a request for evidence or getting a denial while you are outside the country. The decision to admit you back into TPS on return is made by the inspecting officer at the port of entry.
Both DACA and TPS travelers benefit from the Arrabally unlawful presence protection when traveling with proper authorization.17U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility The larger point stands for everyone: advance parole protects the pending application from being abandoned. It does not clear every possible ground of inadmissibility.
