UK Pension in Canada: Frozen Rates, Tax, and Transfers

If you live in Canada and worked in the United Kingdom long enough to earn a UK pension, you can claim it from Canada, but the payment is frozen at the rate in effect when you first claimed it or when you moved abroad, whichever is later. The full new State Pension is currently £241.30 per week for someone with 35 qualifying years of National Insurance contributions, and that figure will never rise while you remain a Canadian resident. Canada is one of the countries the UK specifically excludes from the annual “triple lock” increases that pensioners in the UK and some other jurisdictions receive.

Why Your UK Pension Is Frozen in Canada

This is the biggest financial surprise for most UK pensioners in Canada. Pensioners living in the UK get annual increases under the triple lock, which raises the State Pension each year by the highest of inflation, average earnings growth, or 2.5%. Pensioners in some other countries, including the United States, receive those same annual increases. Canada is not on that list.

Neither of the two social security agreements between the UK and Canada (from 1995 and 1998) provides for pension uprating, and the UK government has stated it does not intend to revisit the arrangement.1UK Parliament. Someone who claimed £200 per week in 2020 is still receiving £200 per week today, while a pensioner in the UK who started at the same amount would now be getting considerably more.

If you return to the UK for a visit or a longer stay, your pension is temporarily increased to the current prevailing rate. It reverts to the frozen level once you return to Canada.2GOV.UK. Do You Qualify for the UK State Pension

The new State Pension applies to anyone reaching State Pension age on or after 6 April 2016. You need a minimum of ten qualifying years of National Insurance contributions to receive any payment, and 35 qualifying years to get the full amount.3GOV.UK. The New State Pension4GOV.UK. The New State Pension What You’ll Get Between those two thresholds the amount is proportional, so 20 qualifying years produces roughly 20/35ths of the full rate.

Every qualifying year sits under your National Insurance number, assigned when you first entered the UK workforce.5GOV.UK. Your National Insurance Number You can check your record online through the GOV.UK “Check your State Pension” service, or request a forecast by post using form BR19.6GOV.UK. One point worth clearing up: the UK-Canada social security agreement does not let you combine work periods from both countries to meet the UK’s ten-year minimum. It only coordinates coverage while you are working, preventing double contributions.7Canada.ca. What Is the Purpose of International Social Security Agreements If you have eight qualifying UK years and twenty Canadian years, only the eight UK years count toward UK eligibility. This is different from the arrangements the UK has with EEA countries and the United States.

Filling Gaps with Voluntary Contributions

Voluntary Class 3 National Insurance contributions can fill gaps and increase your pension. For the 2026-27 tax year, Class 3 costs £17.75 per week for each missing year you buy back, roughly £923 per year.8GOV.UK. Pay Voluntary Class 3 National Insurance

Some overseas residents used to qualify for the much cheaper Class 2 rate based on prior UK employment or self-employment. From 6 April 2026, voluntary Class 2 contributions are no longer available for anyone living or working outside the UK.9GOV.UK. The math is straightforward if you sit below ten years: buying enough years to reach ten unlocks the pension entirely and is almost always worth it. Once you are past ten, each extra year adds about 1/35th of the full weekly rate. Run the numbers before committing, particularly if you are a year or two short of hitting the full 35.

How the UK Pension Is Taxed in Canada

The Canada-UK Double Taxation Convention allows both countries to tax your pension income, but the UK must exempt the greater of the first $10,000 CAD or £5,000 per year from UK tax.10Government of Canada. Canada, on the other hand, taxes the full pension as income. You report it on your Canadian return, and if the UK does withhold anything, you claim a foreign tax credit in Canada to avoid double taxation.

Stopping UK Withholding at Source

To reduce or eliminate UK withholding, file form Canada/Individual with HMRC.11GOV.UK. Double Taxation UK/Canada Form Canada/Individual Send the completed form first to your local Canada Revenue Agency Tax Services Office, which certifies your Canadian tax residence. Then forward the certified form to HMRC.12HM Revenue and Customs. Canada Individual Notes Once processed, HMRC issues a tax code that stops or reduces future withholding, letting you receive the gross payment and settle the tax with the CRA. Skip this step and you will likely have UK tax withheld from every payment, leaving you to chase refunds.

Lump Sums Are Treated Differently

The partial UK exemption for periodic pension payments does not apply to lump sums. The amended treaty explicitly excludes “lump sum payments out of a pension plan” from its definition of pensions for the tax-sharing rule.10Government of Canada. If the lump sum relates to employment performed while you were not a Canadian resident, an RRSP contribution may offset it, but the rules are narrow. The OAS Clawback

Your UK pension counts toward your net world income for Canadian tax purposes, which feeds into the Old Age Security recovery tax. For the July 2026 to June 2027 payment period, the clawback starts when your 2025 net income exceeds $93,454. Every dollar above that threshold costs you 15 cents of OAS, and by around $152,000 the OAS is fully clawed back for pensioners aged 65 to 74.13Canada.ca. Old Age Security Pension Recovery Tax

A frozen State Pension is unlikely to push you over the threshold on its own, but combined with CPP, workplace pensions, and RRIF withdrawals it adds to the pile. One small silver lining of the frozen rate: it does not creep upward the way an indexed pension would, so it will not gradually drag you deeper into clawback territory over time.

Transferring a Private or Workplace UK Pension to Canada

Moving a private or occupational UK pension into a Canadian registered plan requires the Canadian scheme to be a Qualifying Recognised Overseas Pension Scheme (QROPS). Transferring to a plan that is not a QROPS can trigger an unauthorized payment charge of 40%, with a possible 15% surcharge on top, for a total of 55%.14GOV.UK. The Overseas Transfer Charge

Even a transfer to a legitimate QROPS can attract a 25% overseas transfer charge. You are exempt if you are tax resident in the same country where the QROPS is established, so a Canadian resident transferring to a Canadian QROPS should not pay it.16GOV.UK. Defined Benefit Transfers Require Regulated Advice

If you are transferring a defined benefit (final salary) pension with a cash equivalent transfer value above £30,000, UK law requires advice from a financial adviser regulated by the Financial Conduct Authority before the transfer can proceed.17Financial Conduct Authority. Pension Transfer Advice What to Expect It is not optional. The scheme trustees cannot process the transfer without evidence that you took the advice. You are giving up a guaranteed income for life in exchange for a lump sum, so the rule exists for good reason.

Defined contribution pensions are simpler and do not carry the same advice requirement below £30,000. Either way, you start the process by completing form APSS263, which gives your UK pension administrator the details of the receiving QROPS.18GOV.UK. Pension Schemes Member Information APSS263

Minimum Pension Age Is Rising

The earliest age at which you can access a UK private pension is currently 55. It rises to 57 on 6 April 2028 under the Finance Act 2022.19House of Commons Library. Minimum Pension Age Anyone who is 55 or 56 when the change takes effect could temporarily lose access until they turn 57, even mid-drawdown. Some members of specific public service schemes are exempt; most people are not.

Claiming Your State Pension from Canada

Overseas claims are handled by the International Pension Centre in the UK.20GOV.UK. International Pension Centre You will need your National Insurance number and the dates of your UK employment. If you are approaching State Pension age in Canada, the DWP should send you a letter inviting you to claim, but do not count on it arriving. You can start a claim up to four months before you reach State Pension age.

Payments arrive every four weeks in arrears, directly into your Canadian bank account, converted from sterling to Canadian dollars.

Life Certificates

Periodically the Department for Work and Pensions sends a life certificate, a form confirming you are still alive and eligible. Have it signed by a witness and return it promptly. If you do not, your payments can be suspended.21GOV.UK. Keep your address and banking details current with the International Pension Centre.

What Happens on Death

Under the new State Pension, a surviving spouse or civil partner may inherit an additional amount on top of their own State Pension, depending on when each partner reached State Pension age.22GOV.UK. Your Benefits Tax and Pension After the Death of a Partner The new State Pension itself is not fully inheritable the way the old basic State Pension sometimes was, but any protected payment (the portion above the standard full rate carried over from the old system) can pass to a surviving partner. Private and workplace pensions have their own rules that depend on the scheme. If you transferred a UK pension into a Canadian QROPS, Canadian inheritance and tax rules apply to those funds.
