UK Crypto Staking Tax: Income, CGT, and HMRC Deadlines

Crypto staking rewards are taxable in the UK: HMRC treats the sterling value of new tokens at the moment they hit your wallet as miscellaneous income, and any later gain when you sell those tokens falls under Capital Gains Tax. From 1 January 2026, UK crypto platforms must report user transaction data to HMRC under the Crypto-Asset Reporting Framework, so unreported staking income is far more likely to surface.1GOV.UK. Implementation of the Cryptoasset Reporting Framework (CARF)

Income Tax on Staking Rewards

For almost every individual staker, rewards count as miscellaneous income rather than trading income. HMRC’s Cryptoassets Manual says it would be “only in exceptional circumstances” that staking amounts to a trade, which would require a level of frequency, organisation, and commerciality closer to running a business.2HM Revenue & Customs. Cryptoassets Manual – CRYPTO20250 – Cryptoassets for Individuals: What Is Trading If you stake through a platform and collect rewards without significant hands-on operational involvement, you’re on the miscellaneous income side.3HM Revenue & Customs. Cryptoassets Manual – CRYPTO21200 – Cryptoassets for Individuals: Income Tax: Staking That matters, because trade income also brings National Insurance.

The rate you pay on staking rewards depends on your total annual income. After the £12,570 personal allowance, the basic rate is 20% up to £50,270, the higher rate is 40% up to £125,140, and the additional rate is 45% above that.4GOV.UK. Income Tax Rates and Personal Allowances

The £1,000 Miscellaneous Income Allowance

HMRC gives a trading and miscellaneous income allowance of up to £1,000 per tax year, and staking rewards count toward it. If your total miscellaneous income from all sources stays under £1,000, you owe no Income Tax on it and don’t need to report it.5GOV.UK. Check if You Need to Pay Tax When You Receive Cryptoassets

Above that threshold, how you report depends on the amount. Between £1,000 and £2,500 you can contact HMRC directly rather than filing a full Self Assessment return. Above £2,500 you must register for Self Assessment.5GOV.UK. Check if You Need to Pay Tax When You Receive Cryptoassets

Valuing Each Reward in Sterling

Every time rewards land, record the fair market value in pounds at that moment. Ten tokens worth £10 each at the point of receipt is £100 of reportable income. This applies to every reward event, whether daily, weekly, or irregular.

If the token has no direct GBP pair, HMRC expects you to use a reasonable conversion method and apply it consistently — for example, converting a USD price to GBP using an exchange rate from the same timestamp. Keep a written note of the methodology so you can explain it if asked.6HM Revenue & Customs. Cryptoassets Manual – CRYPTO23000 – Cryptoassets for Individuals: Valuation HMRC doesn’t publish official crypto rates, so pull values from a reputable exchange or pricing aggregator. The standard is “reasonable care”; cherry-picking favourable rates draws scrutiny.

Capital Gains Tax When You Sell or Swap Staked Tokens

A second tax event happens when you sell, trade, or spend tokens you earned through staking. The sterling value you already declared as income becomes your cost basis. Anything above that is a capital gain; anything below is a loss you can set against other gains.

For the 2026–27 tax year the annual exempt amount is £3,000. Above that, the rate is 18% if your taxable income keeps you in the basic rate band and 24% if you’re a higher or additional rate taxpayer.7GOV.UK. Capital Gains Tax Rates and Allowances

How Disposals Are Matched

You can’t pick which specific tokens you sold. Disposals are matched against acquisitions in a fixed order: first any tokens bought the same day, then any bought within the following 30 days (the “bed and breakfasting” rule, which stops instant sell-and-rebuy loss creation), and only then against your Section 104 pool. The pool is a running weighted average of the cost of all remaining tokens of that type.8HM Revenue & Customs. HS284 Shares and Capital Gains Tax (2024)

Practically, if you bought ETH at different prices over several months and also earned ETH through staking, all of it blends into a single pool with one per-token cost. Your gain on any sale is the sale proceeds minus that average cost applied to the tokens sold.

Transfers to a Spouse or Civil Partner

Transfers between spouses or civil partners don’t trigger CGT at the point of transfer. Your partner inherits your original cost basis, so their eventual gain runs from when you first acquired the tokens. The exemption falls away if you’ve separated and haven’t lived together at any point during the tax year of the transfer.9GOV.UK. Capital Gains Tax: What You Pay It On, Rates and Allowances – Gifts

Records HMRC Expects

For every reward event, record the date, the type of cryptoasset, the quantity received, the sterling value at receipt, and any platform fees. For each disposal, record the date, type and quantity of tokens sold, the sterling proceeds, and the cost basis used. Exchange histories, staking platform statements, and blockchain explorer data are all valid sources. Consolidating everything into one spreadsheet or a dedicated crypto tax tool saves work at filing time.

For returns filed on time, HMRC requires records be kept for at least 22 months after the end of the relevant tax year.10GOV.UK. Keeping Your Pay and Tax Records – How Long to Keep Your Records If your activity is classified as a trade, retention runs at least five years past the 31 January submission deadline.11GOV.UK. Filing, Deadlines, and Penalties

If your staking income exceeds the reporting thresholds, you file through Self Assessment using form SA100. Miscellaneous staking income goes on the SA101 supplementary pages under additional untaxed income. Capital gains from selling tokens go on SA108.12HM Revenue & Customs. SA100 Tax Return 2026 Returns are filed through HMRC’s online portal via your Government Gateway login. Payment can be made by bank transfer, debit card, or direct debit.

Online returns and any tax owed are both due by 31 January following the end of the tax year. For 2025–26 (ending 5 April 2026), the deadline is 31 January 2027.13GOV.UK. Self Assessment Tax Returns: Deadlines

Late-filing penalties climb quickly:

  • Immediately after the deadline: £100 fixed penalty, even if no tax is owed
  • After 3 months: £10 per day for up to 90 days, capped at £900
  • After 6 months: 5% of the tax due or £300, whichever is greater
  • After 12 months: another 5% of the tax due or £300, whichever is greater

Those are late-filing penalties only. Late payment attracts separate interest and surcharges on top.14GOV.UK. Self Assessment Tax Returns: Penalties

Deliberate evasion sits in a different category. Fraudulent evasion of income tax under the Taxes Management Act 1970 carries a maximum sentence of 14 years for offences committed from 22 February 2024 onward.15Sentencing Council. Revenue Fraud

HMRC’s New Visibility From January 2026

From 1 January 2026, the Crypto-Asset Reporting Framework requires UK-based crypto exchanges, wallet providers, portfolio management services, and NFT marketplaces to collect and report detailed user and transaction data to HMRC, including identity, tax residency, and transaction volume and value.1GOV.UK. Implementation of the Cryptoasset Reporting Framework (CARF)

CARF is international, so it works in both directions: platforms in other participating countries will share your data with HMRC. The government has projected an additional £40 million in revenue from the first year alone.1GOV.UK. Implementation of the Cryptoasset Reporting Framework (CARF) You’re also required to provide accurate identifying details (name, date of birth, tax identification number) to any crypto service provider you use. Inaccurate information can attract penalties of up to £300.

Disclosing Unreported Staking Income From Past Years

If you’ve been staking for years without reporting, coming forward voluntarily typically produces significantly lower penalties than being contacted first. HMRC operates a specific disclosure route for unpaid tax on cryptoassets, which runs through the Digital Disclosure Service. The five steps are: notify HMRC of your intention to disclose, provide full details of unreported income and gains within 90 days, make a formal offer to pay, submit payment, and cooperate with follow-up questions. Payment is expected before the 90-day deadline; if you can’t pay in full, you need to arrange a payment plan with HMRC before submitting.16GOV.UK. Your Guide to Making a Disclosure

If the failure to report was deliberate, use the Contractual Disclosure Facility instead. That’s the only disclosure route that provides assurance against criminal investigation, provided your disclosure is complete and accurate. Penalties on unpaid tax range from zero (reasonable care but wrong figures) up to 100% of the liability for domestic income, or 200% for offshore income.16GOV.UK. Your Guide to Making a Disclosure

DeFi, Liquid Staking, and Inheritance

The rules above cover standard Proof-of-Stake validation rewards. Liquid staking is different: when you deposit ETH into a liquid staking protocol and receive a derivative token like stETH, the exchange currently counts as a disposal for CGT, so you could owe tax at deposit even though nothing has been sold in economic terms. Following consultation, the government has been developing a “no gain, no loss” approach for certain crypto lending and liquidity pool transactions, but as of late 2025 this remains a proposal and has not been enacted. The government has drawn a clear distinction: the proposed change targets cryptoasset loans and liquidity pools, not standard Proof-of-Stake validation rewards. Income from any DeFi rewards remains taxable under existing rules regardless of how the capital gains treatment evolves.17GOV.UK. On death, cryptoassets form part of the estate and are valued at market price on the date of death.18GOV.UK. How to Value an Estate for Inheritance Tax and Report Its Value There are no specific statutory rules on where cryptoassets are located for Inheritance Tax; HMRC’s current view is that for exchange tokens, location follows the beneficial owner’s residence, so a UK-resident owner’s tokens are UK-situated and within scope of IHT.19HM Revenue & Customs.
