For petitions filed today, the U visa work permit processing time is running about five years from the date USCIS receives Form I-918. That first work permit almost always comes through the bona fide determination (BFD) process rather than through full adjudication of the visa itself, because the annual cap of 10,000 U visas has produced a backlog that stretches the full-adjudication route far beyond the BFD route.1U.S. Citizenship and Immigration Services. Two Routes That Produce a Work Permit
There are two separate mechanisms that can result in a U visa petitioner receiving an Employment Authorization Document (EAD), and which one reaches you first determines your wait.
Bona Fide Determination
The BFD process, launched in June 2021, lets USCIS grant work authorization and deferred action before fully adjudicating the underlying petition. USCIS reviews whether the Form I-918 is complete, includes a properly signed law enforcement certification submitted within six months of the certifier’s signature, contains a personal statement describing the victimization, and whether background and security checks are clean. If everything checks out, USCIS issues a four-year EAD and grants deferred action, meaning the government will not pursue removal during that period.2U.S. Citizenship and Immigration Services. The BFD is a lower bar than full U visa approval. USCIS does not need to find at this stage that every statutory requirement for the visa is met.
The U Visa Waitlist
Federal law caps U visas at 10,000 per fiscal year for principal petitioners. That cap has been hit every year for well over a decade.4U.S. Department of State Foreign Affairs Manual. 9 FAM 402.6 – Witnesses, Informants and Victims – S, T, and U Visas When USCIS fully reviews a petition and finds the petitioner eligible but no visa number is available, the petitioner is placed on the waitlist in filing-date order.5eCFR. 8 CFR 214.14 – Alien Victims of Certain Qualifying Criminal Activity Waitlisted petitioners also receive deferred action and a four-year EAD.6U.S. Citizenship and Immigration Services. How Long the BFD Route Currently Takes
The BFD review is currently taking approximately five years (roughly 60 months) from the date USCIS receives Form I-918.1U.S. Citizenship and Immigration Services. I-918, Petition for U Nonimmigrant Status USCIS works through BFD reviews in receipt-date order, starting with the oldest pending petitions. Posted processing times on the USCIS case processing times webpage show the range from receipt to either a BFD notice or notice of waitlist consideration, and that figure is the most current reference point for anyone tracking their own case.
USCIS has stated that BFD reviews were intended to happen within about six months of filing. The current five-year reality is a product of the backlog rather than the design. Some petitioners have shortened their wait through federal court litigation, though that path carries its own costs and is not available to everyone.
Why the Waitlist Route Is Much Longer
For petitioners who do not receive a BFD and must wait for full adjudication and waitlist placement, the timeline stretches dramatically further. With only 10,000 principal visas available each year and hundreds of thousands of pending petitions, the wait is measured in many years beyond the initial BFD stage. Newer filers should realistically expect that their first work permit will come through the BFD process, not the waitlist, because the BFD review happens first in the queue.
If the BFD Is Not Granted
A BFD denial is not a rejection of the U visa petition itself. If USCIS decides you do not meet the BFD criteria, the Form I-918 stays in the system and moves into line for a full waitlist adjudication. USCIS will issue a Request for Evidence giving you the opportunity to submit additional documentation needed for that review.3U.S. Citizenship and Immigration Services. National Engagement – U Visa and Bona Fide Determination Process Frequently Asked Questions
If you are ultimately found eligible for U nonimmigrant status during that full review but no visa number is available, you will be placed on the waitlist and receive an EAD and deferred action at that point. The practical consequence of missing the BFD is a longer wait before you can work legally, not the end of your case.
EAD Validity and Renewals
Whether you receive your work permit through a BFD or waitlist placement, the EAD is valid for four years from the date it is issued.3U.S. Citizenship and Immigration Services. National Engagement – U Visa and Bona Fide Determination Process Frequently Asked Questions Because full adjudication of the U visa petition will almost certainly still be pending when those four years are up, a renewal will be needed.
USCIS does not charge a fee for the initial EAD or for renewals of either BFD or waitlist EADs, and the exemption is automatic — no fee waiver request is required.1U.S. Citizenship and Immigration Services. I-918, Petition for U Nonimmigrant Status File the renewal well before the current EAD expires. A lapse can cause problems with your employer even if you remain eligible for deferred action.
Timing for Family Members
Qualifying family members (spouses, children, parents, and unmarried siblings under 18) can also receive work authorization through the BFD process, but their eligibility is evaluated independently. The principal petitioner must first receive a BFD, and the family member’s Form I-918, Supplement A must be properly filed with credible evidence of the qualifying relationship. Each family member must also pass their own background and security checks.2U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 3 Part C Chapter 5 – Bona Fide Determination Process
If a family member’s BFD is not granted because of deficiencies in their individual filing, their petition generally goes back in line with the principal petition to await a full adjudication. Family members placed on the waitlist alongside the principal petitioner receive deferred action and employment authorization at that point.6U.S. Citizenship and Immigration Services. Protecting the Time You Have Already Waited
A five-year wait is only useful if USCIS can reach you at the end of it. Your EAD card, approval notices, biometrics appointments, and Requests for Evidence all arrive by mail. If USCIS sends something to an outdated address and you miss a deadline, the consequences range from processing delays to a finding that you abandoned the application. Federal law requires noncitizens to report any address change within 10 days of moving.7U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card
U visa cases follow a special address-change procedure rather than the standard AR-11 online process. USCIS directs U visa petitioners to use the instructions on the Change of Address Procedures for VAWA/T/U Cases page.8U.S. Citizenship and Immigration Services. How to Change Your Address Using the wrong procedure can leave your file un-updated even after you submit a change.
Travel is the other way to lose time already served. Leaving the United States while your U visa petition is pending is risky. Without advance parole obtained on Form I-131, an unauthorized departure can effectively end the case and leave you unable to re-enter. If you have an urgent need to travel, consult an immigration attorney before making any plans. The consequences are often irreversible.
