Type 07 FFL: Requirements, Records, and Renewal

A Type 07 FFL has requirements in three layers: you personally must qualify to hold a federal firearms license, your business premises must be legal for manufacturing under local law, and once licensed you must mark every firearm, keep specific records, and pay the right taxes. The license itself costs $150 for a three-year term and authorizes you to manufacture firearms and ammunition for sale, plus everything a standard dealer can do.1Bureau of Alcohol, Tobacco, Firearms and Explosives. What the Type 07 Covers

The Type 07 is the ATF’s license for a “Manufacturer of Firearms Other Than Destructive Devices.” It covers pistols, revolvers, rifles, shotguns, and their frames and receivers, and it includes ammunition manufacturing, so no separate Type 06 is needed.1Bureau of Alcohol, Tobacco, Firearms and Explosives. One boundary matters up front. The Type 07 alone does not authorize you to make items regulated under the National Firearms Act, meaning short-barreled rifles, short-barreled shotguns, suppressors, or machine guns. For those you must also pay the Class 2 Special Occupational Tax, covered below.

Who Can Hold the License

Under 18 U.S.C. § 923(d), the ATF must approve your application if you meet every statutory criterion and must deny it if you fall short on any one.2Office of the Law Revision Counsel. 18 USC 923 – Licensing Every “responsible person” on the application, meaning anyone with power to direct the firearms side of the business, must individually qualify.3Bureau of Alcohol, Tobacco, Firearms and Explosives. You must be at least 21, a U.S. citizen or lawful permanent resident, and not prohibited from possessing firearms under 18 U.S.C. § 922(g). The prohibited categories include:

  • A felony conviction punishable by more than one year of imprisonment (not counting state misdemeanors punishable by two years or less)
  • Fugitive-from-justice status
  • Current use of or addiction to any controlled substance, including marijuana regardless of state legalization
  • Having been adjudicated mentally defective or involuntarily committed
  • A dishonorable discharge
  • Renunciation of U.S. citizenship, or unlawful presence in the country
  • Being subject to certain domestic restraining orders
  • A misdemeanor conviction for a crime of domestic violence

The domestic violence misdemeanor category disqualifies more applicants than people expect. It applies if the offense involved physical force or a deadly weapon and the victim was a spouse, former spouse, co-parent, or someone you lived with in a similar relationship. An expunged conviction or a pardon that expressly restores firearms rights can remove the bar; a generic restoration of civil rights usually does not.5U.S. Department of Justice. The ATF will also deny your application if you have willfully violated the Gun Control Act or made false statements on the form.2Office of the Law Revision Counsel. 18 USC 923 – Licensing

Where You Can Operate

You need a fixed physical location where you will manufacture and keep your records. A P.O. box or a rented storage unit will not do. The license covers only the address on it, so production and records must be at the same site, though you can use a separate warehouse for storage.6Bureau of Alcohol, Tobacco, Firearms and Explosives. The statute requires you to certify that your business is not prohibited by state or local law at that location and that you will comply with all applicable local requirements within 30 days of approval.2Office of the Law Revision Counsel. 18 USC 923 – Licensing Practically, that means checking your zoning before you apply. If your city bans manufacturing in a residential zone and your proposed premises is a house, the ATF will decline the application for that site.

Home-Based Shops

Federal law does not categorically bar home-based Type 07 operations. Many licensees run from a home workshop. The real barrier is local zoning. Some jurisdictions allow light manufacturing in residential zones through a conditional use permit or home occupation permit; others prohibit it outright. Resolve any conflict before you apply. The investigator will verify local compliance during the inspection.

What You File

Applications go on ATF Form 7 (5310.12), the same form used for all FFL types.7Bureau of Alcohol, Tobacco, Firearms and Explosives. Each responsible person must also submit two completed FD-258 fingerprint cards with clear ridge impressions and a 2-by-2-inch front-facing photo taken within the last six months.8Bureau of Alcohol, Tobacco, Firearms and Explosives. Application for Federal Firearms License The $150 fee covers the full three-year term and is non-refundable, with no proration if you stop operating early.

After You Submit

Mail the application and fee to the ATF’s Federal Firearms Licensing Center lockbox at P.O. Box 6200-20 in Portland, Oregon.9Bureau of Alcohol, Tobacco, Firearms and Explosives. After payment clears, the application is assigned to a local Industry Operations Investigator, who schedules an in-person visit, walks through federal recordkeeping requirements with you, and inspects the premises. Having your Acquisition and Disposition book ready, security measures in place, and zoning documentation on hand makes the visit straightforward.

Federal law gives the ATF 60 days from receipt of a properly completed application to approve or deny it.2Office of the Law Revision Counsel. 18 USC 923 – Licensing The clock starts when the application is complete, not when you mailed it. Missing fingerprint cards, unclear photos, and incorrect business information are the usual reasons for a reset.

Marking Every Firearm You Make

Federal regulations require permanent markings on the frame or receiver of every firearm before it leaves your control.11eCFR. 27 CFR 478.92 – Identification of Firearms and Armor Piercing Ammunition by Licensed Manufacturers and Licensed Importers You must mark:

  • A unique serial number that does not duplicate any other you have used
  • Your name (or recognized abbreviation) and the city and state of your business, or your name plus your abbreviated FFL number as a prefix to the serial number
  • The model designation, if one exists, and the caliber or gauge

Markings must be engraved, cast, or stamped to a minimum depth of .003 inches measured from the flat metal surface, and the serial number and license number must be at least 1/16 inch in print size.11eCFR. 27 CFR 478.92 – Identification of Firearms and Armor Piercing Ammunition by Licensed Manufacturers and Licensed Importers

Records You Must Keep

Manufacturers have two overlapping recordkeeping duties.

Manufacturing Log

Under 27 CFR § 478.123, you record the manufacturer name, type, model, caliber or gauge, serial number, and date of manufacture for every firearm you produce. For standard firearms, the entry is due within seven days of manufacture. For NFA firearms such as suppressors or short-barreled rifles, the entry must be made by the close of the next business day.12ATF eRegulations. 27 CFR 478.123 – Record of Receipt and Disposition

Acquisition and Disposition Book

The A&D book tracks every firearm that enters and leaves your inventory, whether made in-house or acquired elsewhere. Each entry includes the manufacturer or importer name, model, serial number, type, and caliber or gauge. Acquisitions record the date received and the source. Dispositions record the sale date, the buyer’s name, and either the buyer’s license number (for licensee-to-licensee sales) or the Form 4473 transaction number (for private buyers).13ATF eRegulations. 27 CFR 478.125 – Record of Receipt and Disposition Records must be in bound form and kept at your licensed premises.

Taxes You Owe

Federal Firearms and Ammunition Excise Tax

Every firearm and round of ammunition you sell is subject to the FAET, collected by the Alcohol and Tobacco Tax and Trade Bureau. The rates are 10% of the sale price on pistols and revolvers and 11% on other firearms, shells, and cartridges.14Alcohol and Tobacco Tax and Trade Bureau. A small manufacturer exemption applies: if you manufacture, produce, and import fewer than 50 pistols, revolvers, and firearms combined in a calendar year, those units are exempt from the tax regardless of when they sell.16eCFR. 27 CFR Part 53 – Manufacturers Excise Taxes, Firearms and Ammunition

Special Occupational Tax for NFA Manufacturing

To manufacture NFA items you must pay the Class 2 SOT: $1,000 per year, or $500 for businesses with total gross receipts under $500,000 for the most recent tax year.17Bureau of Alcohol, Tobacco, Firearms and Explosives. Instructions for Form 5630.7 – Special Tax Registration and Return Firearms The SOT tax period runs July 1 through June 30, with payment due by July 1 each year. Late payment triggers interest and penalties.

ITAR Registration

A 2020 rule change moved most commercial firearms, meaning non-automatic and semi-automatic firearms up to .50 caliber along with their parts and accessories, from the State Department’s U.S. Munitions List to the Commerce Department’s Commerce Control List.18Federal Register. International Traffic in Arms Regulations: US Munitions List Categories I, II, and III Commerce has no registration requirement, so if your entire product line falls under Commerce, no ITAR registration is needed. Renewal Every Three Years

The license expires after three years, and renewal costs $150.20Bureau of Alcohol, Tobacco, Firearms and Explosives. Federal Firearms Licenses About 90 days before expiration the ATF mails you ATF Form 8 Part II. If you have not received it 30 days out, contact the Federal Firearms Licensing Center rather than waiting.21Bureau of Alcohol, Tobacco, Firearms and Explosives. Current Licensees

Submit the renewal before the expiration date. A mailing postmarked on time lets you request a Letter of Authorization from the FFLC allowing you to keep operating for up to six months while renewal processes. Miss the deadline entirely and you are back to a new Form 7 application, with all business operations halted until a new license issues.21Bureau of Alcohol, Tobacco, Firearms and Explosives.
