Temporary Protected Status for Venezuelans has ended under both designations, but a federal court order keeps work authorization alive through October 2, 2026, for a specific group of holders. The 2023 redesignation terminated on October 3, 2025, after the U.S. Supreme Court lifted a lower-court order blocking the move. The 2021 designation ended on November 7, 2025, following a Federal Register notice published on September 8, 2025. What remains in place is narrow and document-specific. Everything below turns on which papers you hold and when they were issued.
Who Is Still Protected, and Until When
A May 30, 2025 order from the U.S. District Court for the Northern District of California kept certain TPS-related documents valid despite the terminations. If you received a TPS-based Employment Authorization Document, a Form I-797 Notice of Action, or a Form I-94 with an expiration date of October 2, 2026, and that document was issued on or before February 5, 2025, your work authorization runs through October 2, 2026.1U.S. Citizenship and Immigration Services. Two conditions, both required. Documents received after February 5, 2025, are not covered by this piece of the order, and neither are documents that carried a different expiration date on their face. Pull your paperwork and check both the issue date and the printed expiration.
An earlier phase of the same litigation reached documents with different expirations. EADs bearing expiration dates of April 2, 2025; September 10, 2025; March 10, 2024; or September 9, 2022 were automatically extended through April 2, 2026.2U.S. Citizenship and Immigration Services. If a Form I-765 renewal was filed before the underlying EAD expired, the automatic 540-day extension can bridge the gap. To use it, you present the expired EAD together with the Form I-797 receipt for the renewal; employers and I-9 verifiers need to see both.
What TPS Termination Means for Your Status
When a TPS designation is terminated, beneficiaries lose protected status 60 days after the termination notice is published in the Federal Register. After termination, a former beneficiary reverts to whatever immigration status they held before receiving TPS, if that status is still valid. Someone who held a valid, unexpired visa before TPS returns to it. Someone who entered without authorization, or whose prior status has since lapsed, no longer has lawful immigration status once TPS ends.4Federal Register. TPS on its own does not lead to a green card. It is a temporary benefit that provides protection from removal and work authorization while the designation is active. Permanent residence requires a separate qualifying basis, such as a family petition, employer sponsorship, or another eligible category.
Other Immigration Options to Look At
Former TPS holders should evaluate whether any other form of immigration relief applies to their situation. Asylum deserves particular attention because of a timing rule that often surprises people. Federal regulations treat holding TPS until a reasonable period before filing an asylum application as an “extraordinary circumstance” that excuses the normal one-year filing deadline, provided that deadline had not already run before TPS was granted. That exception disappears once TPS ends, so the window to file after termination is short.
The interaction between a terminated designation, the pending California court order, and each person’s individual history produces fact-specific outcomes that generic guidance cannot resolve. Travel Is High-Risk Right Now
Even while both designations were active, TPS holders needed advance authorization to leave the country. That was done by filing Form I-131 before departure, with USCIS issuing either a Form I-512T for approved TPS holders or a Form I-512L for those with pending applications. With both designations terminated, the risk is greater. Leaving the United States without valid immigration status or valid advance parole can trigger bars on re-entry. Get legal advice tied to your specific facts before you book anything.
Keep Your Address Current With USCIS
Federal law requires most noncitizens to notify USCIS within 10 days of moving to a new address if they will stay in the country for more than 30 days. The filing is Form AR-11, has no fee, and can be submitted online through a USCIS account. Missing this step can cost you notices you need to see, especially now, when case updates and any future court-driven communications will be routed to whatever address USCIS has on file. The obligation applies whether or not TPS is currently protecting you.
How to Check Where You Stand
Three things determine what you can do right now. First, the exact issue date on your EAD, I-797, or I-94, and whether that date falls on or before February 5, 2025. Second, the expiration date printed on those documents, and whether it matches October 2, 2026 or one of the earlier dates covered by the April 2, 2026 auto-extension. Third, whether you had any lawful status before you received TPS that is still valid today. Those three answers, taken together, tell you whether you currently have work authorization, whether you currently have status, and how much time you have to line up a next step.
