TPS Advance Parole: Eligibility, Filing, and Reentry Risks

If you have Temporary Protected Status and need to leave the country, apply for TPS advance parole first by filing Form I-131 with USCIS, wait for the travel authorization document to be issued, and only then depart. Leaving without it can cost you your TPS. Returning with it, through a port of entry, may also count as a lawful admission that opens the door to a green card.

Why You Cannot Just Leave

A grant of TPS does not include permission to travel. The regulation is direct: failure to obtain advance parole before departure may result in loss of status and deportation or exclusion proceedings.1eCFR. 8 CFR 244.15 – Travel Abroad There is no grace period and no after-the-fact fix. This is the single most common way TPS holders lose their protection.

USCIS also has full discretion to approve or deny the request, and there is no appeal from a denial.1eCFR. 8 CFR 244.15 – Travel Abroad So the sequence matters: apply, wait for the document, then travel.

Who Qualifies

You can apply if you already have approved TPS or if your initial Form I-821 is pending and USCIS considers it valid on its face. Your country’s TPS designation must still be active, and you must be in compliance with the program’s rules. Criminal convictions or national security concerns that would disqualify you from TPS also disqualify you from a travel document.2U.S. Citizenship and Immigration Services. Which Document USCIS Issues

What you receive depends on where your TPS application stands.

If your Form I-821 has already been approved, USCIS issues Form I-512T, a TPS Travel Authorization document created specifically for TPS beneficiaries. If your initial Form I-821 is still pending, USCIS issues the older Form I-512L Advance Parole document.3U.S. Citizenship and Immigration Services. The difference is not cosmetic. The I-512T was introduced in 2022 to replace the I-512L for approved TPS holders, and returning on it counts as being “admitted.” The I-512L grants parole rather than admission.4U.S. Citizenship and Immigration Services. How to File Form I-131

Form I-131 is the application. On the form, select Part 1, Item Number 4, which corresponds to a TPS travel authorization request.2U.S. Citizenship and Immigration Services. What to Include

  • Proof of TPS status: a copy of your Form I-821 approval notice, or your I-797C receipt notice if the initial application is still pending.
  • Two identical color passport-style photos taken recently.
  • Your intended travel dates and the reason for the trip.
  • Your Alien Registration Number (A-Number), found on prior immigration notices.

Fees and Fee Waivers

Form I-131 carries a filing fee. USCIS adjusts its fee schedule periodically, so check the agency’s fee information before you file.6U.S. Citizenship and Immigration Services. Filing Fees

For mailed applications, USCIS no longer accepts personal checks, money orders, or cashier’s checks from most applicants. Pay by credit, debit, or prepaid card using Form G-1450, or authorize a direct bank debit using Form G-1650. If you cannot afford the fee, TPS-related I-131 filings are eligible for a fee waiver. Submit Form I-912 with your application. You qualify if you receive a means-tested government benefit, your household income is at or below 150 percent of the Federal Poverty Guidelines, or you can show financial hardship. Processing Time and Expedite Requests

USCIS sends a receipt notice (Form I-797C) with a case number you can use to track the application.9U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Processing can take several months. Check current estimates on the USCIS website before committing to travel dates.

If you have a pressing need to leave, you can request expedited processing. USCIS considers expedite requests for travel documents in situations that include medical emergencies, the death or serious illness of a family member or close friend, professional or academic commitments where normal processing would cause you to miss the event (if you filed the I-131 in a timely manner), significant personal milestones such as weddings or graduations, and severe financial loss to a company or individual. Coming Back Through CBP

You return through a port of entry and go through inspection by Customs and Border Protection. Bring your travel authorization document (I-512T or I-512L) and your passport. CBP has the final say on whether to admit you; possessing the document does not guarantee entry. The officer checks that your travel authorization has not expired, your TPS is still valid, and you are not inadmissible on criminal or security grounds.2U.S. Citizenship and Immigration Services. If everything checks out, CBP admits you into TPS and provides either a stamp on your travel document or an electronic I-94 arrival record. Return before your travel document’s expiration date. Overstaying it puts your TPS status at risk.

What the Trip Does to Your Green Card Path

This is where TPS travel carries its heaviest long-term weight. To apply for a green card through adjustment of status, federal law requires that you were “inspected and admitted or paroled” into the United States.11Office of the Law Revision Counsel. 8 USC 1255 – Adjustment of Status of Nonimmigrant to That of Person Admitted for Permanent Residence Many TPS holders originally entered without inspection, which historically blocked adjustment even when a family petition or employer sponsorship later became available.

In 2022, USCIS rescinded an earlier adopted decision (Matter of Z-R-Z-C-) and changed its position. Under current policy, TPS beneficiaries who travel abroad with authorization and return through a port of entry are considered inspected and admitted into TPS. For a TPS holder with an approved immigrant petition, a single authorized trip and lawful return can supply the one piece that was missing. One caveat: if you are admitted into TPS after previously being granted parole, the admission replaces the parole status, and you become ineligible for re-parole.3U.S. Citizenship and Immigration Services. Risks That Catch People Off Guard

An Outstanding Removal Order

Traveling on a TPS travel document does not cancel or execute a final order of removal. You return still subject to that order and to any ongoing proceedings. The document gets you back in; it does not clean your immigration record.13U.S. Citizenship and Immigration Services. Missing Notices While You’re Away

USCIS keeps mailing while you are outside the country. If you have a pending TPS re-registration or initial application and you miss a request for evidence or another deadline, USCIS can treat the application as abandoned and deny it, and your TPS can be withdrawn as a result. A Change to Your Country’s Designation

Your travel document is only valid while your underlying TPS remains active. If the government terminates or declines to extend your country’s TPS designation while you are abroad, you can end up outside the United States with no valid basis to return.
