TN Visa Transfer Process: Port of Entry, I-129, and Consular

To transfer your TN visa to a new employer, you have three options: a Canadian citizen can apply at a U.S. port of entry with the new employer’s documents, either nationality can have the new employer file Form I-129 with USCIS, and a Mexican citizen outside the country can apply for a new TN visa at a U.S. consulate. The rule that trips people up most often: TN status has no portability provision, so unless you are admitted at the border with a new I-94 in hand, you cannot start working for the new employer until the change is formally approved.1eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level

Before You Choose a Route, Confirm You Qualify

You need to be in valid TN status at the time you request the change. If you have already left your old job, you can still qualify during the 60-day grace period that federal regulations provide after employment ends. That grace period preserves your status, but it does not authorize work. You cannot start with the new employer during those 60 days unless a new petition is approved first.2eCFR. 8 CFR 214.1 – Requirements for Admission, Extension, and Maintenance of Status

The new position has to fall within the professions listed in the USMCA appendix, and your credentials must match what the appendix requires for that specific occupation. Engineers, accountants, scientists, and management consultants are among the common qualifying categories, with dozens more on the full list.3eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level

The job also has to involve prearranged professional services for a U.S. employer. Self-employment is disqualified. If you would be providing services to a company you own or control as the sole or majority shareholder, USCIS treats that as self-employment no matter how the arrangement is structured.4U.S. Citizenship and Immigration Services. The Three Ways To Change Employers

Port of Entry (Canadian Citizens Only)

Canadian citizens can present the new employer’s documentation directly to a U.S. Customs and Border Protection officer at a designated port of entry or preclearance facility. The officer reviews the documents, conducts a brief interview, and, if everything checks out, issues a new I-94 reflecting the new employer. You can begin working immediately once admitted.5U.S. Citizenship and Immigration Services. TN USMCA Professionals

The route requires physically leaving and re-entering the United States, and CBP charges inspection fees on admission, so bring payment. In exchange, you get a same-day decision instead of a wait that can stretch to months.6U.S. Customs and Border Protection. For Canadian and Mexican Citizens

Form I-129 Through USCIS (Both Nationalities)

Both Canadian and Mexican nationals can have the new employer file Form I-129, Petition for a Nonimmigrant Worker, with USCIS. You stay in the United States while it is processed. The employer submits the petition with the required filing fee, by mail or online, to the appropriate service center. USCIS fees change periodically, so check the current schedule before filing.7U.S. Citizenship and Immigration Services. I-129, Petition for a Nonimmigrant Worker

USCIS issues a Form I-797C receipt notice with a case number for online tracking. Standard processing can take several months. If timing is critical, the employer can request premium processing by filing Form I-907 with an additional fee of $2,965 (effective March 1, 2026), which guarantees USCIS action within 15 business days.8U.S. Citizenship and Immigration Services. Consular Processing (Mexican Citizens)

Mexican citizens who are outside the United States, or who prefer not to file through USCIS, apply for a new TN visa at a U.S. embassy or consulate in Mexico. The consular officer reviews the new employer’s support letter and supporting documents and, if approved, issues a new TN visa stamp. You then use that visa to enter the United States with authorization to work for the new employer.5U.S. Citizenship and Immigration Services. TN USMCA Professionals

Mexican citizens cannot use the Canadian port-of-entry shortcut. If a Mexican TN holder wants to change employers from outside the country, the consulate is the required path.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 5 – Other Factors to Consider

When You Can Actually Start The New Job

This is where TN differs sharply from H-1B, and where people get into real trouble. The answer depends on the route.

If you were admitted at a port of entry with a new I-94, you can start the new job immediately. The I-94 is your proof of authorization, effective the date of admission.

If the employer filed Form I-129 through USCIS, you must wait for the formal approval notice (Form I-797) before starting work. A receipt notice alone does not authorize employment with the new employer. Starting work while the petition is only pending is unauthorized employment, which can trigger visa denials later and expose the employer to penalties. The regulation is explicit that employment with the new employer “is not authorized prior to Department approval of the request.”1eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level

Anyone moving from H-1B, where portability lets you begin work as soon as the petition is filed, needs to reset that expectation before signing an offer letter with an aggressive start date.

Documents To Assemble

The core package looks the same across all three routes: a valid Canadian or Mexican passport, your most recent Form I-94, and educational or professional credentials (diplomas, transcripts, licenses) that match the requirements for the target profession in the USMCA appendix.

The single most important document is the new employer’s support letter. It must describe the specific professional duties, the job title, the length of employment (up to three years per request), and your compensation. Officers use this letter to decide whether the position genuinely qualifies as professional-level work, and vague or generic descriptions are a common reason for denial.5U.S. Citizenship and Immigration Services. For a USCIS filing, the employer also completes Form I-129 with the Trade Agreement Supplement. The supplement asks the employer to select the professional category from the USMCA list, provide its Federal Employer Identification Number, describe the nature of its business, and detail your qualifications.7U.S. Citizenship and Immigration Services. If You Have Dependents Or A Second Job

TN status is employer-specific. Keeping the old job while adding a new one requires separate authorization for each employer. Freelancing or taking a second position without approval is a status violation.

Canadian citizens can add a concurrent employer at a port of entry with documentation from both employers, or the additional employer can file a separate Form I-129 requesting concurrent employment. Mexican citizens can have the additional employer file Form I-129, or apply for a new visa at a consulate with letters from both employers. CBP or USCIS should record both employers so the authorization is clear.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 5 – Other Factors to Consider

If your spouse or children are in the United States on TD status, their records need to be updated with yours. When you file Form I-129, dependents can file Form I-539 to extend or adjust their TD status, providing evidence of your continued employment with the new employer. If you change employers by re-entering at a port of entry, dependents traveling with you can request updated TD status at the same time.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 5 – Other Factors to Consider Leaving their I-94 records tied to the old employer’s expired authorization can cause problems with travel, driver’s license renewals, and other situations where they need to prove valid status.

After Approval: I-9 And Social Security

Once you have the new I-94 or I-797 approval and report to the new job, the employer must complete Form I-9 within three business days of your first day of work. The employer will examine your new I-94 or approval notice as part of that verification.10U.S. Citizenship and Immigration Services. Completing Section 2, Employer Review and Attestation

Visit a local Social Security office to update your record with the new authorization. Bring original documents proving your identity and work-authorized immigration status, such as your unexpired foreign passport with a current admission stamp or your new I-94. Photocopies and notarized copies are not accepted.11Social Security Administration. Foreign Workers and Social Security Numbers

You can start the application online at ssa.gov, but an in-person appointment is still required to present the originals. If the Social Security Administration needs to verify documents with the Department of Homeland Security, the update can take several weeks. Build that into your timeline if your new employer’s payroll system needs a confirmed Social Security number before your first paycheck.
