TN Visa Employer Requirements: Sponsorship, Letter, and Filing

To hire a Canadian or Mexican professional under TN status, a U.S. employer’s requirements are straightforward but strict: offer a real, prearranged professional position that fits one of roughly 60 occupations listed in the USMCA, provide a detailed support letter tying the worker’s credentials to that occupation, use the correct filing route for the worker’s nationality, and handle standard onboarding and tax obligations once the person starts. There is no annual cap, no lottery, and no Labor Condition Application, but the occupation match and the support letter carry almost the entire application.

Who Can Sponsor a TN Worker

The sponsoring entity does not need to be large. Federal regulations recognize sole proprietorships, partnerships, corporations, and even individuals as U.S. employers, so long as the entity operates lawfully and has a genuine need for the professional’s services.1eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level A position invented to support a visa filing will not survive scrutiny; adjudicators look for evidence that the role serves an actual operational function.

A foreign employer can also be the employer of record. A Canadian or Mexican company may send one of its professionals to serve a U.S. client under contract, with the U.S. entity as the beneficiary rather than the direct employer.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas The documentation still has to show a concrete U.S. assignment.

Third-Party Worksite Placements

Staffing agencies and consulting firms can sponsor TN workers placed at client sites. The State Department’s Foreign Affairs Manual states that working for a third-party agency is not a basis for refusal.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas What the officer needs to see is a specific, identified position at an identified end client. Speculative hiring, where an agency brings a worker in and shops them around later, will not qualify. The support letter should name the end client and describe the duties at that worksite.

Self-Employment Is Not Allowed

A TN professional cannot be self-employed. USCIS treats a person as self-employed if they are rendering services to a corporation or entity they own, control, or hold as the sole or controlling shareholder.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 2 – Eligibility Requirements Setting up a separate corporation and having it hire you will not solve the problem if you substantially control that entity. This is a common failure point for entrepreneurial applicants.

Matching the Job to a USMCA Profession

The position must fit a profession listed in Appendix 2 of Annex 16-A of the USMCA.4Office of the United States Trade Representative. USMCA Chapter 16 Temporary Entry for Business Persons The list runs to about 60 occupations in four broad groups: general professions such as engineers, accountants, architects, economists, management consultants, and graphic designers; medical and allied professionals including registered nurses, pharmacists, dentists, and psychologists; scientists across disciplines like biology, chemistry, and geology; and teachers at the college, university, or seminary level.

The employer’s job is to make sure the title and the actual duties genuinely align with a listed profession. A role called “Business Analyst” whose day-to-day work looks like software development can be denied at the border. A mismatch between the listed profession and the real duties is the fastest way to lose the case.

Degrees, Credentials, and Licensing

Most TN professions require at least a bachelor’s degree at the entry level, and work experience generally cannot substitute.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas A handful of professions accept alternative credentials; Medical Laboratory Technologists, for example, may qualify through a post-secondary diploma combined with relevant certification. The degree also has to correspond to the specific occupational category. Verify credentials before extending the offer.

U.S. licensure is not a prerequisite for TN admission. The Foreign Affairs Manual treats professional licensing as a post-entry requirement: a state license may be needed to actually perform the work, but not to enter in TN status.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas In regulated fields such as engineering, accounting, or nursing, confirm that the professional can obtain the required state license soon after arrival.

Management Consultants Draw Extra Scrutiny

The Management Consultant category attracts more skepticism than most. Officers look for genuine consulting work, meaning advisory services provided by an independent contractor or by an employee of a consulting firm, rather than a permanent operational role rebranded as consulting. If the professional will be functioning as regular staff at a U.S. company, the application is likely to be denied. Support letters in this category should be built around specific deliverables, project timelines, and the advisory nature of the engagement.

What the Employer Support Letter Must Include

The support letter is the single most important document in the application. A vague letter will sink an otherwise qualified candidate. The letter comes from the employer and needs to cover:

  • The job title, stated exactly as it appears on the USMCA profession list.
  • A detailed description of the duties the worker will perform, specific enough to demonstrate that the role matches the listed occupation.
  • The purpose of the employment and the business objective the role serves.
  • The anticipated length of stay, up to a maximum of three years per admission.5U.S. Citizenship and Immigration Services. TN USMCA Professionals
  • The salary or compensation arrangement, including whether the position is salaried, hourly, or project-based.
  • An explanation of how the applicant’s education qualifies them for the role, referencing the specific degree or credential.
  • Employer contact information, including address, phone number, and Federal Employer Identification Number.

Copies of diplomas, transcripts, professional licenses, and the employment contract should travel with the letter. The more precisely the letter maps the candidate’s credentials to the profession’s requirements, the smoother the adjudication.

How the Application Gets Filed

The filing route depends on the worker’s nationality.

Canadian Citizens

Canadians do not need a visa stamp. They present their documentation to a CBP officer at a designated U.S. port of entry or pre-clearance station for on-the-spot adjudication.6U.S. Customs and Border Protection. How to Obtain TN Status as a Canadian Citizen A Canadian professional with a solid support letter and passport can, in principle, be approved the same day and start work that week. The tradeoff is that a denial happens face-to-face with no appeal, so everything has to be right before arrival.

Mexican Citizens

Mexican citizens must obtain a TN visa at a U.S. embassy or consulate before entering.5U.S. Citizenship and Immigration Services. Filing Form I-129 With USCIS

For either nationality, the employer can file Form I-129, Petition for a Nonimmigrant Worker, with USCIS. This route is common for extensions, changes of employer, and cases where the worker is already in the United States.8U.S. Citizenship and Immigration Services. Employers who need a faster decision can add Form I-907, Request for Premium Processing Service, which guarantees USCIS action within 15 business days.10U.S. Citizenship and Immigration Services. How Do I Request Premium Processing As of March 1, 2026, the premium processing fee for TN petitions is $2,965. Standard processing without it can stretch to several months.

What TN Does Not Require

For employers used to H-1B, some familiar steps are absent. TN has no Department of Labor prevailing wage attestation and no Labor Condition Application. There is also no annual cap and no lottery, so employers can hire TN professionals at any point in the year without competing for slots.

Temporary Intent

TN is explicitly temporary. The USMCA defines temporary entry as entry “without the intent to establish permanent residence,” and officers apply this seriously.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas The stay must have a reasonable, finite end point.

This does not bar TN holders from ever pursuing a green card, but the timing matters. A future intent to immigrate that is unconnected to the current trip does not automatically disqualify the applicant, and even a long series of renewals can still count as temporary if there is no immediate intent to immigrate.2U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas An applicant who cannot demonstrate the temporary nature of the stay risks refusal. If the plan is eventual permanent sponsorship, be aware of the constraint.

After the Worker Starts

Form I-9

Complete Form I-9 as with any new hire. A TN worker’s unexpired I-94 arrival record together with an unexpired foreign passport qualifies as a List A document, establishing both identity and employment authorization in one step.11U.S. Citizenship and Immigration Services. NAFTA (TN) Visas The worker may instead present one List B document and one List C document, using the I-94 as the List C item. Payroll Taxes

TN workers are generally subject to the same federal payroll taxes as any other employee, with Social Security withholding at 6.2% up to the 2026 taxable earnings cap of $184,500 and Medicare at 1.45% on all wages, plus the additional 0.9% Medicare surtax above the applicable threshold.13Social Security Administration. Contribution and Benefit Base Unlike F-1 or J-1 workers, TN professionals do not receive an automatic FICA exemption based on immigration status. Some workers may qualify for an exemption under a bilateral totalization agreement, which requires a certificate of coverage from the home country’s social security authority.

Extensions and Changing Employers

TN status is granted in increments of up to three years and can be renewed without any set limit on the number of renewals, provided the worker continues to meet eligibility requirements and maintains temporary intent.14U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 4 – Extension of Stay and Change of Status Extensions are obtained either by filing a new Form I-129 with USCIS or by having the worker leave and reenter with fresh documentation. Each extension needs a new support letter confirming the continuing need for the professional’s services.

A worker changing employers cannot simply start the new job. The new employer must file Form I-129, or the professional must leave the country and reapply at a port of entry or consulate with the new employer’s documentation. When Employment Ends

If the job ends before TN status expires, the worker does not immediately fall out of status. Federal regulations allow a discretionary grace period of up to 60 consecutive days after the end of employment, or until the authorized validity period expires, whichever comes first.16eCFR. 8 CFR 214.1 – Requirements for Admission, Extension, and Maintenance of Status The grace period can be used only once per authorized validity period, no work is permitted during it, and USCIS can shorten or eliminate it.

Within those 60 days, the worker can depart, apply for a change of status, or have a new employer file a petition. Communicate the timeline clearly to departing TN workers, because staying past the grace period creates serious immigration consequences.

TD Status for Dependents

The worker’s spouse and unmarried children under 21 may accompany or follow to join in TD nonimmigrant status. TD dependents receive status for the same period as the principal and may study in the United States, but they cannot work.5U.S. Citizenship and Immigration Services.
