The Automatic Stay in Bankruptcy: Scope, Exceptions, and Lifting

The automatic stay in bankruptcy is a court order that takes effect the instant you file a petition and forces nearly every creditor to stop collecting from you.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Lawsuits pause, foreclosures stop, repossessions stop, wage garnishments stop, and the phone calls and letters stop. The protection is powerful, but it is not absolute. Some obligations are carved out entirely, creditors can ask the judge to lift the stay, and people who have filed before may get very little protection at all.

What Stops the Moment You File

Once your petition is on file, creditors cannot start or continue a lawsuit against you, enforce a judgment they already have, seize bank accounts, garnish wages, or send accounts out to collections.2Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Pending cases freeze where they are.

For most filers, the tangible relief is in the big-ticket collections. Mortgage lenders have to halt foreclosure. Auto lenders cannot repossess a car after the petition date. Wage garnishments stop immediately. Outside bankruptcy, federal law lets creditors take up to 25% of your disposable earnings for ordinary debts; the stay cuts that off and returns your full paycheck.3U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act

Utility service gets a narrower but useful protection. Your electricity, water, gas, or phone cannot be shut off just because you filed or because you owe a pre-filing balance. That protection runs for 20 days, during which you must give the utility a deposit or other security for future service. Miss that, and the utility can disconnect you after the 20 days.4Office of the Law Revision Counsel. 11 USC 366 – Utility Service Either side can ask the court to adjust the deposit if the amount seems unreasonable.

Routine harassment stops as well. Phone calls, demand letters, emails, and texts about debts are all prohibited while the stay is in place. The underlying idea is that the court, not the fastest creditor to the courthouse, decides who gets paid out of your assets.

What Keeps Going Anyway

The Bankruptcy Code carves out a long list of actions that continue despite your filing. If you expect the stay to shield you from any of these, you will be caught off guard.

Criminal Cases and Government Police Powers

Criminal prosecutions are not touched by bankruptcy. A pending criminal case, a traffic matter, or any other criminal proceeding moves on its normal schedule, and criminal fines and restitution orders stay enforceable.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Government agencies also keep their regulatory and police powers, so enforcement actions aimed at public health and safety continue.

Family Court and Support Collection

Most family law matters go forward. A court can establish paternity, set or modify child support and alimony, decide custody and visitation, grant a divorce, and issue domestic violence protection, all without pausing for the bankruptcy. The one limit is that the divorce court cannot divide property that belongs to the bankruptcy estate; that piece runs through the bankruptcy judge.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Collection of support is also exempt. Income withholding for domestic support continues, tax refunds can be intercepted for overdue support, unpaid support can still be reported to credit bureaus, and a state can suspend a driver’s license or professional license for unpaid support while your bankruptcy is active.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay The law treats support for children and former spouses as a higher priority than the debtor’s fresh start.

Tax Actions

Tax authorities keep most of their tools. The IRS or a state agency can still audit prior returns, send a notice of deficiency, demand that you file missing returns, and issue a formal tax assessment. What the stay generally blocks is the actual seizure of your property to collect the tax while the case is pending.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Evictions Where the Landlord Already Won

If your landlord obtained an eviction judgment before you filed, the stay does not automatically stop that eviction. Filing bankruptcy will not save your apartment on its own at that point. You can buy a short pause by filing a sworn certification with your petition stating that local law lets you cure the default even after judgment and that you have deposited enough with the clerk to cover the first 30 days of rent, then by paying off the full default and filing a second certification within that window.5Office of the Law Revision Counsel. 11 US Code 362 – Automatic Stay Miss either step and the landlord proceeds.

Protection for Co-Signers in Chapter 13

Chapter 13 adds a protection that Chapter 7 does not: a co-debtor stay that shields people who co-signed or guaranteed your consumer debts. If a parent co-signed your car loan or a friend guaranteed a credit card, the creditor cannot pursue them while your Chapter 13 case is active.6Office of the Law Revision Counsel. 11 US Code 1301 – Stay of Action Against Codebtor This covers only consumer debts, meaning debts taken on for personal, family, or household purposes. Business debts are not covered.

A creditor can ask the court to lift the co-debtor stay if the co-signer actually received the benefit of the loan, if your plan does not propose to pay that debt, or if leaving the stay in place would cause the creditor irreparable harm. When the motion is based on your plan not covering the debt, the stay lifts automatically after 20 days unless you or the co-debtor files a written objection. The co-debtor stay also ends if your case is dismissed, closed, or converted to Chapter 7 or Chapter 11.6Office of the Law Revision Counsel. 11 US Code 1301 – Stay of Action Against Codebtor

When a Creditor Can Get the Stay Lifted

Creditors are not required to sit quietly while they lose money. Any creditor can file a motion asking the court for relief from the stay, and courts grant these motions regularly.

The most common ground is lack of adequate protection. A car lender whose collateral is uninsured, or a mortgage holder whose borrower has stopped paying, can argue that keeping the stay in place is eroding its security interest. The court may lift the stay entirely or let it stand on conditions, such as resumed payments, insurance, or other steps to preserve the asset’s value.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

A creditor can also get relief by showing both that the debtor has no equity in the property and that the property is not necessary for an effective reorganization. If you owe $250,000 on a house worth $200,000 and you are in a Chapter 7 liquidation rather than a Chapter 13 repayment plan, there is no equity to distribute and no reorganization to support, and the court is likely to let the lender foreclose.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Courts also have a tool aimed at serial filers who use repeated bankruptcies to stall foreclosure on the same property. A judge can issue an in rem order that attaches to the real property itself. Once recorded in the land records, that order blocks the automatic stay from applying to the property in any future bankruptcy case for two years.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

What Happens When a Creditor Ignores the Stay

A creditor who knowingly violates the stay is exposed to real consequences. If you can show a willful violation, you are entitled to recover actual damages, including attorneys’ fees and court costs, and in egregious cases the court may add punitive damages.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay “Willful” here does not mean the creditor intended to break the law. It means the creditor knew about your bankruptcy and took the collection action deliberately. A bank that keeps pulling automatic loan payments after notice of your filing is acting willfully even if it later blames a system error.

In practice, that matters more than many filers realize. If a creditor repossesses your car after the petition date, you are not stuck asking for it back politely. You can file a motion in the bankruptcy court seeking return of the vehicle, your expenses, your legal fees, and additional damages.

How Long the Stay Lasts

For a first-time filer, the stay stays in effect until the court closes the case, dismisses it, or grants a discharge.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay In a typical Chapter 7, that is three to four months. In Chapter 13, the stay can last the entire three-to-five-year repayment period. Either way, specific creditors can shorten it by winning a motion for relief.

The rules get much harsher if you have filed before. If you had one bankruptcy case dismissed in the 12 months before your current filing, the stay expires 30 days after you file unless the court extends it. To get that extension, you have to move before the 30 days run out and prove by clear and convincing evidence that the new case was filed in good faith. The law presumes it was not.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay The court looks at why the earlier case was dismissed and whether your financial situation has actually changed. A dismissal for failing to file documents, failing to pay, or failing to follow a confirmed plan weighs heavily against you.

If two or more of your prior cases were pending and dismissed in the past year, no stay goes into effect at all when you file again. Creditors can keep collecting. A party in interest can ask the court to impose a stay within 30 days, but the same clear-and-convincing standard applies, and any stay the court does impose takes effect only on the date of the order, not back to the petition date.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Deadlines the Stay Freezes

The stay does not just stop collection activity. It also pauses certain clocks, which can cut either way.

If a creditor had a right to sue you when you filed, the civil statute of limitations stops running against that creditor during the stay. Once the stay ends, the creditor gets at least 30 extra days to sue, even if the original deadline would otherwise have passed while your case was open. The same extension applies to co-debtors protected by the Chapter 13 co-debtor stay.7Office of the Law Revision Counsel. 11 USC 108 – Extension of Time Assuming an old debt has expired on the calendar can be a costly mistake.

The IRS collection clock works the same way. The IRS normally has 10 years from assessment to collect a tax. Filing bankruptcy suspends that period on the petition date and keeps it suspended until the case is discharged, dismissed, or closed, plus an additional six months.8Internal Revenue Service. Time IRS Can Collect Tax9Office of the Law Revision Counsel. 26 USC 6503 – Suspension of Running of Period of Limitation If part of your strategy is to outlast an old tax, a bankruptcy filing can backfire by adding months or years to the government’s window.
