How SPV Sets Your Tax Floor
The 80 percent threshold is written into the law so that a low number on the bill of sale doesn’t automatically produce a low tax bill. Two buyers who pay very different amounts for the same year, make, and model can end up owing identical tax, because any purchase price below 80 percent of SPV gets replaced by that 80 percent figure for tax purposes. You only pay tax on your actual price when it meets or beats the floor.

Looking Up a Vehicle’s SPV Before You Buy
The Texas Department of Motor Vehicles maintains an online SPV calculator. Treat the number as informational. SPV figures are updated periodically, and the official taxable value is whatever the county tax office pulls on the day you title the vehicle.2Texas Comptroller of Public Accounts. When SPV Doesn’t Apply

- Purchases from a licensed dealer, taxed on the dealer’s documented sale price.
- Even trades between private parties with no money involved.
- Qualifying gift transfers between eligible family members, which use a flat $10 gift tax instead.
- Unrepaired salvage-title vehicles.
- Vehicles eligible for classic, custom, or street rod specialty plates under Transportation Code Section 504.501, whether or not those plates are displayed.
- Vehicles sold by government entities and those acquired through storage or mechanic’s liens.
- Vehicles obtained through the state’s abandoned vehicle process.

The $10 Gift Transfer Option
A legitimate gift between eligible relatives sidesteps the SPV calculation entirely. Texas charges a flat $10 gift tax rather than 6.25 percent of any value, but the transfer must involve zero consideration. Any payment, any assumed loan, any trade of something with value, and the transaction is treated as a sale with SPV applied.4Texas Department of Motor Vehicles. Eligible donors include a spouse (separate property only, not community property), parents, stepparents, in-laws, grandparents, children, stepchildren, siblings, siblings-in-law, foster parents, foster children, guardians, and a decedent’s estate. Nonprofits qualifying under IRC Section 501(c)(3) and certain revocable trusts also qualify. Anyone outside that list, including a friend, a boyfriend or girlfriend, or an unmarried partner, does not qualify. Handing over the keys with no money changing hands still triggers the full SPV tax calculation in those cases, not the $10 flat rate.
Challenging the SPV With a Certified Appraisal
When mechanical problems, body damage, high mileage, or other issues make a vehicle worth well under its SPV, you can substitute a certified appraisal for the SPV figure. This is the only way to pay tax on an amount below 80 percent of SPV, and the rules are strict.
Who Can Appraise
Only two types of professionals qualify: a licensed Texas motor vehicle dealer, limited to the categories of vehicles they’re licensed to sell, or a licensed insurance adjuster. The appraiser must physically inspect the vehicle and complete Form 14-128, the Used Motor Vehicle Certified Appraisal Form, listing their license number, the mechanical or cosmetic factors reducing value, and their signature.5Texas Comptroller of Public Accounts. Deadlines and Fees
The appraisal must be obtained and presented to the county tax office within 30 calendar days of the purchase date. For vehicles bought out of state, the 30-day clock starts when the vehicle enters Texas. Active-duty military personnel get 60 calendar days.1Texas Comptroller of Public Accounts. Dealers may charge between $100 and $300 for a standard vehicle appraisal, between $40 and $300 for a motorcycle, and between $100 and $500 for a travel trailer or motor home. What the Appraisal Cannot Do
An appraised value cannot fall below what you actually paid. Pay $5,000 for a vehicle an appraiser values at $3,500, and tax is still calculated on $5,000.6Cornell Law Institute. 34 Texas Administrative Code 3.79 – Standard Presumptive Value The appraisal only helps when the vehicle’s condition justifies a value below 80 percent of SPV but above your purchase price.
Out-of-State Purchases and Tax Credits
Buying a used vehicle in another state doesn’t get you out of SPV. When you bring the vehicle into Texas, you owe the 6.25 percent motor vehicle use tax on the SPV-based value, same as a local purchase. Texas participates in the Multistate Tax Compact, however, and gives dollar-for-dollar credit for a similar sales or use tax already paid to another state.7Texas Comptroller of Public Accounts. Pay 4 percent tax in the selling state and you owe Texas the remaining 2.25 percent. Pay 6.25 percent or more elsewhere and you owe nothing additional. Property taxes, import duties, value-added taxes, and fees paid to foreign countries do not count toward the credit.7Texas Comptroller of Public Accounts. The 30-Day Deadline and What Happens if You Miss It
Titling, registering, and paying tax all happen at the county tax assessor-collector’s office within 30 calendar days of the purchase date.8Texas Department of Motor Vehicles. Buying or Selling a Vehicle Two separate penalties stack once that window closes.
The title transfer penalty is an automatic $25, plus another $25 for each additional month the title is late. The tax payment penalty is a percentage of the sales tax owed. One to 30 days late brings a 5 percent penalty. More than 30 days late brings an additional 5 percent, for a total of 10 percent.
