Texas Limited Term Driver License: Expiration, Renewal, and REAL ID

A Texas Limited Term driver license carries the same driving privileges as any other Texas license, but it comes with restrictions built around your immigration status: it expires when your authorized stay ends (or after one year if your status has no fixed end date), it can only be renewed in person after a fresh federal status check, and the card itself is printed with the words “Limited Term” on the front. It can still be REAL ID compliant, and Texas cannot refuse to issue one just because your visa is short.

When the License Expires

This is the restriction that matters most. Under Texas Transportation Code Section 521.271, a Limited Term license expires on the earlier of two dates: the first birthday after the sixth anniversary of your application, or the date your lawful presence in the United States ends according to federal records.1State of Texas. Texas Transportation Code TRANSP 521.271 – License Expiration In practice, the second date almost always wins, because most temporary statuses run well under six years.

If your I-94 shows “duration of status” instead of a specific end date, common for F-1 students and J-1 exchange visitors, the license is valid for only one year from issuance.1State of Texas. Texas Transportation Code TRANSP 521.271 – License Expiration The same one-year cap applies at every renewal. DPS confirms the same structure in its fee schedule: the license costs $33 and expires when lawful presence expires, or in one year for duration-of-status holders.2Department of Public Safety. One protection cuts the other way. Texas law prohibits DPS from denying a license to someone with valid immigration documentation just because their authorized stay is short.3State of Texas. Renewal Has to Be Done in Person

Limited Term holders cannot renew online or by mail. Every renewal requires an in-person visit to a DPS driver license office with updated documents proving your lawful presence continues.4Department of Public Safety. Driver Licenses and ID Cards for Temporary Visitors The reason is the federal status re-check: DPS runs your record through the Systematic Alien Verification for Entitlements (SAVE) program at each renewal, and it will not issue a new card until SAVE returns a positive result.5Texas Department of Public Safety. Verifying Lawful Presence

Most SAVE checks clear within seconds. When the system cannot immediately confirm status, the case escalates to manual review that can run days or weeks, and DPS cannot override the delay.6USCIS. SAVE CaseCheck You can track a pending case through SAVE CaseCheck on the USCIS website. Bringing clean, unexpired, legible originals reduces the odds of triggering that manual review.

If your immigration status changes favorably, for example if you become a lawful permanent resident, you drop out of the temporary visitor category entirely and can apply for a standard license with an eight-year validity period. That switch also requires an in-person visit with your new documents.

The “Limited Term” Marking and REAL ID

Federal regulations require every temporary or limited-term license to state on its face and in the machine-readable zone that it is a temporary credential.7eCFR. 6 CFR 37.21 – Temporary or Limited-Term Drivers Licenses and Identification Cards On the Texas card, that shows up as the printed words “Limited Term” on the front, along with an expiration date that will usually be much sooner than the dates on a standard eight-year license.

The marking does not disqualify the card for federal purposes. A Limited Term license that carries the REAL ID star and was issued through the proper verification process is accepted by TSA at airport checkpoints and works for entering federal facilities.8TSA. REAL ID Frequently Asked Questions Expiration is absolute, though. An expired Limited Term license, even by a day, is not accepted for any federal purpose, and you cannot legally drive with it.

Why EAD Renewals Matter More Now

If your lawful presence is documented through an Employment Authorization Document, a recent federal change tightens the timing you have to plan around. Starting October 30, 2025, the Department of Homeland Security ended the longstanding practice of automatically extending EADs for people who filed timely renewal applications.9U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Under the old rules, filing a renewal kept your EAD valid while USCIS processed it, and that extension carried through as proof of lawful presence for your license. That automatic bridge is gone for most categories.

Certain groups still get extensions, including Temporary Protected Status beneficiaries whose extensions are published through Federal Register notices.9U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization For everyone else, USCIS recommends filing EAD renewals up to 180 days before the current card expires. If the EAD lapses before the new one arrives, you lose the documentation DPS needs at renewal, and there is no legal way to drive on the expired license in the meantime.

Commercial Driver Licenses Are Narrower

If you need a Commercial Driver License, the restrictions get stricter. Under federal rules, only holders of H-2A, H-2B, or E-2 status are eligible for a non-domiciled CDL.10Federal Motor Carrier Safety Administration. Non-Domiciled CDL 2026 Final Rule FAQs No other nonimmigrant category qualifies, and states cannot accept a Form I-797C Notice of Action as evidence of status for CDL purposes. Only documents that actually grant or confirm status count.

If a federal agency tells Texas that a non-domiciled CDL holder no longer has qualifying status, or if a SAVE check fails, Texas must downgrade or cancel the CDL within 30 days.10Federal Motor Carrier Safety Administration. Non-Domiciled CDL 2026 Final Rule FAQs The consequences run faster and harder than for a standard Limited Term license.

Documents to Bring for an Application or Renewal

Every applicant fills out Form DL-14A, the adult driver license application.11Texas Department of Public Safety. Texas Driver License or Identification Card Application On top of that, DPS wants three things: proof of lawful presence, identity verification, and Texas residency.

For lawful presence, bring original, unexpired immigration documents. Commonly accepted items include an unexpired I-94, a Form I-766 Employment Authorization Card, or a valid foreign passport paired with a visa and I-94.12Department of Public Safety. U.S. Citizenship or Lawful Presence Requirement Students usually bring a valid I-20 as well. Photocopies and expired paperwork will not be accepted.

If you are lawfully present but not eligible for a Social Security number, request Form SSA-L676 from the Social Security Administration. It documents that your SSN application could not be processed.13Social Security Administration. Form SSA-L676 – Refusal to Process SSN Application DPS may accept it alongside your immigration documents to satisfy the SSN step.

For residency, you need two separate printed documents showing your name and a Texas address, and at least one must show 30 days of Texas residency.14Department of Public Safety. Texas Residency Requirement for Driver Licenses and ID Cards A lease, utility bills within 180 days, bank or credit card statements, a current auto insurance policy, or a USCIS-issued document all work. The name on every residency document must match the name on your immigration paperwork exactly. Any mismatch causes delays or a rejection.
