To qualify for a Texas driver’s license, you have to meet the state’s eligibility requirements: you must be old enough for the license class you want, have established Texas residency, prove your identity and lawful presence in the United States, meet vision and health standards, and have no active driving suspension in another state.1State of Texas. Texas Transportation Code Section 521.021 – License Required Miss any one of these and the Department of Public Safety (DPS) will turn you away, no matter how complete the rest of your paperwork looks.
Age Requirements
Texas licenses drivers under 18 through a graduated system with two stages before full driving privileges.
At 15, a teen can apply for a learner license after finishing the classroom portion of an approved driver education course. A concurrent course requires six classroom hours; a block course requires 24.2Texas Department of Public Safety. Texas Learner License as a Teen The learner license only allows driving with a licensed adult 21 or older in the front passenger seat.
A provisional license comes next, after the full driver education program, the required behind-the-wheel hours, and a driving test. The teen must also complete the Impact Texas Teen Drivers program and present a valid, unexpired ITTD certificate before testing.3Texas Department of Public Safety. Texas Provisional License as a Teen Provisional holders drive under three restrictions until they turn 18: no more than one passenger under 21 who isn’t family; no driving between midnight and 5:00 a.m. except for work, school, or emergencies; and no wireless device use, including hands-free.4Texas Department of Public Safety. Applicants 18 and older skip the graduated system. They take the knowledge and skills tests and, once licensed, drive without provisional restrictions. The application asks whether you have held a license in another state and whether it was ever suspended or revoked, so answer honestly.5Texas Public Law. At 85 and older, you receive a two-year license rather than the standard eight-year card, which means more frequent renewal visits so DPS can recheck vision and health.6Texas Department of Public Safety. Senior Drivers – Age 65 or Older
Residency
You must have lived in Texas for at least 30 days before applying, under state administrative rules.7Cornell Law Institute. 37 Texas Administrative Code 15.49 – Proof of Domicile There is one exception worth knowing: if you surrender a valid, unexpired license from another state, the 30-day wait does not apply and you can apply as soon as you can prove you live here.
New residents get 90 days to drive on an out-of-state license after moving to Texas.8Department of Public Safety. Moving to Texas: A Guide to Driver Licenses and IDs Before the window closes, visit a DPS office in person and surrender the old card. Driving past the deadline exposes you to a citation for operating without a valid license.
Identity and Lawful Presence
Every applicant proves both identity and lawful presence in the United States. U.S. citizens typically use a valid passport, or an original birth certificate paired with a Social Security card. Non-citizens present immigration documents showing their status, such as a permanent resident card or an employment authorization document.
DPS verifies immigration documents through the federal Systematic Alien Verification for Entitlements program, which checks your records against Department of Homeland Security databases.9Texas Department of Public Safety. Verifying Lawful Presence If your authorized stay has an expiration date, DPS issues a limited-term license that expires with your status, and you cannot renew online. You will return in person with updated immigration documents each cycle.
People without lawful immigration status are not eligible for a standard Texas driver’s license under current law. Other documents will not substitute.
Vision and Health Standards
Texas law authorizes DPS to decide whether a medical condition affects your ability to drive safely, and requires you to disclose any condition that could impair vehicle operation.10Texas Department of State Health Services. When DPS cannot judge the severity of a reported condition on its own, it refers the case to the Medical Advisory Board, a panel of licensed physicians that reviews reports from your own doctor and issues a written recommendation.11Cornell Law Institute. 37 Texas Administrative Code 15.58 – Medical Advisory Board Referrals Cardiovascular disease and seizure disorders such as epilepsy commonly trigger a referral. The board meets every other week, so expect a wait if your file is sent up.
A referral often ends in a restricted license rather than a denial. Common restrictions include corrective lenses, daylight-only driving, and additional mirrors or adaptive equipment. Outright denial is reserved for conditions where no restriction can protect public safety.
At the office, every applicant takes a vision test. The passing standard without corrective lenses is 20/40 acuity in each eye and both eyes together.12Cornell Law Institute. 37 Texas Administrative Code 15.51 – Vision Tests If you fall below that, DPS refers you to an eye specialist. A corrective-lens restriction on your license is a common result, not a disqualification.
If you have a disability that affects testing, the Americans with Disabilities Act requires DPS to provide accommodations so you have an equal opportunity to demonstrate your abilities.13ADA.gov. ADA Requirements: Testing Accommodations These can include extended time, large-print or screen-read exams, a distraction-free room, or a wheelchair-accessible station. Contact your DPS office ahead of the appointment.
Out-of-State Suspensions
This is the eligibility trap that catches the most applicants. If your driving privilege is suspended, revoked, denied, or canceled in any other state, you are not eligible for a Texas license. DPS will not issue one until the other state clears your record.14Texas Department of Public Safety. Out-of-State Offenses and Withdrawals If you already hold a Texas license when another state reports a disqualifying action, Texas will cancel yours until that state marks you eligible again. Court paperwork from the other state will not fix the problem; the clearance has to come from that state’s licensing agency.
DPS finds these problems through the National Driver Register, a federal database of drivers whose privileges have been revoked, suspended, or denied anywhere in the country. The system points the state where you apply to the state that holds your record, so the details travel with you.15National Highway Traffic Safety Administration. Documents You Must Bring
DPS rejects incomplete applications on the spot, and photocopies are not accepted. Bring originals of the following:
- Proof of identity and lawful presence, such as a valid U.S. passport, original birth certificate, or permanent resident card. A single qualifying federal document can satisfy both.
- Social Security verification: your Social Security card, a W-2, or an SSA-1099 showing your full number. Federal law authorizes Texas to require this for license administration.16U.S. Department of Justice. Disclosure of Social Security Numbers
- Two proofs of Texas residency, each showing your name and residential address, each dated within 180 days of your application, and each from a different source. - Vehicle registration and proof of insurance if you own a vehicle. Texas minimums are $30,000 per injured person, $60,000 per accident, and $25,000 for property damage. If you do not own a vehicle, you sign a statement to that effect. Vehicle registration is specifically required from new residents surrendering an out-of-state license.18State of Texas. Two bills from the same utility company will not count as two proofs of residency; the sources have to be independent.
REAL ID and Your License
Federal enforcement of the REAL ID Act began May 7, 2025. A non-compliant license can no longer be used to board domestic flights or enter certain federal facilities. Texas has issued REAL ID-compliant cards since October 2016, marked by a gold star inside a circle in the upper right corner.20Department of Public Safety.
