A student loan settlement in 2026 can mean one of three very different things: an automatic check from the Consumer Financial Protection Bureau’s enforcement action against Navient, an automatic loan discharge under the Sweet v. McMahon class action for borrowers defrauded by their schools, or a lump-sum payoff you negotiate yourself on a defaulted loan. Each has its own eligibility rules, its own process, and its own consequences, and the differences matter before you cash a check, wait for a discharge, or pick up the phone to negotiate.
The Navient CFPB Payments
In September 2024, the CFPB entered a consent order against Navient Corporation, Navient Solutions, and Pioneer Credit Recovery over what it called “wide-ranging student lending failures,” including steering borrowers into forbearance instead of income-driven repayment, misapplying payments, and incorrectly reporting disabled borrowers as in default.1Consumer Financial Protection Bureau. The Earlier $1.85 Billion Multi-State Settlement
A separate, larger settlement predates the CFPB action. In January 2022, Navient reached a $1.85 billion agreement with 39 state attorneys general, led by Illinois, California, Massachusetts, Pennsylvania, and Washington.7Illinois Attorney General. Announces $1.85 Billion Settlement With Student Loan Servicer Navient It included nearly $1.7 billion in cancellation of subprime private student loans for about 66,000 borrowers, plus $95 million in restitution — roughly $260 per person — for about 350,000 federal borrowers pushed into long-term forbearance.
Federal restitution generally required that you lived in a participating state as of January 2017, entered repayment before January 2015, and spent at least two consecutive years in forbearance between October 2009 and January 2017.8Navient AG Settlement. Navient AG Settlement Private loan cancellation covered subprime loans originated between 2003 and 2014 that were delinquent for more than seven consecutive months before June 30, 2021. Relief went out automatically, and the deadline to request a reissued restitution check was August 31, 2023. Sweet v. McMahon: Discharges for Borrowers Defrauded by Their Schools
If you took out federal loans to attend a school that misled you, the relevant settlement is Sweet v. McMahon — originally filed as Sweet v. DeVos — a class action in the Northern District of California before Judge William Alsup.9Civil Rights Litigation Clearinghouse. Sweet v. Cardona Final approval came on November 16, 2022, covering a reported $6 billion in relief for roughly 200,000 borrowers.10Higher Ed Dive. Here’s a List of the Colleges in the Sweet v. Cardona Settlement Agreement
The settlement sorts class members into three groups:
- Group 1 covers borrowers who attended schools on the settlement’s Exhibit C list — more than 150 institutions including ITT Technical Institute, DeVry University, the University of Phoenix, The Art Institutes, Corinthian Colleges (Everest, WyoTech, Heald), Argosy University, Ashford University, Kaplan schools, and Brown Mackie College. These borrowers receive full automatic discharge of the federal loans tied to the school, refunds of payments made, and removal of the loan from their credit report.11Federal Student Aid. Sweet v. - Group 2 covers class members whose schools were not on Exhibit C. Their borrower defense claims had to be decided on a timeline tied to how long they had been waiting, and a missed deadline triggered automatic full relief.9Civil Rights Litigation Clearinghouse. Sweet v. Cardona
- Group 3 covers post-class applicants who filed borrower defense applications between June 23 and November 15, 2022. They were entitled to a decision within three years, with the same automatic-relief backstop if the Department missed the deadline.
As of mid-2026, the Department of Education has provided roughly $12 billion in relief to nearly 300,000 borrowers under the settlement.13Forbes. Student Loan Discharge Emails Sent to 30,000 Borrowers as Settlement Relief Proceeds About 170,000 post-class borrowers who attended Exhibit C schools received discharge notices after the January 28, 2026, deadline passed. In June 2026, the Department began issuing notices to roughly 30,000 additional post-class borrowers who did not attend Exhibit C schools after missing the April 15, 2026, deadline.
Full relief means discharge, refunds of amounts previously paid, and deletion of the credit tradeline, to be delivered within one year of the notice.12Federal Student Aid. Sweet v. McMahon Settlement While you wait, you are not required to make payments, and the Department cannot garnish wages or offset tax refunds.
The Department is simultaneously appealing to the Ninth Circuit (Case No. 26-1136), arguing that “materially changed circumstances” have increased the implementation burden.13Forbes. Student Loan Discharge Emails Sent to 30,000 Borrowers as Settlement Relief Proceeds On March 25, 2026, a Ninth Circuit panel denied the Department’s emergency motion for a stay, finding it had not shown a likelihood of success on the merits and had known since February 2023 that the post-class group exceeded 205,000 people.14U.S. Court of Appeals for the Ninth Circuit. Settling a Defaulted Federal Loan on Your Own
If you have defaulted on a federal student loan, you may be able to negotiate what the Department of Education calls a “compromise” to resolve the debt for less than you owe. This option opens only after default, which the Department defines as 270 days without payment.16Federal Student Aid. Default
Private collection agencies working for the Department can approve three standard compromises without further sign-off:
- A collection fee waiver, where you pay the current principal plus all accrued interest but no collection charges.
- A half-interest compromise, where you pay the principal plus 50% of accrued interest.
- A 90% compromise, where you pay at least 90% of combined principal and interest.17FinAid. Settlements
Anything below those thresholds counts as a “nonstandard” compromise and typically requires Department approval. Agencies can offer at most six nonstandard deals per quarter, and they rarely volunteer them, because their commissions run roughly 25% of what they collect on principal and interest.17FinAid. Settlements
Federal settlements are lump sums, not installment plans. Payment must usually be completed within 90 days of the offer and made by cashier’s check, money order, certified check, or credit card.17FinAid. One thing to keep in mind on timing: on January 16, 2026, the Department of Education announced an indefinite pause on involuntary collections for defaulted borrowers, including wage garnishment and Treasury offsets of tax refunds and Social Security benefits.19PBS. Settling a Private Student Loan
Private lenders are not bound by the Department’s compromise framework. They generally will not negotiate until a loan is in default or has been charged off and sold to a collection agency.21Student Loan Borrower Assistance. Settling Private Student Loans
Settlement amounts vary with the age of the debt and how hard the borrower would be to collect from. Lump-sum settlements typically run 50% to 90% of the balance.22California Courts Self Help. Debt Settlement on Student Loan Debt Private lenders lack federal tools like garnishment and tax offset, which gives borrowers somewhat more leverage.
Before you call, have the lump sum ready, gather documentation of hardship, and refuse to pay until you have a written agreement that marks the account “paid in full.”23Bankrate. Taxes on Settled or Forgiven Student Loan Debt

Two exceptions matter. Public Service Loan Forgiveness is still tax-free. And in October 2025, the Department of Education reached an agreement with the American Federation of Teachers covering borrowers who became eligible for income-driven repayment forgiveness in 2025 but whose paperwork was delayed by backlogs: the Department treats the eligibility date as the effective discharge date and will not file a 1099-C for those borrowers.26CNBC. Settlement Scams
Large settlements and shifting policy create cover for fraud. The CFPB and FTC have confirmed that scammers have stolen millions from student loan borrowers by posing as relief companies.27Consumer Financial Protection Bureau. What Are the Signs of a Student Loan Scam In one recent case, the FTC permanently banned BCO Consulting Services and SLA Consulting Services from the debt relief industry after they falsely claimed Department of Education ties and charged borrowers for free services. Warning signs include upfront fees (legitimate servicer help is free), promises of instant or guaranteed forgiveness, requests for your FSA ID (your servicer and the Department will never ask for it), power-of-attorney forms that cut you off from your real servicer, and official-sounding names and logos designed to look like the Department of Education.27Consumer Financial Protection Bureau.
