Student Loan Forgiveness for VA Disability: Apply, Refunds, Taxes

If the VA has rated your service-connected disability at 100% or determined that you are unemployable because of a service-connected condition, you qualify for student loan forgiveness for VA disability through the federal Total and Permanent Disability (TPD) discharge program. Who Qualifies

There are two VA determinations that open the door to TPD discharge, and either one is enough:

  • A service-connected disability rated at 100%.
  • A determination that you are unemployable due to a service-connected condition (Total Disability Based on Individual Unemployability, or TDIU).

Both lead to the same outcome: full cancellation of qualifying federal student loan debt.3eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge You do not need a physician’s certification or Social Security Administration paperwork. Which Loans Are Covered

TPD discharge covers three categories of federal education debt:

  • William D. Ford Federal Direct Loans, including subsidized, unsubsidized, PLUS, and consolidation loans.
  • Federal Family Education Loan (FFEL) Program loans, including Stafford and FFEL PLUS.
  • Federal Perkins Loans.

TEACH Grant service obligations are also dischargeable. If you have an outstanding TEACH Grant obligation and receive a TPD discharge, the service requirement ends and the grant does not convert into a loan.4Federal Student Aid. Total and Permanent Disability Discharge

Private student loans are not part of the program. TPD applies only to federal debt held or guaranteed by the Department of Education. If you carry private loans, you would need to work directly with those lenders on any relief.

Parent PLUS Loans

If you borrowed a Parent PLUS loan to help pay for a child’s education, the discharge is based on your disability as the borrower. A parent with a 100% VA rating or TDIU determination can have Parent PLUS loans discharged. If the student is the one with a qualifying disability but the parent is not, the parent’s PLUS loan is not eligible. The disability has to belong to the person who signed for the loan.

How to Apply

Many veterans do not need to file anything. The Department of Education periodically receives data from the VA identifying veterans who hold federal student loans and have a qualifying disability rating. When the match finds you, the Department sends a notice explaining that your loans will be discharged no earlier than 61 days after the notice date unless you request faster discharge or opt out.5Department of Veterans Affairs. If you have not received a notice, or you want to move sooner, you can apply directly:

  • Log in to StudentAid.gov and go to the TPD Application page.
  • Select the VA documentation option on the disability information screen.
  • Upload your VA documentation showing the qualifying rating.
  • Sign and submit electronically, or download the PDF to sign by hand.

Documentation

The document you need is your VA Benefit Summary Letter, sometimes called a VA award letter, which you can download from the VA’s website.6Veterans Affairs. Download VA Benefit Letters The letter must show either the 100% service-connected rating or the TDIU determination, and it must reflect your most recent rating decision. An older letter that does not show the qualifying determination will slow things down.

Before you submit, confirm that your Social Security number and date of birth match what the VA and your loan servicer have on file. Small mismatches between those records are one of the most common reasons applications stall.

While Your Application Is Under Review

You are not required to make payments on the loans included in your discharge request while the application is being reviewed. One exception matters: if your loans are already in default and the government is collecting through wage garnishment or Treasury offset, those collections continue until the discharge is actually approved.7Consumer Financial Protection Bureau. Refunds of Past Payments

For veterans, the discharge is effective on the date the VA made the qualifying disability determination, not the date you applied or the date the Department approved your application.8eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge Any payments received on or after that VA determination date get refunded to whoever made them.4Federal Student Aid. Say the VA rated you 100% disabled in March 2023, and you kept paying your loans through 2025 before applying. Every payment made from March 2023 forward comes back to you. That can be a substantial refund, which is a reason to apply even if you have been current on the loans for years since your rating.

Federal and State Taxes

Student loan debt canceled because of death or total and permanent disability is permanently excluded from federal gross income. Congress made the exclusion permanent in July 2025, replacing an earlier temporary provision that had been set to expire at the end of that year.1Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness The updated law applies to discharges after December 31, 2025, while the American Rescue Plan Act provision covered discharges from 2021 through 2025. You may still receive a Form 1099-C (Cancellation of Debt) from your loan servicer showing the discharged amount, because creditors are required to file one when they cancel $600 or more in debt.10Internal Revenue Service. State treatment is less uniform. Most states with an income tax follow the federal definition of taxable income, so the federal exclusion flows through automatically. A handful of states use older versions of the federal code or have chosen not to adopt certain exclusions, and veterans in those states could face a state income tax bill on the discharged amount. A short conversation with a tax professional familiar with your state’s conformity rules will tell you where you stand.

Borrowing Federal Student Loans Again

A TPD discharge based on VA documentation is final once approved. Your old loans will not be reinstated if you decide to return to school. Taking out new federal student loans after a TPD discharge does require an extra step: you will need a physician to certify that you are able to engage in substantial gainful activity and attend school, and you will sign an acknowledgment that the new loans cannot be discharged under TPD unless your condition substantially deteriorates to total and permanent disability again.4Federal Student Aid. A veteran considering opting out of an automatic discharge because they plan to borrow again should weigh whether keeping the current loans is easier than clearing that step later.
