SSN for H4 Visa Holders: Eligibility, EAD Route, and ITIN Option

An H4 visa holder can get a Social Security Number, but only after receiving work authorization through an Employment Authorization Document (EAD). The Social Security Administration issues SSNs to noncitizens only when they have permission to work in the United States, so on H4 status the EAD is the gate.1Social Security Administration. Foreign Workers and Social Security Numbers If you don’t qualify for an EAD but need a taxpayer ID to file a return, the IRS offers a separate route through the ITIN.

Who Qualifies

Not every H4 dependent can apply. USCIS allows an H4 spouse to file Form I-765 for an EAD only if the H-1B spouse meets one of two conditions:2U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses

  • The H-1B spouse is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker; or
  • The H-1B spouse has been granted an extension of H-1B status past the standard six-year limit under the American Competitiveness in the Twenty-first Century Act (AC21), which applies to workers in the employment-based green card process whose extensions are tied to processing backlogs.

If the H-1B spouse hasn’t hit one of those milestones, the H4 dependent can’t get an EAD, and without an EAD there is no SSN. The timing is driven entirely by the H-1B case.

H4 Children Cannot Get an SSN

H4 status covers spouses and unmarried children under 21, but the EAD eligibility above is limited to spouses. H4 dependent children cannot obtain work authorization and are not eligible for a Social Security Number in most circumstances. Families with older teenagers approaching working age often run into this.

Two Ways to Get the SSN After Your EAD

Request It on the EAD Application

When you file Form I-765, you can ask USCIS to share your information with SSA so the SSN is issued automatically once the EAD is approved. The SSN card arrives in a separate envelope, usually within about seven business days after the EAD.3Social Security Administration. Apply for your Social Security Number While Applying for Your Work Permit If it doesn’t arrive in that window, contact SSA by phone or visit a local office. This is the simpler path for most people because it skips a separate trip.

Apply at a Social Security Office

If you didn’t check the SSN box on Form I-765, or the automated data sharing didn’t produce a card, apply directly at a Social Security office. SSA recommends waiting at least 10 days after arriving in the United States so immigration records have time to sync across databases; applying earlier often triggers verification delays.4Social Security Administration. You can start online through SSA’s website and then bring your documents to a local office in person.5Social Security Administration. Documents to Bring

SSA accepts originals or copies certified by the issuing agency. Photocopies and notarized copies won’t be accepted.7Social Security Administration. Learn What Documents You Will Need to Get a Social Security Card Bring:

  • Your unexpired foreign passport, which serves as identity and age proof.
  • Form I-94, Arrival/Departure Record, which shows lawful admission. You can print it from the CBP website if you don’t have a paper copy.
  • Your Employment Authorization Document (Form I-766). Without it, SSA will not process the application.4Social Security Administration. Social Security Numbers for Noncitizens

If any document is in a language other than English, SSA handles translation through an internal process, so you don’t need to bring a certified translation yourself.8Social Security Administration. Processing Time and What the Card Says

Once SSA approves the application, the card arrives by mail in five to 10 business days, assuming immigration records can be verified electronically.5Social Security Administration. Request a Social Security Number for the First Time When verification requires SSA to contact USCIS or DHS directly, which happens more often with recently issued EADs, the wait can stretch to several weeks or, in rare cases, several months.9Social Security Administration. Your card will carry the legend “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” That restriction means the card itself is not a standalone List C document for Form I-9 employment verification; you use your EAD for that instead.10U.S. Citizenship and Immigration Services. What Happens When Your EAD Expires

The nine-digit SSN itself is permanent. It stays assigned to you for life and continues to be used for tax reporting and earnings records regardless of what happens to your immigration status. The card, though, is only valid as work authorization proof when paired with a current EAD or other DHS authorization, because of the restrictive legend.11Congressional Research Service. Noncitizen Eligibility for Employment Authorization and Work

You aren’t required to notify SSA when your status changes. If you renew your EAD, become a permanent resident, or naturalize, you can request an updated card under the same number with the appropriate legend, or no legend at all once you are a citizen. A new SSN is never issued; only the card changes.

The ITIN Route If You Can’t Get an SSN

If you’re an H4 dependent who doesn’t qualify for an EAD, either because the H-1B spouse’s I-140 hasn’t been approved or because you’re an H4 child, you can’t get an SSN. You may still need a taxpayer identification number to be listed on a U.S. tax return. That’s what the Individual Taxpayer Identification Number (ITIN) is for.12Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN)

A common example: an H4 spouse wants to file jointly with the H-1B spouse to use lower tax rates and the standard deduction. The H4 spouse needs either an SSN or an ITIN to appear on that return.13Internal Revenue Service. Nonresident Spouse

To apply, file Form W-7 with the IRS along with your federal tax return and original identity documents, or certified copies from the issuing agency.14Internal Revenue Service. It doesn’t authorize employment and won’t substitute for an SSN once you become eligible for one.
