Three SSI rule changes took effect on September 30, 2024, and together they mean higher payments for many recipients and less paperwork for nearly everyone. Food Help No Longer Reduces Your Payment
Before September 30, 2024, groceries or meals provided by friends, family, or community organizations counted as unearned income under the in-kind support and maintenance rules. If a relative regularly bought you food or you ate at someone’s home, the agency could cut your monthly check. Food has now been removed from those calculations entirely.2Federal Register. This is where the old rules caused the most trouble. Recipients had to track and report the value of food they received, which was confusing and easy to get wrong. An unreported bag of groceries from a relative could produce an overpayment notice months later. The new rule eliminates that entire category of reporting, so you no longer need to document food assistance from anyone.1Social Security Administration. More Households Now Count as Public Assistance Households
Living in a “public assistance household” generally protects your SSI payment from reductions for shared living expenses, because you are presumed to be paying your fair share. Under the old rule, every person in the household had to be receiving public assistance. Most mixed-income families could not clear that bar.
Two things changed. For someone living with a spouse or parent who receives SNAP, this change alone can mean a noticeably higher monthly check.
The Rental Subsidy Exception Now Applies in Every State
Many SSI recipients live in housing owned by family or friends and pay less than market rent. Under the old rules, the difference between what you paid and the property’s fair market value could be treated as in-kind support and maintenance, potentially cutting your benefit by up to one-third of the federal rate plus $20. A favorable exception existed in seven states because of court decisions, but recipients everywhere else were stuck with the harsher standard.5Social Security Administration. As of September 30, 2024, the rental subsidy exception applies nationwide. If your rent equals or exceeds a threshold called the “presumed maximum value,” the agency counts no rental subsidy as income.6Social Security Administration. 20 CFR 416.1130 – Introduction If your rent falls below that threshold, the agency counts only the difference between what you pay and the presumed maximum value (or the actual market rent, whichever is less), rather than the full gap between your rent and market rate.
The practical effect: if you pay a reasonable baseline amount, your SSI stays intact even when a family member is giving you a deal on housing. Before this change, a recipient in Ohio or Georgia could lose hundreds of dollars in benefits for the same living arrangement that would have been fine in Illinois or New York. That geographic split is gone.
What Still Counts Against Your Benefit
The food exclusion did not touch shelter-related help. Assistance with rent, mortgage payments, utilities, and property taxes still counts as in-kind support and maintenance.7Social Security Administration. 20 CFR 416.1102 – What Is Income? Old Food-Related Overpayments May Be Worth a Second Look
Food-related overpayments were common under the old in-kind support rules. If you received one of those notices in the past, you can still request a waiver. The agency will grant a waiver when you were not at fault and repaying the money would deprive you of funds needed for housing, food, clothing, or medical care.9Social Security Administration. If a waiver is not granted, standard recovery from ongoing checks is capped at 10 percent of your total monthly income, which includes your SSI payment, any state supplement, and countable income combined.10Social Security Administration. 20 CFR 416.571 – 10-Percent Limitation of Recoupment Rate You can ask for a lower rate if that amount would cause hardship, and the agency will look at your income, resources, and living costs before setting a reduced figure.
A Simpler Way to Apply Online
For years, applying for SSI meant an in-person or phone appointment at a Social Security field office, often with long waits and multiple visits. Starting in late 2024, the agency began rolling out a streamlined online application for some applicants.11Social Security Administration. If your situation is complex or the online form gives you trouble, an in-person appointment is still an option.
