Which Vehicles Are Covered

The rule targets vehicles that aren’t classified as standard passenger cars or trucks. Dual-sport motorcycles are the common trap. A street-legal bike with a valid plate still needs a qualified spark arrestor to ride public trails. Closed-course race machines usually ship without arrestors because tracks are cleared of brush. The moment that bike touches a public trail, the requirement applies. Convert before you ride.

What Makes an Arrestor Legal: USFS Standard 5100-1

The governing technical standard is USFS Standard 5100-1 (current revision 5100-1d), which sets minimum performance and maintenance requirements for spark arrestors on engines used near grass, brush, and timber. Manufacturers submit designs to an accredited testing lab for qualification. The Forest Service accepts testing from its own San Dimas, California facility, Underwriters Laboratories, DLG e.V., and CSA International.2USDA Forest Service. The Label Myth

A common misconception is that the device has to be stamped “Qualified per USFS Standard 5100-1.” It doesn’t. What the standard actually requires is permanent markings, visible without removing the device, showing the manufacturer’s name or trademark and the model designation, with screen-type arrestors also marked “SCREEN TYPE.” Markings must be at least 1/8 inch (3.2 mm) tall and applied by stamping, etching, dot peening, or durable label.2USDA Forest Service. If your model isn’t on the list, no stamped wording will save you.

Screen and Housing Specs

Screen-type arrestors trap carbon particles in a wire mesh. The standard caps any screen or housing opening at 0.023 inches (0.58 mm), small enough to stop heat-retaining particles from reaching dry vegetation.2USDA Forest Service. Aftermarket Exhausts and Catalytic Converters

Some catalyst-equipped exhaust systems do trap large debris well enough to function as a spark arrestor, but only systems specifically tested and qualified through the standard process count.3USDA Forest Service. Aftermarket exhausts need particular caution. Many performance pipes for off-road bikes and ATVs ship without spark arrestors, and any modification to a qualified exhaust after testing voids its qualification.4USDA Forest Service. Where and When the Rules Apply

National Forest System Lands

The Forest Service prohibits operating any internal or external combustion engine without a properly installed, maintained, and functioning spark arrestor meeting Standard 5100-1.5Federal Register. BLM Lands

Fire Restriction Stages

When fire danger climbs, agencies stack additional restrictions on top of the baseline rule. Under Stage 1, the spark arrestor mandate stays in effect and agencies often require extra equipment for chainsaw and generator use, such as a fire extinguisher and a shovel. Stage 2 goes further: some forests prohibit operating internal combustion engines entirely during the hottest hours, typically 9:00 AM to 8:00 PM, for activities like wood cutting and road building. Even generators may only run under Stage 2 if they carry a qualified spark arrestor and sit in an area cleared of flammable material within three feet.

Restriction stages vary by forest and by year. Check the current status of the specific area you plan to visit before you go.

What Rangers Check in the Field

Expect inspections at trailheads, staging areas, and during trail encounters. The first check is visual: rangers look for the manufacturer’s name and model number on the device, then compare that model against the qualified products list.

For centrifugal-type arrestors, rangers use a probe test. They insert a rod into the exhaust outlet to see whether internal baffles stop it. If the probe passes the full length of the arrestor, the internal parts have been removed or damaged and the vehicle fails.7USDA Forest Service. A damaged or worn-out arrestor is treated the same as no arrestor at all. A screen full of holes fails as badly as an empty pipe. Spark arrestor screens are wear items; replacing one before a ride costs far less than a citation and a tow home.

Penalties and Wildfire Cost Recovery

Violating the spark arrestor requirement on National Forest land falls under 36 CFR Part 261, which carries a maximum penalty of six months imprisonment, a fine under 18 U.S.C. 3571, or both.8eCFR. 36 CFR 261.1b – Penalty Most first-time violations end in a citation and a fine rather than jail time, but amounts vary by jurisdiction and repeat offenses during high fire danger draw much stiffer consequences.

The fine is the smaller problem if things go wrong. Both the Forest Service and BLM pursue cost recovery when someone’s equipment or negligence starts a wildfire. Many states also penalize operating unequipped vehicles on state-managed lands, and some allow civil suits from neighboring landowners whose property is damaged by a fire you started. The federal fine is the floor of your exposure, not the ceiling.

Beyond Vehicles: Chainsaws and Generators

The spark arrestor requirement isn’t limited to what you ride. Chainsaws, portable generators, brush cutters, and other small engine equipment used on public lands all need qualified arrestors of their own. During Stage 1 fire restrictions, operating a chainsaw on BLM land typically requires a working USDA- or SAE-approved arrestor, a chemical fire extinguisher of at least 8 ounces, and a round-point shovel at least 36 inches long.
