Social Security Disability Benefits Cut Off: Appeals and Reinstatement

If your Social Security disability benefits were cut off, the agency has decided one of a few things: your medical condition improved, you earned above the monthly work limit, your income or resources changed (for SSI), you missed a requested exam or paperwork, or you were incarcerated. You have 60 days from the date you receive the cessation notice to appeal, and if you want your payments to keep coming while the appeal is pending, you have to act within 10 days. Everything else follows from figuring out which reason applies to you.

Why Social Security Stops Disability Benefits

The reason on your notice determines what you do next, so start there.

Medical Improvement Found at a Continuing Disability Review

Social Security periodically runs a Continuing Disability Review to check whether your condition has improved.1Social Security Administration. 20 CFR 404.1594 – How We Will Determine Whether Your Disability Continues or Ends How often depends on whether improvement was expected: as often as every six to 18 months if it was, longer intervals if it was not.

The agency cannot cut you off just because your records show some improvement. It has to find that the improvement is related to your ability to work and that you can now perform substantial gainful activity.2Social Security Administration. How We Decide if You Still Have a Qualifying Disability If your health has not meaningfully changed, or if you still cannot hold a job despite feeling somewhat better, benefits should continue. Cessation decisions get overturned most often at this exact point, where a modest uptick in functioning gets treated as the ability to sustain full-time employment.

Earning Above the Substantial Gainful Activity Limit

You can work while on SSDI, but the paycheck matters. In 2026, earning more than $1,690 a month before taxes generally disqualifies non-blind recipients; the threshold for blind recipients is $2,830.3Social Security Administration. Substantial Gainful Activity

Before benefits stop for work, SSDI recipients get a Trial Work Period: nine months (not necessarily consecutive) inside a rolling five-year window during which you keep your full check no matter what you earn. In 2026, any month you earn more than $1,210 counts as a Trial Work Period month.4Social Security Administration. The Red Book – What’s New in 2026 After those nine months are used, you enter a 36-month Extended Period of Eligibility, during which you get paid for any month your earnings fall below the SGA limit and lose payment for months they exceed it. Only after that extended period can the agency permanently terminate benefits for working.

Impairment-related work expenses (wheelchair maintenance, specialized transportation, medications tied to your ability to work) are deducted before the agency calculates whether your earnings cross the threshold.

Income or Resource Changes on SSI

SSI is need-based, so the rules are tighter. If your countable resources — bank accounts, cash, stocks, most property beyond your home and one vehicle — exceed $2,000 for an individual or $3,000 for a couple at the start of any month, you lose eligibility that month.5Social Security Administration. Supplemental Security Income SSI Resources Income from any source reduces or eliminates the payment, and if your countable income exceeds the federal benefit rate, the check drops to zero.6Social Security Administration. 20 CFR 416.1100 – Income and SSI Eligibility

Free shelter counts too. If someone covers your rent, mortgage, or utilities, the agency treats it as unearned income and may reduce your SSI.7Social Security Administration. 20 CFR 416.1130 – In-Kind Support and Maintenance Since September 30, 2024, free food no longer counts.8Federal Register. Omitting Food From In-Kind Support and Maintenance Calculations

Missed Exams or Requests for Records

If you skip a consultative examination the agency scheduled, or you do not send in updated medical records when asked, the agency can stop benefits without ever finishing a medical review.9Social Security Administration. Disability Evaluation Under Social Security – Part II – Evidentiary Requirements This is one of the most avoidable cutoffs. Any letter asking for records or scheduling an exam should be treated as urgent.

Incarceration

Benefits are suspended, not terminated, if you are confined for more than 30 continuous days after a criminal conviction. Payments can restart the month you are released once you contact Social Security with proof of release.10Social Security Administration. Benefits After Incarceration: What You Need To Know Some prisons have prerelease agreements that let the process start up to 90 days before your release date.

When It Is Not Really a Cutoff

If you have just reached full retirement age, your SSDI does not stop; it converts to retirement benefits automatically. No new application, same monthly amount, no more medical reviews.11Social Security Administration. If I Get Social Security Disability Benefits and I Reach Full Retirement Age, Will I Then Receive Retirement Benefits A letter arriving around this milestone is usually just the reclassification notice.

The 10-Day Rule to Keep Payments Coming

This is the detail that costs people the most money when they miss it. To keep receiving benefits while your appeal is pending, you have to file both the appeal and a request for benefit continuation within 10 days of receiving the cessation notice, not the standard 60.12Social Security Administration. 20 CFR 416.996 – Continued Benefits Pending Appeal The agency will ask you to sign a statement electing continuation. File between day 11 and day 60 and your appeal still moves forward, but the checks stop while you wait.

There is a trade-off. If the appeal fails and the cessation stands, you generally have to pay back every dollar you received during the appeal unless you qualify for a waiver. For most people who genuinely believe their condition has not improved, keeping income during a months-long review is worth the risk. A new election is required at each appeal level, so if reconsideration is denied and you request an Administrative Law Judge hearing, you have to elect continuation again within 10 days of the reconsideration denial.

How to File the Appeal

You have 60 days from receiving the notice to file a Request for Reconsideration on Form SSA-561-U2.13Social Security Administration. Understanding Supplemental Security Income Appeals Process Social Security assumes you got the notice five days after it was mailed, giving you an effective 65 days from the mailing date. You can file late with a showing of good cause (serious illness, non-delivery), but it puts you at a disadvantage.14Social Security Administration. Social Security Handbook 535 – How to Submit a Late Request for Reconsideration

File Form SSA-3441, the Disability Report – Appeal, alongside your reconsideration request to update the agency on your current condition, treatments, and providers.15Social Security Administration. Disability Report – Appeal Sign Form SSA-827 to let the agency pull records directly from your doctors, hospitals, and therapists.16Social Security Administration. Information on Form SSA-827

Evidence beats paperwork. Generic statements like “I can’t work” carry almost no weight. Specifics do: what tasks you cannot perform, how long you can sit or stand, how often pain or fatigue keeps you from activities, and what side effects your medications cause. “I cannot stand for more than 10 minutes without severe lower back pain” gives the reviewer something concrete.

If reconsideration is denied, you can request a hearing before an Administrative Law Judge, a separate and more thorough proceeding.17Social Security Administration. Request Hearing With a Judge Approval rates are significantly higher at the ALJ level than at reconsideration, so a first-stage denial is not the end of the road.

Getting Benefits Back After They Ended

If your benefits already stopped because you went back to work and later you cannot work again, you may not need to start from scratch. Expedited Reinstatement lets you request that benefits restart without a new application, as long as you make the request within five years of the month your benefits ended.18Social Security Administration. Get Disability Back if Your Benefit Ended

While the agency reviews the request, you can receive provisional benefits for up to six months, including cash and Medicare or Medicaid. Those provisional payments generally do not have to be repaid even if reinstatement is denied.19Social Security Administration. Expedited Reinstatement Past five years, you have to file a new disability application.

Keeping Your Health Coverage

Losing the cash benefit does not automatically mean losing health insurance.

If SSDI ended because your earnings crossed the SGA limit (not because of medical improvement), you can keep premium-free Medicare Part A for at least 93 consecutive months — about seven years and nine months — after your Trial Work Period ends.20Social Security Administration. The Red Book – SSDI Only Employment Supports You still need the underlying disability. Part B and Part D continue if you were enrolled, with premiums. After that window, Medicare can be purchased by paying monthly premiums.

If SSI cash payments stop because of earned income, Section 1619(b) lets you keep Medicaid as long as your disability continues, you still meet the non-income SSI rules, and you need Medicaid to keep working.21Social Security Administration. SSI Spotlight on Continued Medicaid Eligibility for People Who Work Each state has an annual earnings threshold — running from about $40,000 to over $84,000 in 2026 — below which you automatically qualify.22Social Security Administration. POMS SI 02302.200 – Charted Threshold Amounts Above the state threshold, you can still qualify through an individualized calculation that factors in your actual medical expenses, impairment-related work expenses, and publicly funded attendant care.

If You Also Received an Overpayment Notice

The same events that stop benefits often produce an overpayment notice covering the months between when the change happened and when the agency caught up. For people still receiving benefits, the agency withholds a percentage of each check. For people no longer receiving benefits, it can withhold federal tax refunds, intercept certain state payments, or garnish wages.23Social Security Administration. Resolve an Overpayment

You have three responses:

  • Challenge the amount by filing a Request for Reconsideration within 60 days if you believe the overpayment was calculated wrong or did not occur.
  • Request a waiver on Form SSA-632-BK if the overpayment is correct but repaying it would cause hardship and it was not your fault. For overpayments of $2,000 or less, you can request a waiver by phone or at a local field office.24Social Security Administration. Request for Waiver of Overpayment Recovery
  • Negotiate a payment plan if you owe the money but cannot afford the default withholding rate.

Waivers require detailed household financial documentation — bank statements, recent bills, pay stubs, and a recent tax return, all dated within three months of the request. The agency will deny a waiver if you were at fault, for example by knowingly failing to report earnings or a change in living arrangements.

Getting Help With Your Appeal

You can appoint an attorney or a non-attorney representative at any stage. Most work under a fee agreement that caps payment at 25 percent of your past-due benefits or $9,200, whichever is lower.25Social Security Administration. Fee Agreements Nothing is due upfront; the fee comes from your back pay only if you win, and if the appeal fails a standard fee agreement pays nothing.

Representation matters most at the ALJ hearing, which resembles a courtroom proceeding with testimony, cross-examination of vocational experts, and legal arguments about whether the evidence supports continued disability. Reconsideration is a paper review that many people handle themselves. The practical inflection point is the step from reconsideration denial to ALJ hearing.
