SNAP-Eligible Foods: Hot Meals, Seeds, and Online Grocery Rules

What You Can Buy

Federal law defines food for SNAP purposes as any food or food product for home consumption.1Office of the Law Revision Counsel. 7 U.S.C. 2012 – Definitions That definition is deliberately broad. It covers staples like meat, poultry, fish, dairy, bread, cereals, and fruits and vegetables in any form: fresh, frozen, or canned. It also covers items that aren’t remotely healthy. Chips, cookies, candy bars, ice cream, and bakery cakes all qualify, because the program doesn’t grade groceries on nutrition. If a package carries a Nutrition Facts label and it’s meant to be eaten at home, it’s almost certainly eligible.

Non-alcoholic drinks are in as well. Soda, coffee, tea, juice, bottled water, and most energy drinks all qualify at the federal level.3Food and Nutrition Service. SNAP Eligible Food Items

A few edge cases catch shoppers by surprise. You can buy live shellfish, fish that have been removed from the water, and animals that are slaughtered before you pick them up.3Food and Nutrition Service. What You Cannot Buy

The federal statute carves three categories out of the definition of food: alcoholic beverages, tobacco, and hot foods prepared for immediate consumption.1Office of the Law Revision Counsel. 7 U.S.C. 2012 – Definitions Beyond those, anything that isn’t food is off-limits. Authorized retailers may accept SNAP only in exchange for eligible food, not cash and not other merchandise.4eCFR. 7 CFR 278.2 – Participation of Retail Food Stores

The items people most often try to ring up and can’t:

  • Household supplies like dish soap, laundry detergent, cleaning sprays, paper towels, toilet paper, and trash bags
  • Personal care products including toothpaste, shampoo, deodorant, and cosmetics
  • Beer, wine, liquor, cigarettes, and vaping products
  • Pet food of any kind
  • Vitamins and supplements — anything with a Supplement Facts label rather than a Nutrition Facts label

These restrictions apply even though every one of these items sits on shelves in the same stores where you use your EBT card. When your cart mixes eligible food with anything else, the register splits the transaction and you cover the non-food portion with another payment method.3Food and Nutrition Service. The Hot Food Rule

The restriction that trips people up most often is about temperature. Hot foods and hot food products prepared for immediate consumption are excluded from the SNAP definition of food.5eCFR. 7 CFR 271.2 – Definitions The rotisserie chicken under the heat lamp, the soup bar, the hot deli sandwich: all ineligible, even at a grocery store where everything around them qualifies.

Cold prepared foods are treated differently. A pre-made cold sandwich, a container of pasta salad from the deli case, or a package of grocery-store sushi can generally go on your EBT card as long as the store doesn’t heat it for you.3Food and Nutrition Service. The rule tracks the temperature at the register, not what you do in your own kitchen.

Nutrition Facts vs. Supplement Facts

The label on the package is what decides eligibility for a lot of borderline products. A Nutrition Facts label means the item is treated as food. A Supplement Facts label means it’s treated as a supplement, and supplements cannot be purchased with SNAP.6Food and Nutrition Service. SNAP Retailer Notice – Allowable Items

This matters most for energy drinks, protein shakes, and meal-replacement drinks. Many of them carry Supplement Facts labels, and protein powders almost always do.6Food and Nutrition Service. Check the back of the can before you head for the register.

When Hot or Restaurant Meals Are Allowed

You generally can’t use SNAP at restaurants, but federal law creates a narrow exception for people who may not be able to prepare their own meals. Under the Restaurant Meals Program, certain groups can buy prepared meals at USDA-authorized restaurants: people aged 60 and older, people receiving Supplemental Security Income or disability payments, homeless individuals, and the spouses of anyone who qualifies.1Office of the Law Revision Counsel. 7 U.S.C. 2012 – Definitions

Not every state participates, and only specifically authorized restaurants accept SNAP under the program. If you think you qualify, your state SNAP agency can point you to participating locations.

Seeds and Food-Producing Plants

Something a lot of shoppers don’t realize: SNAP covers seeds and plants that produce food for your household. Congress added this to the definition of food in 1973 to help families supplement their diet through gardening.7Food and Nutrition Service. Ornamental plants, cut flowers, and seeds for non-edible plants do not.

Buying Groceries Online

SNAP online purchasing is now available in all 50 states and the District of Columbia.8Food and Nutrition Service. Stores Accepting SNAP Online Your EBT card works on participating retailers’ websites and apps, including Amazon, Walmart, and several regional grocery chains. The same eligibility rules apply online: SNAP covers the food, nothing else.

Fees are the catch. SNAP benefits cannot pay for delivery charges, service fees, convenience fees, or tips.8Food and Nutrition Service. Stores Accepting SNAP Online You’ll need a credit or debit card on file to cover those, and most retailers handle the split automatically at checkout.

State Restrictions Starting in 2026

The biggest change to SNAP purchasing rules in years is happening at the state level. USDA has approved food restriction waivers for at least 19 states with implementation dates in 2026, and several more with later start dates.2Food and Nutrition Service. SNAP Food Restriction Waivers These waivers let states exclude specific categories of food from SNAP eligibility, something the broad federal definition previously did not allow.

The categories states are targeting most often are soft drinks, candy, energy drinks, and sweetened beverages. Some go further. Florida’s waiver also covers prepared desserts. Iowa’s restricts all taxable food items as defined by state tax code. Missouri includes prepared desserts alongside candy and certain beverages.2Food and Nutrition Service. States with approved 2026 waivers include Arkansas, Colorado, Florida, Hawaii, Idaho, Indiana, Iowa, Louisiana, Missouri, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, Virginia, and West Virginia. Kansas, Wyoming, and Nevada have approved waivers with implementation dates in 2027 or 2028.2Food and Nutrition Service. Your state SNAP office or the USDA waiver page will have the exact list and effective date for your state.

Using Your Card in Another State

Federal law requires EBT systems to be interoperable and SNAP benefits to be portable across all states.9Office of the Law Revision Counsel. 7 U.S.C. 2016 – Issuance and Use of Program Benefits Your card works at any authorized retailer in any state, not just the one that issued it. If you travel or spend time out of state, you can shop wherever you see SNAP accepted. A permanent move is different: eventually you’ll need to transfer your case to the new state.
