Short-Barreled Rifles and NFA Thresholds: Forms, Tax, and Engraving

To register a short-barreled rifle, you file an application with the ATF, pay a $200 tax, submit fingerprints and a photograph, notify your local chief law enforcement officer, and wait for an approved tax stamp before you build or take possession of the firearm. Which form you file depends on whether you are making the SBR yourself (Form 1) or buying one that already exists (Form 4). Short-barreled rifle registration is governed by the National Firearms Act, and skipping any step is a federal felony carrying up to ten years in prison.

What Counts as a Short-Barreled Rifle

Under 26 U.S.C. § 5845(a)(3), an SBR is a rifle with a barrel shorter than 16 inches.1Office of the Law Revision Counsel. 26 U.S.C. 5845 – Definitions A separate category under § 5845(a)(4) covers weapons made from a standard rifle: those trip NFA regulation if the modified weapon has a barrel under 16 inches or an overall length under 26 inches.2Office of the Law Revision Counsel. 26 U.S.C. 5845(a) – Definitions The registration process is the same for both, but you must identify the correct category on your application.

Permanently attached muzzle devices count toward barrel length. The ATF recognizes full-fusion welding, high-temperature silver soldering at 1,100°F or higher, and blind pinning with the pin welded over as permanent attachment.3Bureau of Alcohol, Tobacco, Firearms and Explosives. National Firearms Act Handbook – Chapter 2 A brake you can thread off by hand does not. Overall length is measured with any folding or collapsible stock fully extended.

Form 1 or Form 4: Pick the Right Application

Two federal forms cover almost every SBR registration.

ATF Form 1 for Making an SBR

Form 1 (ATF Form 5320.1) is the application to make an NFA firearm. Use it if you plan to shorten an existing rifle barrel, assemble an SBR from parts, or otherwise convert a receiver into a short-barreled configuration.4Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Form 1 Submission External Guidance With Q&A You must have your approved tax stamp in hand before performing any work. Cutting a barrel or completing the build before approval is a federal offense on its own, regardless of whether the application is later granted.

ATF Form 4 for Buying an SBR

Form 4 (ATF Form 5320.4) covers tax-paid transfers of NFA firearms that are already registered. If you’re buying an SBR from a dealer or another individual, this is the correct application.5Bureau of Alcohol, Tobacco, Firearms, and Explosives. ATF Form 5320.4 – Application to Transfer and Register NFA Firearm (Tax-Paid) Both the seller and the buyer complete portions of the form, and the firearm cannot legally change hands until the ATF approves the transfer.

What You Submit With the Application

Both forms ask for detailed firearm data: manufacturer, model, caliber, serial number, and exact physical dimensions. Individual applicants must also submit two sets of fingerprint cards on standard FBI FD-258 forms and a recent 2-by-2-inch passport-style photograph.4Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Form 1 Submission External Guidance With Q&A Fingerprint cards are available from local ATF offices or the ATF Distribution Center.

You must also notify the Chief Law Enforcement Officer with jurisdiction over the area where you are located. Qualifying CLEOs include a chief of police, sheriff, head of state police, or a local district attorney. The CLEO receives a copy of the completed application. They have no approval or veto authority, but you must record the name and location of the notified CLEO on your form.

The $200 Tax and Current Wait Times

Each registration requires a one-time $200 tax payment, a figure unchanged since the original 1934 legislation.6Bureau of Alcohol, Tobacco, Firearms and Explosives. National Firearms Act The tax applies per firearm, so three SBRs mean three separate $200 payments.

The ATF’s eForms portal is the standard submission method and accepts credit card or electronic check. Digital filing has dramatically shortened processing times compared to the paper era. As of early 2026, eForm 4 applications for individual registrants are seeing median approval times measured in days rather than months. Trust and corporate applications take somewhat longer. eForm 1 timelines vary more widely and are tracked separately from transfers. In every case, you cannot legally possess or begin building the firearm until the approved stamp has been issued. Taking possession before approval, even by a day, is a federal violation.

Registering to Yourself or to a Trust

You can register an SBR to yourself as an individual or to a legal entity such as a gun trust. The choice affects who can lawfully handle the firearm and what happens to it when you die.

When the registration is individual, no one else may possess the firearm unless you are physically present. A spouse or family member who accesses your SBR while you’re not standing next to it is technically in illegal possession of an unregistered NFA firearm. A gun trust solves this by designating multiple trustees, each of whom can independently possess trust firearms.7Bureau of Alcohol, Tobacco, Firearms and Explosives. Background Checks for Responsible Persons (Final Rule 41F) Every trustee or other responsible person with the power to direct the trust’s management of its firearms must submit their own fingerprints and photograph as part of any application.

Trusts also simplify inheritance. When an individual registrant dies, the firearm must go through a transfer process that can involve temporary surrender to a licensed dealer while paperwork is sorted out. A trust with named beneficiaries and successor trustees provides a clearer path.

Engraving Requirements for Form 1 Makers

If you build an SBR under a Form 1, you must permanently mark the firearm before it is complete. The frame or receiver must carry your name (or a recognized abbreviation), the city and state where you made it, and a unique serial number.8eCFR. 27 CFR 479.102 – Identification of Firearms The caliber and model, if applicable, must also appear on the barrel, frame, or receiver.9Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Handbook – Chapter 6: Making NFA Firearms by Nonlicensee

The physical specifications are strict. All markings must reach a minimum depth of .003 inches measured from the flat metal surface, and the serial number must be in a print size no smaller than 1/16 inch.8eCFR. 27 CFR 479.102 – Identification of Firearms Most people use a professional engraving service, with fees typically running between $20 and $125. The engraving must be finished before you first assemble or use the firearm in its SBR configuration.

State Law Can Still Ban It

Federal registration does not override state law. Several states prohibit short-barreled rifles entirely, and others impose restrictions beyond the federal rules. Completing the NFA process in a state that bans SBRs still leaves you holding an illegal weapon under state law. Before spending time and money on an application, confirm your state permits possession. State restrictions can change, and some states that previously banned SBRs have legalized them in recent years while others maintain firm prohibitions.

After Approval: Transport and Loss Reporting

Federal law prohibits transporting a short-barreled rifle across state lines without prior written authorization from the ATF.10Office of the Law Revision Counsel. 18 U.S.C. 922 – Unlawful Acts To get it, submit ATF Form 5320.20 in duplicate to the NFA Division before the trip.11Bureau of Alcohol, Tobacco, Firearms and Explosives. Application to Transport Interstate or to Temporarily Export Certain NFA Firearms (ATF Form 5320.20) The form can be mailed, faxed, or scanned and emailed. Approval covers only the specific time period listed. If you ship the firearm, a copy of the approved Form 5320.20 must travel with it for the entire journey. The destination state must also permit SBR possession; federal transport approval does not override a state ban.

If a registered NFA firearm is stolen or lost, the registered owner must report it to the ATF immediately upon discovery.12eCFR. 27 CFR 479.141 – Stolen or Lost Firearms The report must include your name and address, the type of firearm, serial number, model, caliber, manufacturer, the date and place of loss, and a complete account of the circumstances. There is no grace period.

Penalties for Getting It Wrong

Possessing an NFA firearm that is not registered to you in the National Firearms Registration and Transfer Record violates 26 U.S.C. § 5861(d).13Office of the Law Revision Counsel. 26 U.S.C. 5861 – Prohibited Acts A conviction carries up to ten years in prison and a fine of up to $10,000 under the NFA’s own penalty provision.14Office of the Law Revision Counsel. 26 U.S.C. 5871 – Penalties General federal sentencing law can push fines higher. A felony conviction also means losing the right to possess any firearms under federal law. The ATF does not require you to have known the firearm was an unregistered NFA item; if you possess it and it meets the measurements, you have a problem.
