Sexual abuse lawsuit loans are cash advances paid to survivors who have already filed a civil claim and need money to live on while the case moves through the courts. They are not really loans in the traditional sense: repayment comes out of your settlement if you win, and you owe nothing if you lose. That non-recourse structure is why the industry calls the product “pre-settlement funding.” It is also why the cost is so high.1Annuity.org. Pre-Settlement Funding
Who Qualifies and How Quickly You Can Get Money
Credit score, income, and employment status do not matter. The funder is underwriting your lawsuit, not you. What they look at is the strength of the claim, the likely settlement value, the defendant’s ability to pay, and your attorney’s track record.1Annuity.org. Pre-Settlement Funding For sexual abuse claims specifically, some companies require evidence of an active lawsuit and a “high likelihood of receiving compensation.”2High Rise Legal Funding. You need a lawyer. Technically you can apply without your attorney’s permission, but most reputable funders will not approve an advance until they have spoken to the attorney directly to verify the case and discuss its strength. Applying without that attorney involvement tends to push you toward unlicensed companies that charge more and may offer recourse funding, meaning you owe the money back even if you lose.3Annuity.org. Pre-Settlement Funding Without Attorney Consent
The application itself is short. You submit basic case information and your attorney’s contact details online or by phone, the funder reaches out to the attorney, and if approved, money can hit your account within 24 hours. More commonly, approval takes a few days to a week, depending on how fast your attorney responds.1Annuity.org. Pre-Settlement Funding4Tribeca Lawsuit Loans. How Much You Can Get
Approved advances typically run between 10% and 20% of the expected settlement value.1Annuity.org. Pre-Settlement Funding The money can come to you in different forms. The simplest is a direct cash deposit you can spend on rent, food, or anything else. Funding can also be routed through medical liens that pay therapy and treatment providers directly, or it can flow to your law firm as a line of credit the firm then uses to cover case expenses and advance money to you.5AMG Law. What It Actually Costs
The headline number is a monthly interest rate, usually quoted between 3% and 5%, and some lenders charge well above that.6Fund My Lawsuit Now. How Much Do Lawsuit Loans Cost On a long case, that compounds into real money. A $10,000 advance at 3% monthly simple interest grows to $17,200 over two years. At the same 3% compounded monthly, the same advance grows to $20,328, more than double the original. In the most aggressive arrangements, effective annual rates can exceed 200%.7Enjuris. Then there are the fees. Processing, application, underwriting, and origination charges are common and are often buried in the paperwork rather than quoted up front.7Enjuris. A large advance against a moderate settlement can leave very little in your pocket once everyone is paid.
Two protections cost nothing to use. Ask any funder for a “payback chart” that shows exactly what you will owe at each month of the case. And have your attorney read the contract before you sign.7Enjuris. Why Survivors Use It
The pressure during a sexual abuse case can be severe. Trauma causes anxiety and depression that often interfere with the ability to work. Therapy and mental health treatment carry out-of-pocket costs that insurance covers only partially, if at all.9Taylor & Ring. And the cases take a long time. Most civil sexual abuse claims resolve within 12 to 24 months, but cases against churches, school districts, or corporations regularly stretch two to four years.10Phillips Law Group. How Long Does a Sexual Abuse Lawsuit Take to Resolve Discovery alone can run six months to a year, and court backlogs and appeals add more.11Morelli Law Firm. How Long Does It Take to Resolve a Sexual Abuse Case Defense attorneys for well-funded institutions sometimes use delay as a deliberate tactic, hoping financial strain will push a survivor into a smaller settlement. An advance that covers your rent for a year can be what lets you hold out for a fair number.
Why It Isn’t Called a Loan, and Why That Matters to You
The legal classification sounds like a technicality, but it directly affects what you pay. Loans are capped by state usury laws. Pre-settlement funding, in most states, is not. Courts in Georgia and Texas, and the federal Eleventh Circuit in Davis v. Oasis Legal Finance, have held that because repayment depends on winning the case, these agreements are investment contracts rather than debt, so interest-rate ceilings do not apply.12Ballard Spahr. Ruth v. Cherokee Funding, LLC13FindLaw. Davis v. Oasis Legal Finance Operating Company, LLC That is the legal reason the rates can look like what they do.
The upside for you is the same contingency. If your case recovers nothing, you keep the money and owe nothing. That is the “non-recourse” promise, and it is real. Just confirm in writing that your contract is non-recourse before you sign; recourse arrangements, where you owe the balance regardless of outcome, exist mostly among unlicensed funders working around attorneys.3Annuity.org. State and Federal Rules Worth Knowing
There is no federal law regulating consumer litigation funding, and most states have not passed one.14Gain Servicing. The Primary Differences Between Traditional Loans and Non-Recourse Legal Funding A handful, including Maine, Ohio, Nebraska, Oklahoma, and Vermont, have added consumer protections, though the specifics vary.1Annuity.org. Pre-Settlement Funding
New York passed the most protective law to date. The Consumer Litigation Funding Act, signed by Governor Hochul in December 2025 and effective June 17, 2026, caps total repayments at 25% of your gross recovery, requires fixed-dollar fee schedules instead of percentage-based ones, mandates plain-language contracts, and gives consumers a 10-business-day right to cancel. Funders must register with the state and post a bond. They are prohibited from steering case strategy or settlement decisions, and referral deals with attorneys and medical providers are banned.15Tyson & Mendes. Consumer Litigation Funding Act – New York If you live in a state without comparable protections, those terms are the benchmark to compare any contract against.
At the federal level, the Tackling Predatory Litigation Funding Act was introduced in May 2025 but focuses on taxing funder profits and expanding oversight, not on capping consumer rates.16U.S. Senator Thom Tillis. Tillis Introduces Legislation to Target Predatory Litigation Funding Practices
Cheaper Options to Try First
Before signing a funding contract, check whether any of these programs can cover your immediate needs. None of them charge interest or take a cut of your settlement.
- State victim compensation boards can pay for medical bills, counseling, and lost wages. One survivor’s attorney describes the application process as “confusing and time-consuming,” with no guarantee of full coverage, so apply early.9Taylor & Ring. - The federal Crime Victims Fund, administered by the DOJ’s Office for Victims of Crime, feeds those state compensation programs and had a balance above $3.6 billion as of February 2026.17Office for Victims of Crime. Types of Funding

These programs usually have caps and processing delays, and they are oversubscribed; thousands of people are turned away from victim-services programs annually.18National Network to End Domestic Violence. Funding and Appropriations They rarely replace the broader financial gap that pre-settlement funding addresses, but they can shrink how much you need to borrow.
What Taxes Will Do to Your Final Check
How much of your settlement you keep also depends on tax treatment. Under current IRS rules, compensatory damages for personal physical injuries or physical sickness are tax-free, but damages for emotional injuries alone are taxable. The IRS looks for evidence of observable bodily harm, and in sexual abuse cases the line between physical and emotional injury can be ambiguous.19Forbes. Bill Shielding Sexual Assault Settlements From IRS Taxes Passes House
The Survivor Justice Tax Prevention Act (H.R. 2347), which would make settlement income related to sexual acts or sexual conduct tax-free except for punitive damages, passed the U.S. House but had not been enacted as of mid-2026.19Forbes. Bill Shielding Sexual Assault Settlements From IRS Taxes Passes House Ask your attorney how any settlement offer is likely to be characterized before you decide how much funding to take against it. A six-figure settlement that turns out to be partly taxable, with a funder repaid off the top and attorney fees on top of that, can leave less than the advance made it look like you were owed.

Three questions handle most of the risk. Is the contract non-recourse in writing? What is the full payback chart at 6, 12, 18, and 24 months, including all fees? And is the amount offered truly what you need, or more than that? Borrowing less is the only lever you fully control, and on a case that may run years with compounding interest, it is the one that matters most.
