Seniors and Pensioners Tax Offset: Eligibility, Amounts, and Claims

The Seniors and Pensioners Tax Offset reduces the income tax owed by older Australians and can wipe out a single person’s tax bill on income up to roughly $33,000, worth up to $2,230 a year. It’s non-refundable, meaning it can bring your tax to zero but won’t produce a cash refund beyond that. The Australian Taxation Office applies it automatically when it processes your return, as long as your details and offset code are right.

Who Qualifies

Three conditions must all be met: you’ve reached Age Pension age, you’re an Australian resident for tax purposes, and you’re eligible for a qualifying government pension or allowance.

Age Pension age is 67 for anyone born on or after 1 January 1957.1Social Security Guide. 3.4.1.10 Qualification for Age Anyone reaching pension age now needs to be 67.

The pension eligibility test is broader than it looks. You qualify if you received one of the relevant payments during the year, including the Age Pension, Carer Payment, Disability Support Pension (if you’re Age Pension age), Parenting Payment (single), age service pension, income support supplement, Veteran Payment, or partner service pension.

You also qualify if you were eligible for the Age Pension but didn’t receive it, either because you didn’t apply or because your income or assets were too high. In that case, you need to have been an Australian resident for pension purposes for at least 10 years, with 5 of those continuous, or meet a qualifying residence exemption.2Australian Taxation Office. Seniors and Pensioners Tax Offset This is the route that self-funded retirees often overlook: you don’t have to collect the Age Pension to get SAPTO, only to have been eligible for it.

Veterans with eligible war service, Commonwealth veterans, allied veterans, and allied mariners who were eligible for a Department of Veterans’ Affairs pension or allowance also qualify, whether or not they claimed it.

One disqualifier: you cannot claim SAPTO for any income year during which you were in jail for the entire year.3Australian Taxation Office. Income Tax Assessment Act 1936 – Sect 160AAAA

How Much the Offset Is Worth

The amount depends on your relationship status and your rebate income. Three tiers apply.

  • Single: maximum offset of $2,230. Phase-out starts at rebate income of $34,919 and the offset disappears at $52,759.
  • Each member of a couple: maximum offset of $1,602 per person. Phase-out starts at $30,994 and the offset cuts out at $43,810.
  • Each member of an illness-separated couple: maximum offset of $2,040 per person. Phase-out starts at $33,732 and cuts out at $50,052.

Above the shading-out threshold, the offset reduces by 12.5 cents for every dollar of extra rebate income until it reaches zero at the cut-out figure.2Australian Taxation Office. What Counts as Rebate Income

Rebate income is not the same as taxable income. It starts with taxable income and adds back several items that would otherwise reduce the figure, giving the ATO a fuller view of your finances.

The components are:

  • Taxable income (less any assessable First Home Super Saver released amount).
  • Reportable employer superannuation contributions, meaning employer contributions above the compulsory guarantee.
  • Deductible personal superannuation contributions you claimed as a tax deduction.
  • Net financial investment loss, added back if your investments produced a net loss.
  • Net rental property loss, so negative gearing losses are added back.
  • Reportable fringe benefits at their grossed-up value, with different treatment for employers exempt from Fringe Benefits Tax.

The ATO’s myTax instructions include a worksheet that walks through each row.4Australian Taxation Office. The gap opens up when you have investment losses, salary-sacrificed super, or employer fringe benefits.

Couples and Illness-Separated Partners

For couples, entitlement is worked out from combined rebate income. Under Section 160AAAA of the Income Tax Assessment Act 1936, each partner’s income figure for threshold purposes is half the sum of both partners’ rebate incomes.5AustLII. Income Tax Assessment Act 1936 – Sect 160AAAA A higher-earning partner can drag down the other’s offset, even where the lower earner’s own income would have qualified for the full amount.

Transferring Unused Offset to a Spouse

If one partner doesn’t have enough tax to use their full SAPTO, the leftover can be transferred to the other. The ATO does this automatically once both returns are lodged. Where the lower-earning spouse has taxable income of $6,000 or less, the entire offset is available for transfer. Above $6,000, the transferable amount is reduced by a formula reflecting the tax the lower earner would have paid on income over that threshold.2Australian Taxation Office. If your spouse is a foreign resident, the calculation uses their marginal tax rate against their taxable income. A foreign-resident spouse receiving an Australian Government pension is treated as a resident for this purpose.

Illness-Separated Couples

Partners who live apart indefinitely because of illness or infirmity can be classified as an illness-separated couple. The typical case is one partner moving permanently into residential aged care. The separation must produce greater living expenses than the couple would otherwise face, and the arrangement must be expected to continue indefinitely.6Social Security Guide. Determining an Illness Separated Couple

Illness-separated partners receive more generous treatment than standard couples: up to $2,040 each, with the higher thresholds shown above.

How to Claim It

SAPTO is claimed through your annual tax return. There is no separate application. In myTax (through myGov), the seniors and pensioners section appears automatically once you’ve entered government pension income or indicated that you’re 60 or older, and the ATO may pre-fill your tax offset code from records it already holds.4Australian Taxation Office. Seniors and Pensioners Tax Offset – myTax Instructions

Pick the code that matches your circumstances. Codes differ for single, partnered, illness-separated, and veteran situations. If the pre-filled code is wrong, change it manually. Veterans and war widows or widowers use a separate veteran code.

Once you lodge, the ATO calculates the exact offset and applies it to your assessment. Where you have a spouse, any transfer of unused offset is worked out automatically after both returns are in. Your notice of assessment will show the offset amount and your final tax position. Choosing the wrong code, or leaving spouse income details blank, can cause the ATO to calculate your tax without the offset, so check the notice of assessment once it arrives.
