An SBA 7(a) loan is financing of up to $5 million issued by a private lender and partially guaranteed by the U.S. Small Business Administration, and it is the federal government’s largest source of small business credit. The SBA rarely lends directly under this program. It guarantees a portion of the loan (up to 75 percent on a standard 7(a) loan and up to 50 percent on an SBA Express loan) so lenders will approve businesses that would not clear a conventional underwriting bar on their own.1U.S. Small Business Administration. 7(a) Loans2U.S. Small Business Administration. Who Qualifies
Your business has to be organized for profit, actively operating, and located in the United States.3eCFR. 13 CFR 120.100 – What Are the Basic Eligibility Requirements for All Applicants for SBA Business Loans It also has to meet the SBA’s size standard for its industry, measured either by annual revenue or by average employee count depending on your NAICS code.4eCFR. 13 CFR Part 121 – Small Business Size Regulations A construction firm and a retail store have very different thresholds, so “small” is not a single number.
You also have to satisfy the “credit elsewhere” test. Since August 2023, the lender documents why comparable financing isn’t available without a government guarantee by picking from a standard list of reasons: inadequate collateral, startup status, the need for a longer repayment term than conventional lenders offer, and similar factors. Your personal resources are no longer counted against you in that determination.5U.S. Small Business Administration. Business Loan Program Improvements You also need to have put a reasonable amount of your own equity into the business.
Businesses That Cannot Get a 7(a) Loan
Some categories of business are barred from the program no matter how strong their numbers look. The excluded list under 13 CFR 120.110 includes nonprofits (though a for-profit subsidiary of a nonprofit can qualify), lending businesses like banks and finance companies, life insurance companies, foreign-based businesses, pyramid sales operations, and any business that gets more than one-third of its gross annual revenue from legal gambling.6eCFR. 13 CFR 120.110 – What Businesses Are Ineligible for SBA Business Loans The gambling threshold catches more businesses than owners expect. A restaurant with a busy poker room or a bank of video lottery terminals can quietly cross one-third of revenue and lose eligibility entirely.
What You Can Use the Money For
The permitted uses of 7(a) proceeds are unusually broad for a government loan program. You can buy land, construct or renovate buildings, purchase equipment, stock inventory, fund working capital, or acquire an existing business. Refinancing certain existing debts is allowed in some circumstances.7eCFR. 13 CFR 120.120 – What Are Eligible Uses of Proceeds
The regulations draw firm lines the other way. You cannot use proceeds to pay past-due payroll taxes, sales taxes, or other trust fund taxes you collected on behalf of a government. You cannot use them for payments or loans to business associates, with a narrow exception for ownership changes handled under specific SBA rules. Buying property held primarily for investment or speculation is off limits, and any use that does not benefit the small business itself is prohibited.8eCFR. 13 CFR 120.130 – What Are Ineligible Uses of Loan Proceeds
Loan Size and Program Variants
The maximum 7(a) loan is $5 million. There is no set minimum. The SBA guarantees a percentage rather than the full amount, so the lender still carries real risk. A standard 7(a) loan is guaranteed up to 75 percent; on a $1 million loan, that means the SBA is on the hook for $750,000 and the lender for $250,000 if you default.2U.S. Small Business Administration. Types of 7(a) Loans
The program has several subtypes. SBA Express caps at $500,000 and moves faster: the SBA is required to respond within 36 hours of receiving the lender’s submission. The tradeoff is a lower guarantee of just 50 percent. Export Working Capital and International Trade loans serve businesses with international sales, each with its own guarantee percentage and collateral rules. Ask your lender which version fits your situation.2U.S. Small Business Administration. Types of 7(a) Loans
Interest Rates
Rates are negotiated between you and the lender, but the SBA caps how high they can go. The ceiling is a base rate plus an allowed spread that shrinks as the loan grows:9U.S. Small Business Administration. 7(a) Loan Program – Terms, Conditions, and Eligibility
- $50,000 or less: base rate plus 6.5 percentage points
- $50,001 to $250,000: base rate plus 6.0 percentage points
- $250,001 to $350,000: base rate plus 4.5 percentage points
- Over $350,000: base rate plus 3.0 percentage points
These spreads are set by regulation.10eCFR. 13 CFR 120.214 – What Conditions Apply for Variable Interest Rates Smaller loans cost more relative to their size because the underwriting work is roughly the same whatever the dollar amount.
The traditional base rates are the prime rate and the SBA’s Optional Peg Rate. As of March 2026, the SBA also added the Secured Overnight Financing Rate (SOFR), the 5-year Treasury Note rate, and the 10-year Treasury Note rate as alternative base rate options for variable-rate loans. Lenders using SOFR may reference either 30-day term SOFR or 30-day average SOFR. Whichever base rate the lender picks, the maximum interest rate charged cannot exceed the equivalent of prime plus the allowed spread for that loan size.11Federal Register. 7(a) Alternative Base Rate Options
Loans can be fixed or variable. The SBA periodically publishes the maximum allowable fixed rate in the Federal Register.12eCFR. 13 CFR 120.213 – What Fixed Interest Rates May a Lender Charge Variable rates adjust on a set schedule, usually monthly or quarterly. Over a long term, half a percentage point compounds into real money, so compare offers.
Repayment Terms and Prepayment
The SBA sets loan terms based on what the money is for. Real estate purchases get the longest term at up to 25 years, with additional time allowed if construction has to be finished. Equipment loans can also exceed 10 years when the asset has a useful life longer than that, but the loan will not outlast the equipment. Everything else, working capital included, falls under a 10-year maximum.13eCFR. 13 CFR 120.212 – What Limits Are There on Loan Maturities Within those ceilings, the SBA requires the shortest appropriate term based on your ability to repay, so you should not assume you will get the maximum.
Prepayment penalties apply only to loans with maturities of 15 years or longer, and only when you voluntarily pay down 25 percent or more of the outstanding balance in the first three years. The fee is 5 percent of the prepaid amount in year one, 3 percent in year two, and 1 percent in year three. After that there is no penalty, and loans with maturities under 15 years carry no prepayment penalty at all.9U.S. Small Business Administration. 7(a) Loan Program – Terms, Conditions, and Eligibility
Fees
The SBA charges an upfront guarantee fee on every 7(a) loan, and lenders almost always pass it through to the borrower. For fiscal year 2026 (October 2025 through September 2026), the fee schedule for loans with maturities over 12 months is:14NAGGL. FY 2026 Loan Fees and Clarification of Fee Calculation for Multiple WCP or EWCP Loans
- $150,000 or less: 2 percent of the guaranteed portion
- $150,001 to $700,000: 3 percent of the guaranteed portion
- $700,001 to $5 million: 3.5 percent on the first $1 million of the guaranteed portion, plus 3.75 percent on any guaranteed amount above $1 million
Short-term loans with maturities of 12 months or less pay a much smaller fee of 0.25 percent. Manufacturers classified under NAICS sectors 31 through 33 pay zero upfront guarantee fee on loans of $950,000 or less.14NAGGL. FY 2026 Loan Fees and Clarification of Fee Calculation for Multiple WCP or EWCP Loans
Lenders separately pay an ongoing annual service fee of 0.55 percent on the outstanding guaranteed balance, and that fee cannot be charged to the borrower.15U.S. Small Business Administration. Lenders Annual Service Fee Lenders may also charge reasonable packaging, closing, and servicing fees under 13 CFR 120.221.9U.S. Small Business Administration. 7(a) Loan Program – Terms, Conditions, and Eligibility Ask for a full fee breakdown before signing, because these ancillary charges vary lender to lender.
Collateral and the Personal Guarantee
The SBA does not require collateral on loans of $50,000 or less. Between $50,001 and $500,000, the lender follows whatever collateral policy it uses for non-SBA commercial loans of that size. For standard 7(a) loans above $500,000, the SBA considers the loan fully secured when the lender takes a security interest in all assets being acquired or improved with the proceeds, plus any available fixed assets up to the loan amount in adjusted net book value. Insufficient collateral by itself is not grounds for denial; if the business and its owners are creditworthy, the lender is expected to approve the loan even when the assets do not fully cover it.2U.S. Small Business Administration. Types of 7(a) Loans
Personal guarantees are the piece that catches borrowers off guard. Every individual who owns 20 percent or more of the applicant business has to sign an unlimited personal guarantee.16U.S. Small Business Administration. Unconditional Guarantee Unlimited means what it sounds like. If the business fails and the collateral does not cover the debt, the guarantor’s personal assets, including savings and real estate, are on the hook for the full remaining balance. Spouses who own 20 percent or more are not exempt. The SBA guarantee protects the lender, not you.
Applying: Documents and Process
A 7(a) application is a substantial package. The core SBA forms are Form 1919, the Borrower Information Form covering the business, its owners, the loan request, and any prior government financing,17U.S. Small Business Administration. Borrower Information Form and Form 413, the Personal Financial Statement detailing each owner’s assets, liabilities, and net worth.18U.S. Small Business Administration. SBA Form 413 – Personal Financial Statement
Beyond the forms, expect to hand over recent profit-and-loss statements and balance sheets dated within 120 days, federal income tax returns for the business and its principals for the previous three years, and your business license or certificate of doing business. A written narrative on company history, current operations, and the purpose of the loan helps the lender put the numbers in context. Contents vary by loan size and by the lender’s processing method, so confirm the checklist early.
The SBA’s Lender Match tool connects applicants with participating institutions, or you can approach any SBA-preferred lender directly. The lender reviews your file, makes its own credit decision, and then submits the application to the SBA to secure the guarantee. Standard 7(a) applications can take several weeks; SBA Express carries the 36-hour SBA response window mentioned earlier. Once the lender issues a conditional approval, the loan closes when you sign the note and security agreements, the SBA assigns a loan number, and the funds are disbursed.
If You Default
Default triggers a collection chain that starts with the lender and can end at the U.S. Treasury. The lender first pursues the business assets pledged as collateral. If those come up short, it turns to the personal guarantors and their savings, real estate, and other property. Once the lender has exhausted its recovery, it files a claim with the SBA for the guaranteed portion.
The debt does not disappear at that point. The SBA steps into the lender’s place and continues collection on the remaining balance. Unresolved debt can be referred to the Treasury Offset Program, which intercepts federal payments owed to you, tax refunds included, to satisfy the balance.19Bureau of the Fiscal Service. Debt Management – Contact Us The SBA does allow an offer in compromise, a settlement for less than the full amount, but only after all collateral has been liquidated.20U.S. Small Business Administration. Offer in Compromise Requirement Letter A defaulted SBA debt can follow you for years and damage your ability to borrow again, which is the strongest argument for reading the unlimited personal guarantee carefully before you sign it.
