The DOT SAP evaluation process is a five-stage sequence you must complete after a federal drug or alcohol violation before you can perform safety-sensitive work again: an initial clinical evaluation by a Substance Abuse Professional, education or treatment the SAP recommends, a follow-up evaluation, a return-to-duty test, and a follow-up testing plan that runs for at least a year after you go back. Until every stage is finished and documented, you cannot work in a safety-sensitive role for any DOT-regulated employer, not just the one where the violation happened.1US Department of Transportation. 49 CFR 40.285 – When Is a SAP Evaluation Required
What Puts You Into the Process
Under 49 CFR Part 40, the SAP requirement is triggered by a verified positive drug test, an alcohol test of 0.04 or higher, refusing a test, tampering with a specimen, or any other violation of DOT drug and alcohol prohibitions.2eCFR. 49 CFR 40.285 – When Is a SAP Evaluation Required There doesn’t have to be an arrest or an on-the-job incident. A failed random test on an ordinary shift puts you in the same process as anyone else with a violation.
Finding a Qualified SAP
Your employer is required to give you a free list of qualified SAPs with names, addresses, and phone numbers.3eCFR. 49 CFR 40.287 – What Information Is an Employer Required to Provide Concerning SAP Services A SAP is a licensed clinician (physician, psychologist, social worker, employee assistance professional, marriage and family therapist, or certified drug and alcohol counselor) who has passed DOT-specific qualification training and a national exam.4eCFR. 49 CFR 40.281 – Who Is Qualified to Act as a SAP The SAP is an independent evaluator. They don’t work for your employer and they don’t work for you; their job is a clinical judgment about what you need.
The Initial Evaluation
The first appointment is a clinical assessment. The SAP reviews the documentation of your violation, goes through your drug and alcohol history, and gathers enough to make a clinical determination. The evaluation can be done in person or remotely, at the SAP’s discretion.5US Department of Transportation. 49 CFR 40.291 – What Is the Role of the SAP in the Evaluation, Referral, and Treatment Process
Every recommendation has to be individualized. The rules explicitly forbid SAPs from handing the same recommendation to most people they see.6eCFR. 49 CFR 40.293 – What Are the SAPs Function in Conducting the Initial Evaluation A first positive on a random marijuana screen is likely to draw a very different recommendation than a pattern of alcohol violations.
Education or Treatment
Every employee who goes through a SAP evaluation gets a recommendation for education, treatment, or both. There are no exceptions.6eCFR. 49 CFR 40.293 – What Are the SAPs Function in Conducting the Initial Evaluation Education can include self-help groups like AA, verifiable community lectures, or substance abuse courses. Treatment can range from outpatient counseling to partial hospitalization to inpatient programs with aftercare. The SAP doesn’t deliver the education or treatment. They refer you out and send a written recommendation directly to your employer’s designated employer representative.
The Follow-Up Evaluation and Return-to-Duty Test
Once you’ve finished the recommended education or treatment, you return to the same SAP for a follow-up evaluation. The SAP decides whether you actually complied.7US Department of Transportation. 49 CFR 40.301 – What Is the SAPs Function in the Follow-Up Evaluation If they conclude you didn’t, they notify your employer in writing and you stay out of safety-sensitive work. Your employer may allow additional follow-up evaluations if you’re making progress, or take personnel action under company policy.8eCFR. 49 CFR Part 40 Subpart O – Substance Abuse Professionals and the Return-to-Duty Process
If the SAP clears you, you take a return-to-duty test. You need a negative drug result or an alcohol test below 0.02 before you can go back.9eCFR. 49 CFR 40.305 – What Happens After the SAP Determines the Employee Has Demonstrated Successful Compliance Return-to-duty and follow-up drug collections are done under direct observation by a same-gender collector.10US Department of Transportation. 49 CFR 40.67 – When and How Is a Directly Observed Collection Conducted
Follow-Up Testing After You Return
Passing the return-to-duty test doesn’t close the file. The SAP also writes a follow-up testing plan tailored to you. At a minimum, that means six unannounced tests during your first twelve months back, and the plan can extend up to sixty months total.11eCFR. 49 CFR 40.309 – What Are the Requirements for the SAPs Directed Follow-Up Testing The frequency and duration reflect the SAP’s judgment about your risk. Refusing or failing to comply with the plan can lead to discipline up to termination.8eCFR. 49 CFR Part 40 Subpart O – Substance Abuse Professionals and the Return-to-Duty Process
Who Pays
DOT rules don’t assign the cost to either side. The agency leaves it to employer policy and any labor-management agreement.12Federal Motor Carrier Safety Administration. Who Is Responsible for Reimbursing the SAP for Services Rendered In practice, employees terminated after a violation almost always pay out of pocket. Some employers, especially those with retention-focused policies or union contracts, cover part or all of it. Check your employer’s policy and any applicable collective bargaining agreement before assuming. The evaluation, any treatment, and the follow-up evaluation together can run into real money.
What Clearance Does and Doesn’t Do
Finishing the process gives you regulatory clearance to work in a safety-sensitive role again. It does not give you your job back. The reinstatement decision belongs to the employer, and some employers have zero-tolerance policies that end in termination regardless of SAP compliance.9eCFR. 49 CFR 40.305 – What Happens After the SAP Determines the Employee Has Demonstrated Successful Compliance Even then, completing the process still matters, because it clears you to be hired by a different DOT-regulated employer.
If you hold a CDL, your violation is also recorded in the FMCSA Drug and Alcohol Clearinghouse, which employers must query before hiring and at least once a year for current drivers.13Federal Motor Carrier Safety Administration. Commercial Drivers License Drug and Alcohol Clearinghouse The record stays for five years from the violation date or until you finish the full return-to-duty and follow-up process, whichever is longer.14FMCSA Drug and Alcohol Clearinghouse. Violations and the RTD Process Any prospective employer running a query will see an unresolved violation, which effectively blocks CDL hiring anywhere in the country until you complete the SAP process.
If You Don’t Complete the Process
Ignoring the process doesn’t erase the violation. You remain in prohibited status, unable to work in a safety-sensitive role for any DOT-regulated employer, indefinitely.1US Department of Transportation. 49 CFR 40.285 – When Is a SAP Evaluation Required No employer can legally put you in one of those jobs until the entire process is complete and documented, and your current employer can take independent personnel action, including termination, once the SAP reports noncompliance.8eCFR. 49 CFR Part 40 Subpart O – Substance Abuse Professionals and the Return-to-Duty Process
