SafeStreets USA, the nationwide home security company that operates as ADT’s largest authorized dealer, has been the target of several lawsuits, most of them tied to its telemarketing practices. The two most consequential are a federal class action under the Telephone Consumer Protection Act (TCPA) over unsolicited text messages and robocalls promoting ADT security systems, and a wage-and-hour case brought by its own installation workers that ended in a $1.27 million settlement approved in late 2024.
The Davis TCPA Class Action
The highest-profile SafeStreets USA lawsuit is Davis v. Safe Streets USA LLC, filed October 15, 2019, in the U.S. District Court for the Eastern District of North Carolina (No. 5:19-cv-00455-D). Lauren Davis alleged that on April 15, 2019, she received an unsolicited text congratulating her on a home sale and offering her $200 to complete an ADT referral form. The message linked to a website but gave no way to opt out.1Findlaw. Davis v. Safe Streets USA LLC, ADT LLC
Davis claimed the defendants ran a systematic operation targeting realtors to obtain new homebuyers’ contact information, then blasted automated marketing texts through a vanity short code operated by CallFire Inc., a third-party text marketing platform.2ClassAction.org. Davis v. Safe Streets USA Complaint The suit invoked 47 U.S.C. § 227(b)(1)(A)(iii) and 47 C.F.R. § 64.1200(a)(2), which prohibit sending automated calls or texts to cell phones without prior express written consent, and sought $500 per negligent violation and up to $1,500 per willful violation.1Findlaw. ADT LLC was added as a defendant in an amended complaint. In September 2020, Judge James C. Dever III denied both Safe Streets’ and ADT’s motions to dismiss, finding the allegations that an automatic telephone dialing system was used were plausible enough to proceed.1Findlaw. Davis v. The case never produced a class-wide judgment. Davis reached an individual settlement with ADT in February 2021, and the parties filed a joint stipulation of dismissal on April 9, 2021.3ClassAction.org. The 2021 Safe Streets TCPA Settlement
A broader class settlement did emerge later that same year, covering telemarketing calls promoting ADT services made between May 10, 2015, and August 18, 2021. The class notice named Safe Streets USA LLC, Acquity LLC, PerfectVision Manufacturing Inc., Tektiks Innovative Network USA Inc., Simple Home 360 Inc., MWT & S Biz LLC, and their subcontractors as covered parties. Anyone searching Safe Streets litigation will also find Fitzhenry v. ADT LLC et al., filed May 10, 2019, in the Southern District of Florida (No. 9:19-cv-80626). The South Carolina plaintiff alleged that ADT and Safe Streets USA placed pre-recorded promotional calls to his cell phone offering a free security system in exchange for displaying an ADT sign in his yard, without his written consent.5ClassAction.org. The $1.27 Million Wage-and-Hour Settlement
Not every SafeStreets lawsuit involves consumers. In Mark Anderson v. Safe Streets USA LLC (No. 2:18-cv-00323, E.D. Cal.), workers alleged the company failed to pay overtime and reimburse job expenses. An initial settlement of nearly $1.5 million was rejected by the court, which found it lacked jurisdiction because the collective claims under the Fair Labor Standards Act and the state-law class claims were moot, and flagged that the attorneys’ fee request partially duplicated an arbitrator’s earlier award to a worker.7Bloomberg Law. The parties came back with a revised $1.27 million deal that redirected 75 percent of the civil penalties under California’s Private Attorneys General Act to a state agency. Why Safe Streets Keeps Getting Sued
The recurring TCPA claims trace back to how the company is structured. Safe Streets USA describes itself as ADT’s only authorized provider and its most recognized dealer, and ADT in turn describes Safe Streets as one of its “oldest, largest and most respected Authorized Dealers.”9ADT. ADT Dealer Program SafeStreets Safe Streets also runs its own dealer and partner programs, providing backend operations, administrative support, and installation services to smaller independent security companies inside its network.10SafeStreets. SafeStreets Dealer Program
That layered arrangement, in which ADT relies on Safe Streets and Safe Streets relies on sub-dealers, is exactly the setup that produces the disputes about who is legally responsible when telemarketing calls go out without consent. The Davis complaint’s theory of vicarious liability rested on that chain.
Consumer Complaints Outside Court
Beyond the formal lawsuits, consumer reviews collected by ConsumerAffairs describe recurring problems: misrepresented contract terms, high-pressure sales, trouble canceling within the required cooling-off period, and steep early-termination fees on 36- to 60-month contracts. Some reviewers said they were billed for equipment or installations they had not authorized, and that disputed accounts were sent to collections. Several reported filing complaints with state attorneys general and the Better Business Bureau.11ConsumerAffairs.
