Federal restaurant relief programs from the pandemic era have largely closed to new applicants, so restaurants seeking capital in 2026 rely on standard SBA lending, while owners who received Restaurant Revitalization Fund grants, Employee Retention Credit refunds, or COVID-19 EIDL loans still carry active reporting, repayment, and audit obligations. The Restaurant Revitalization Fund is not accepting applications and is not funded for 2026.1SAM.gov. Assistance Listings Restaurant Revitalization Fund The ERC filing window has effectively shut. What remains is a mix of ongoing SBA loan programs for new financing and a long tail of compliance work for the money already spent.
SBA Financing Available in 2026
With the pandemic-specific grants gone, the government-backed options for a restaurant needing capital are the SBA’s regular loan programs. These require repayment, but they carry terms most independent restaurants cannot get from a conventional bank on their own.
7(a) and 504 Loans
The 7(a) program provides up to $5 million for working capital, equipment, real estate, and debt refinancing.2U.S. Small Business Administration. 7(a) Loans In May 2026, the SBA doubled the cumulative borrowing limit across the 7(a) and 504 programs to $10 million, so a qualifying restaurant can now stack both programs for a larger project.3U.S. Small Business Administration. SBA Doubles Cumulative 7(a) and 504 Loan Limit to $10 Million
To qualify for a 7(a) loan, your restaurant must operate for profit in the United States, meet SBA size standards, show the ability to repay, and demonstrate that comparable credit is not available from non-government sources.2U.S. Small Business Administration. 7(a) Loans Applications go through a participating lender rather than the SBA directly. The SBA’s Lender Match tool can point you to banks that handle these loans.
Disaster Loans
A restaurant located in a federally declared disaster area can apply for an SBA disaster loan to cover physical damage or operating expenses the business would have met absent the disaster.4U.S. Small Business Administration. Disaster Assistance These loans fill gaps not covered by insurance or FEMA, are open to businesses of all sizes, and can run up to 30 years depending on need. For restaurants in hurricane, flood, or wildfire zones, this option reactivates with each qualifying declaration.
If You Received an RRF Grant
Receiving a grant did not end your obligations. The SBA requires every RRF awardee to file a post-award report confirming that funds were spent on authorized expenses.5U.S. Small Business Administration. Restaurant Revitalization Fund Program Post Award Report Recipients who did not fully spend their awards before the March 11, 2023 deadline had to submit annual reports until the money was accounted for. Reporting completion does not close the door on audits.
The Department of Justice has pursued enforcement against businesses that misrepresented eligibility. In one case, a restaurant chain paid $7.8 million to settle claims that it falsely certified its size to qualify. The American Rescue Plan barred any restaurant that owned or operated more than 20 locations as of March 13, 2020.6United States Department of Justice. Hold on to every receipt, bank statement, and payroll record tied to your grant spending. The government’s ability to review these transactions does not expire quickly.
If You Claimed the Employee Retention Credit
The Employee Retention Credit gave qualifying employers a refundable payroll tax credit for wages paid during government-ordered shutdowns or significant revenue declines. The 2021 version equaled 70 percent of qualified wages, up to $10,000 per employee per calendar quarter, and applied only to wages paid before October 1, 2021 for most employers or January 1, 2022 for recovery startup businesses.7Office of the Law Revision Counsel. 26 USC 3134 – Employee Retention Credit for Employers Subject to Closure Due to COVID-19 Because the credit ran through employment taxes, claiming it meant amending quarterly returns on IRS Form 941-X.8Internal Revenue Service. The Filing Window Is Closed
You can no longer submit a new ERC claim. The deadline for correcting 2020 quarters expired on April 15, 2024, and the deadline for 2021 quarters expired on April 15, 2025.9Internal Revenue Service. If You Received a Disallowance Notice
Processing of pending claims remains slow, and the IRS has issued disallowances in large batches. Roughly 28,000 ERC disallowance notices went out in the summer of 2024, and in 2025 the agency sent around 720,000 disallowance notices across all programs.10Taxpayer Advocate Service. If your restaurant receives a disallowance notice (Letter 105C or 106C), you have two years from the date on that notice to reach an agreement with the IRS, file a refund suit, or execute a formal extension of time.10Taxpayer Advocate Service. If You Doubt Your Eligibility
Restaurants that were pushed into ERC claims by third-party promoters and now question whether they qualified still have limited options. The IRS allows a taxpayer to withdraw a claim that has not yet been processed.11Internal Revenue Service. Employee Retention Credit – Voluntary Disclosure Program If the credit was already paid, the second ERC Voluntary Disclosure Program allowed repayment of 85 percent of the amount received with no penalties, no interest, and no requirement to amend income tax returns, but that program closed on November 22, 2024 for 2021 tax periods.
Businesses that miss those routes and later get caught face repayment of the full credit with interest and penalties, and willful fraud can trigger a criminal investigation.11Internal Revenue Service. Employee Retention Credit – Voluntary Disclosure Program If you received an ERC payment you were not entitled to, talk to a tax professional about remaining options before the IRS contacts you.
The Wage Deduction Adjustment
Claiming the ERC creates a tax consequence that catches some owners off guard. Federal law requires you to reduce your income tax deduction for wages by the amount of the credit you received. A $50,000 ERC means $50,000 less in deductible wages on your business income tax return. Restaurants that claimed the credit but never reduced their wage deduction may need to amend the corresponding income tax return to avoid penalties for overstating deductions.
If You Have an EIDL Loan
The COVID-19 Economic Injury Disaster Loan is a loan, not a grant. The initial deferment ran 30 months from disbursement, so most borrowers have been paying for well over a year by 2026, and because interest accrued through the deferment, the balance is larger than the original disbursement.12U.S. Small Business Administration. Manage Your EIDL
If payments are becoming difficult, the SBA offers a Hardship Accommodation Plan that can cut your monthly payment in half for six months. Your loan has to be less than 90 days past due, and you need to describe the temporary financial difficulty behind the shortfall.12U.S. Small Business Administration. Manage Your EIDL Interest keeps accruing during the reduced-payment period, and the option is available only once every five years. Falling 120 days behind with no arrangement can send your account to the Treasury Offset Program for collection.
Penalties for Misrepresenting a Relief Claim
Enforcement on pandemic relief runs well past a request to give the money back. Filing a false claim against the United States carries a criminal penalty of up to five years in prison.13Office of the Law Revision Counsel. 18 USC 287 – False, Fictitious, or Fraudulent Claims Making false statements to a federal agency is a separate offense with the same five-year maximum.14Office of the Law Revision Counsel. 18 USC 1001 – Statements or Entries Generally
