Reserve Component incapacitation pay is a statutory entitlement under 37 U.S.C. § 204 that replaces income for Reserve and National Guard members who are hurt, become ill, or aggravate a condition during qualifying military duty. It comes in two forms: full active-duty pay and allowances if you cannot perform your military duties, or a partial payment equal to your lost civilian earnings if you can still serve but cannot work your civilian job. Payments are capped at six months absent an extension, and the combined total cannot exceed what an active-duty member of the same grade and time in service would earn.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement
The Two Tiers and How Much Each Pays
The Army labels the two entitlements Tier 1 and Tier 2, and the practical question is which fits your situation.
Tier 1: You Cannot Perform Military Duties
Under 37 U.S.C. § 204(g), a member who is physically disabled and cannot perform assigned military duties receives the full pay and allowances of a regular active-duty member at the same grade and time in service.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement Any nonmilitary earned income you receive during the same period is subtracted dollar for dollar. Wages, salaries, tips, professional fees, income protection plan payouts, and any vacation or sick leave you elect to use all count as earned income. Passive income does not: rents, royalties, retirement pay, dividends, interest, welfare payments, and nontaxable government benefits are excluded from the offset.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers
Tier 2: You Can Serve but Lost Civilian Income
Under 37 U.S.C. § 204(h), a member who can still perform military duties but has lost civilian or self-employment income because of the injury receives a portion of active-duty pay and allowances.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement The classic scenario is a drill-weekend injury that lets you sit at a desk during a training assembly but keeps you off your civilian construction site. Tier 2 pays the lesser of your demonstrated lost civilian income or the full active-duty pay and allowances for your grade.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers If you lost $2,000 a month in civilian wages and the active-duty equivalent is $3,500, you receive $2,000.
The Overall Ceiling
Combined incapacitation pay under subsections (g) and (h), along with any compensation under 37 U.S.C. § 206(a), cannot exceed the total pay and allowances of an active-duty member at your grade and length of service.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement
When the Injury Qualifies
Not every injury in uniform triggers eligibility. The injury, illness, disease, or aggravation must have happened in one of these duty statuses:1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement
- Active duty performed in a line-of-duty status.
- Inactive-duty training performed in a line-of-duty status. Correspondence courses and inactive attendance at sponsored educational institutions do not count.
- Travel directly to or from active duty or inactive-duty training.
- An overnight stay at or near the training site, before training begins or between successive training periods.
- Funeral honors duty, including travel to and from the ceremony and overnight stays outside reasonable commuting distance.
Every scenario requires a formal line-of-duty determination, typically documented on DD Form 261, confirming the connection between duty and injury.3Executive Services Directorate. DD Form 261 – Report of Investigation Line of Duty and Misconduct Status Injuries caused by your own gross negligence or misconduct disqualify you from both tiers, and you must remain a member of the Reserve Component throughout the period you receive payments.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement
How Long Payments Last
Incapacitation pay under either tier is capped at six months, measured from the first qualifying period of incapacitation rather than the injury date.1Office of the Law Revision Counsel. 37 U.S.C. 204 – Entitlement Partial recovery followed by a relapse does not reset the clock; the months accumulate.
The Secretary of the relevant military department can extend payments beyond six months when fairness and equity demand it, but extensions are not automatic and require a separate determination with additional documentation showing that your condition continues to prevent military duty or civilian employment.4Office of the Law Revision Counsel. 37 U.S. Code 204 – Entitlement
Filing a Claim
Every incapacitation pay claim is retroactive. You file after a period of incapacitation, not in advance, and each month is reviewed separately.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
Three Deadlines to Track
- You have 180 days from the date of injury, illness, or diagnosis to report the incident through your chain of command.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
- Claims covering dates more than 12 months before the application require written justification for the delay.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
- Under 31 U.S.C. § 3702(b), the absolute deadline for filing a claim for unpaid military pay is six years.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
The 180-day reporting window is the deadline people miss most often. A drill-weekend injury can feel minor at the time and worsen months later; report it early even if you’re not sure you’ll file a claim.
What Goes in the Package
The application form for Army Reserve and National Guard soldiers is DA Form 7574, Request and Certification for Incapacitation Pay; other branches use service-specific equivalents.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers Along with the approved LOD investigation, the package needs:
- A statement from a military physician describing the injury and specifically addressing whether you can perform military duties, your civilian job, or both. Civilian and VA physicians’ statements must be evaluated by a military profiling officer before they carry weight.6U.S. Army Reserve. Processing Incapacitation Claims – USARC Regulation 140-3
- For Tier 2, employer affidavits showing average weekly earnings and hours missed, W-2 forms or your 1040 filing, your military LES and civilian earning statements, and a civilian job description so the reviewing board can assess whether the injury actually prevents that work.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
- For self-employed members, certification of business structure (sole proprietorship, partnership, LLC, S corporation, or independent contractor) with supporting federal tax forms including IRS Form 1040, Schedule C, and Form 1065 if applicable. Any claims filed with or benefits received from an income protection plan must be disclosed.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures
Review and Monthly Recertification
The unit initiates the claim through the electronic Military Medical Processing System (eMMPS). An Incapacitation Review Board examines the medical and financial evidence and recommends action to the approval authority, which sits at the state headquarters for the Guard or at USARC or AHRC for the Army Reserve. Once approved, finance must process the entitlement within five days.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers
Payments do not roll forward automatically. The IRB reviews each case monthly, and you must submit a new DA Form 7574 for every claim period documenting continued inability to perform military duties or ongoing lost civilian income. A missed monthly submission stops payment until the paperwork arrives.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers
If Your Claim Is Denied
The Army’s regulation gives you two shots. First, request reconsideration from the same approval authority within 30 days of receiving the denial, submitting a written request with any new supporting evidence. If that fails, you have another 30 days to file a formal appeal to the Deputy Chief of Staff, G-1, which is the final decision-maker. Legal assistance offices, the IRB authority office, and the approval authority office can help you prepare the appeal.2Department of the Army. AR 135-381 Incapacitation of Reserve Component Soldiers
Side Effects on Status and Benefits
Retirement Points
Members receiving Tier 1 pay cannot attend inactive-duty training or earn retirement points for IDT periods during that time.7Air Force Wounded Warrior Program. Reserve Incapacitation Pay Entitlements General Information If you’re close to a reserve retirement milestone, this can matter to your timeline.
SGLI
Servicemembers’ Group Life Insurance premiums normally come out of service pay. Coverage should continue while you’re on incapacitation pay, but when a member is not receiving regular pay the uniformed service is responsible for keeping coverage in force and may seek reimbursement from the member for the premium.8Department of Veterans Affairs. Servicemembers’ and Veterans’ Group Life Insurance Handbook Confirm with your unit finance office that premiums are being handled and that coverage has not lapsed.
Taxes
Incapacitation pay is structured as military pay and allowances rather than VA disability compensation. The Army’s processing procedures require members to document “nonmilitary earned taxable income” for offset calculations, and the payment flows through military pay systems.5Department of the Army. DA PAM 135-381 Incapacitation of Reserve Component Soldiers Processing Procedures Because it replaces military pay rather than compensating for a disability rating, incapacitation pay is generally treated as taxable income. Talk to a tax professional familiar with military pay if your situation involves concurrent VA benefits or combat zone exclusions.
