Regional Finance Lawsuits: Answering, Defenses, and Arbitration

A Regional Finance lawsuit is almost always a debt-collection case: the company sues a borrower who has stopped paying on a personal loan or auto-secured loan, and asks the court for a judgment for the balance. If you’ve been served, the single thing that matters most is filing a written answer with the court before your deadline runs out. Miss it and Regional Finance wins by default, which is how most of these cases end.1Weston Legal. Regional Finance Company of Texas Lawsuit

Regional Finance is the consumer-lending brand of Regional Management Corp., a publicly traded company headquartered in Greer, South Carolina, with 353 branches across 19 states as of its 2025 annual report. Texas, North Carolina, and South Carolina are its largest markets. It makes personal loans from $600 to $45,000 and auto-secured loans that take a first lien on the borrower’s vehicle, marketed largely to people with limited or damaged credit.2TradingView. What Regional Finance Sues For

These are breach-of-contract cases filed in local courts. The amounts track the company’s loan sizes: small personal loans up to $2,500, larger secured loans between $2,500 and $12,000, and auto loans up to $27,000.1Weston Legal. Regional Finance Company of Texas Lawsuit

Regional Finance’s collection approach has been described as aggressive, and it relies heavily on default judgments. A default judgment issues when a borrower who has been served fails to respond in time, and it gives the lender broad collection powers: wage garnishment, freezing and draining bank accounts, liens on property, and in some cases sale of personal property at auction.1Weston Legal. How To Respond After You’re Served

File an answer with the court before your deadline. Deadlines are set by state and by the type of court. In Texas Justice Court, for example, you have 14 days after service, and filing the answer is free.5Texas Law Help. How To Answer a Debt Collection Case in Justice Court

Answering matters even if you think you owe the money. A general denial, which neither admits nor denies the allegations, is a valid response and shifts the burden back to Regional Finance to prove its case: that it owns the debt and that the amount it’s claiming is accurate.5Texas Law Help. Defenses Worth Raising in Your Answer

  • Statute of limitations. Every state sets a deadline for creditors to sue on an unpaid debt, generally three to six years depending on the state and type of debt. If the deadline has passed, raise it as an affirmative defense; the case may be dismissed. The clock usually starts when a required payment is missed, but a partial payment or a written acknowledgment can restart it in some states, so be careful about what you say to the company.6Consumer Financial Protection Bureau. • Demand documentation. Require Regional Finance to produce the signed loan agreement and a full payment history from the first payment forward. Records gaps are common, and the company has to prove the number it’s suing for.4SoloSuit. Beat Regional Finance Court
  • Exempt income and assets. If your only income comes from Social Security, disability, veterans benefits, or similar protected sources, you may be effectively judgment-proof, meaning a court cannot order collection even if the lender wins. • Improper venue. If the case was filed in the wrong court, ask for a transfer.5Texas Law Help. How To Answer a Debt Collection Case in Justice Court

Settling or Asking for Hardship Help

Regional Finance accepts negotiated settlements. Its borrower assistance page states that customers who cannot repay the full balance can negotiate a reduced payoff, after which the debt is considered resolved. The company warns of possible tax and credit consequences from a settled-for-less balance.7Regional Finance. Borrower Assistance Programs

If you haven’t been sued yet but are falling behind, the company also offers hardship options. A temporary loan modification lets you pay half your regular payment for three months at a reduced 8% interest rate; a permanent modification extends that arrangement for the rest of the term. A deferral postpones a payment and extends the loan by the same period. A renewal restructures the balance under new terms to lower the monthly payment.7Regional Finance. When You Have a Claim Against Regional Finance

Borrowers have brought their own claims against Regional Finance, most visibly around the company’s practice of mailing unsolicited “live checks”: real, cashable checks that create a binding loan when deposited.

In Regional Finance Company of Georgia, LLC v. Pearson, Nicholas Pearson sued after the company mailed him an unsolicited live check that was deposited without his knowledge. He brought claims for negligence and violations of the Georgia Fair Business Practices Act, and the case reached the Georgia Court of Appeals, which issued a decision on October 30, 2024.8Leagle. Regional Finance Company of Georgia LLC v Pearson, 908 S.E.2d 643 Consumer advocates have described the same pattern in other situations: a check gets mailed, someone other than the addressee cashes it, and the company or a later debt buyer tries to collect from the person whose name was on the envelope.

If a collector is trying to make you pay on a debt like that, the Fair Debt Collection Practices Act gives you the right to dispute the debt in writing within 30 days of the first collection contact, which forces the collector to verify the debt before continuing. The burden of proving the debt is valid and the amount correct rests on the party trying to collect, not on you.4SoloSuit. Beat Regional Finance Court

Consumers have also alleged other violations against Regional Finance: unwanted robocalls under the Telephone Consumer Protection Act, unauthorized electronic debits under the Electronic Fund Transfer Act, inaccurate credit-bureau reporting under the Fair Credit Reporting Act, and FDCPA violations including calls at prohibited hours, calls to the borrower’s workplace, and attempts to collect debts the borrower did not actually owe.4SoloSuit. Arbitration Can Block a Court Case

Before you plan a lawsuit against Regional Finance, check your loan paperwork. The company’s terms of use state that borrowers “may be required to sign an Arbitration Agreement and/or Alternative Dispute Resolution and Limitation of Damages and Remedies Agreement upon final loan closure.”9Regional Finance. Terms of Use Arbitration clauses generally keep borrowers out of court and out of class actions, sending disputes to a private arbitrator instead. That limits discovery and appeal rights, and it changes what a consumer claim against the company realistically looks like. An arbitration clause in your file doesn’t stop you from defending a lawsuit Regional Finance files against you; it affects the claims you want to bring on your own.
