Prudential GM Pension: Guarantees, Risks, and Survivor Rules

If you receive a GM salaried pension that is now paid by Prudential, your monthly check comes from the same group annuity contract GM purchased in 2012 to cover about 110,000 U.S. salaried retirees, and the dollar amount did not change at the handoff. What did change is the legal nature of the benefit: the Prudential GM pension is now an insurance annuity governed by state insurance law, not a pension protected by the federal Pension Benefit Guaranty Corporation. That shift affects your safety net, how you resolve disputes, and a few practical items most retirees never think about until they need to.

Who the Transfer Covered

Prudential began administering payments on January 1, 2013, for U.S. salaried retirees and their beneficiaries who were already receiving pension payments before the cutoff. Roughly 110,000 people fell inside that group.1General Motors. GM Announces US Salaried Pension Plan Actions

Hourly retirees were not included. GM’s own announcement said plainly that “there is no impact on hourly retirees.” If you retired under a union-negotiated hourly pension, your benefit stayed with GM’s pension plan and never moved to Prudential.1General Motors. What Stayed the Same, What Is Now Locked

GM stated that “the value of the pension benefit that a retiree receives today under the GM pension plan will be the same from Prudential for the benefits covered by the annuity contract. There will also be no change in timing.”2General Motors. GENERAL MOTORS Facts About GM’s Salaried Pension Program and Commitment to Retirees Survivor options built into the original pension carried over into the annuity contract.

Here is the piece retirees sometimes miss. The GM salaried pension did not include automatic cost-of-living adjustments, though GM had occasionally granted discretionary increases over the years. Once the annuity contract was issued, those discretionary bumps were off the table. Prudential pays the amount set at the time of transfer for life, and that amount does not move with inflation.

Your Safety Net Changed

While the benefit was a GM pension, it was backstopped by the PBGC. For plans terminating in 2026, the PBGC’s maximum monthly guarantee is $7,789.77 for a single-life annuity starting at age 65.3PBGC. The PBGC’s position is that its guarantees end once an employer distributes annuity contracts to retirees.4PBGC. Pension Insurance Coverage

The replacement is the state life and health insurance guaranty association system. Every state, D.C., and Puerto Rico operates a nonprofit guaranty association that steps in if a licensed insurer is liquidated by a court. These associations are funded by assessments on other insurance companies in the state, not by tax dollars.5NOLHGA. The Life and Health Insurance Guaranty Association System

Two features of this system matter for your planning. First, coverage is measured as the present value of the annuity contract, not the monthly payment. Second, the ceiling varies by state. As of late 2024, limits ran from $100,000 to $500,000 in present value. Many states cap coverage at $250,000 or $300,000; New York, Connecticut, Washington, Michigan, Ohio, Pennsylvania, and about a dozen more go up to $500,000.5NOLHGA. The Life and Health Insurance Guaranty Association System

The present value of a lifetime monthly annuity can easily exceed those caps for retirees with larger benefits. If Prudential were ever liquidated, your state’s guaranty association would cover you up to its limit, and the remaining assets of the failed insurer would typically be distributed to cover the rest. Historically, when insurers have failed, that combination has been enough to make policyholders whole in most cases. The guarantee is not unlimited, though, and it depends on where you live.

How Likely Is a Prudential Failure

As of February 2026, the Prudential Insurance Company of America holds strong financial strength ratings across every major agency:

  • A.M. Best: A+ (Superior)
  • Standard & Poor’s: AA- (Very Strong)
  • Moody’s: Aa3 (Excellent)
  • Fitch: AA- (Very Strong)

Prudential’s statutory capital and surplus stood at approximately $15.8 billion as of September 30, 2025, the most recent reported figure.7Prudential Financial, Inc. Quarterly Statement Summary of The Prudential Insurance Company of America That surplus exists to absorb losses and keep the company able to meet its obligations, and state insurance departments monitor reserves, investments, and capital adequacy on an ongoing basis. No insurer is risk-free, but Prudential is among the largest and most highly rated life insurers in the country.

If You Move to Another State

Guaranty association coverage follows your state of residence, not where the annuity was issued or where Prudential is based. When an insurer is liquidated, each state’s association covers policyholders living in that state at the time of liquidation.5NOLHGA. The Life and Health Insurance Guaranty Association System

Relocating can change the ceiling protecting your benefit. Moving from a $500,000 state to a $250,000 state cuts your backstop in half. If your benefit is large enough that this matters, call the guaranty association in your current and prospective states and ask about their specific annuity limit before you commit.

Survivor Claims

Joint-and-survivor options and other death benefits built into the original GM pension carried over into the Prudential annuity. When an annuitant dies, the named beneficiary files a claim with Prudential to begin or continue survivor payments.

Prudential uses a Group Claim Form for Survivor Benefits. A surviving spouse submits it with a birth certificate. If minor children are the beneficiaries and there is no surviving spouse, a court-appointed guardian must submit the guardianship order. The claim goes to Prudential’s Group Life Claim Division, and the dedicated line for survivor claims is 800-524-0542.

Taxes on survivor payments work the same way they did for the retiree. The IRS treats the beneficiary as stepping into the annuitant’s shoes: the taxable portion stays taxable, and any tax-free portion carries over at the same fixed dollar amount. Any increase above the original amount is fully taxable.8Internal Revenue Service. Publication 575, Pension and Annuity Income

Taxes and Withholding

Prudential issues an IRS Form 1099-R each January reporting the prior year’s gross distribution and taxable amount. You carry those numbers to your Form 1040.9Internal Revenue Service. About Form 1099-R, Distributions From Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc.

To change federal withholding on your monthly payment, submit IRS Form W-4P to Prudential. The 2026 version lets you account for multiple income sources, claim dependent credits, and request extra withholding. If you never submit a W-4P, Prudential withholds as if you are single with no adjustments, which can mean over-withholding for married retirees or anyone with meaningful deductions.10Internal Revenue Service. Form W-4P – Withholding Certificate for Periodic Pension or Annuity Payments

One instruction catches people out. If you also hold a job or receive another pension, the W-4P tells you not to claim dependent credits or deductions on this form. You handle those on the Form W-4 for the job, or on the W-4P for whichever pension pays the most each year. Doubling up on credits across forms can produce a tax bill in April.10Internal Revenue Service. Form W-4P – Withholding Certificate for Periodic Pension or Annuity Payments

Keep your mailing address and direct deposit current with Prudential. A stale address is the most common reason a 1099-R shows up late, and you cannot file an accurate return without it.

If Your Payment Looks Wrong

Start with Prudential directly. The general customer service line is 1-800-778-4357 (1-800-PRU-HELP). Keep your original GM pension benefit statement so you can compare the figures.

If Prudential does not resolve the problem, your next stop is the state insurance regulator, not the federal Department of Labor. Because the benefit is now an insurance product rather than an ERISA pension, the ERISA claims-and-appeals process no longer applies. Most state insurance departments accept complaints online, by phone, or by mail, and their consumer services staff can often help informally before a formal complaint. The consumer protections available to you now come from your state’s insurance code, including the right to sue in state court. Retirees who believe their benefit was miscalculated at the time of transfer may want to consult an attorney who works in insurance or pension law, though the deadlines for challenging the original transfer have largely passed.

Divorce After the Transfer

Dividing the annuity after a divorce requires a Qualified Domestic Relations Order. A QDRO is a court order directing the annuity issuer to pay a portion of the benefit to a former spouse. Prudential’s group annuity contracts handle both “separate interest” QDROs, which give the former spouse an independent benefit, and “shared payment” QDROs, which split each payment between the parties.

If a QDRO was already on the records before the transfer date, Prudential honors it automatically. For divorces that come after the transfer, you submit the QDRO to Prudential for approval. Because the order has to satisfy both family-court requirements and the terms of the insurance contract, working with an attorney familiar with QDRO drafting is worth the cost. Language errors cause Prudential to reject orders, which can delay the split by months.
