Portugal’s property stamp duty (Imposto do Selo) is charged at a flat 0.8% of the property’s value on every real estate purchase. If you finance the purchase with a mortgage, you also owe stamp duty of up to 0.6% on the loan principal. Gifts, inheritances, and rental agreements are taxed at different rates. The tax is separate from the Municipal Property Transfer Tax (IMT) and from annual ownership taxes, but it falls due at the same time as IMT and must be paid before the deed is signed.
The Rate on Property Purchases
The standard stamp duty rate for buying property is 0.8%, set under Verba 1.1 of the Tabela Geral annexed to the Código do Imposto do Selo. It applies to any purchase or donation of real estate or partial property rights, whether the property is classified as urban or rural.1Diário da República. Código do Imposto do Selo
How the Taxable Base Is Set
The tax authority compares two figures and charges 0.8% on whichever is higher: the declared purchase price, or the property’s official tax valuation, the Valor Patrimonial Tributário (VPT). The VPT appears on the property’s Caderneta Predial, the registration document maintained by the Autoridade Tributária e Aduaneira. Article 9 of the Código do Imposto do Selo directs the authority to use the same valuation rules that apply to IMT, so the higher-of-two-values comparison is written into the law.2Diário da República. Código do Imposto do Selo – Artigo 9
A Worked Example
A buyer agrees to pay €500,000 for an apartment whose VPT is €450,000. The taxable base is €500,000 because the declared price is higher. Stamp duty: €500,000 × 0.8% = €4,000. Reverse the figures — VPT €550,000, price €500,000 — and the rate applies to €550,000, producing €4,400.
Stamp Duty on the Mortgage
If you borrow to fund the purchase, you owe a separate stamp duty on the principal. Verba 17.1 of the Tabela Geral sets rates on a sliding scale tied to loan duration:
- Less than one year: 0.04% of the loan amount per month or fraction of a month.
- One to five years: 0.50% of the total principal.
- Five years or longer: 0.60% of the total principal.3Ordem dos Advogados. Tabela Geral do Imposto do Selo
Most residential mortgages run 20 to 40 years, so 0.6% is the rate buyers meet in practice. On a €300,000 mortgage with a 30-year term, the mortgage stamp duty is €1,800. Combined with the 0.8% on a €500,000 purchase, total stamp duty on that transaction comes to €5,800.
The Exemption for Buyers Aged 35 or Under
Since August 2024, buyers aged 35 or under can qualify for a full exemption from both stamp duty and IMT when buying their first home for permanent residence. The relief was introduced by Decreto-Lei 48-A/2024 and remains in effect for 2026. To qualify, you cannot be listed as a dependent on anyone else’s household for income tax purposes in the year of purchase, and the property must be used exclusively as your own primary home.
The exemption has a price ceiling. On mainland Portugal the full exemption applies to properties valued up to roughly €316,000 to €330,000, with the exact threshold linked to the brackets in Article 17 of the IMT Code and adjusted periodically. The Azores and Madeira have a higher ceiling. If the purchase price exceeds the full-exemption limit, partial relief may still apply under the relevant IMT table. Thresholds shift with legislative updates, so confirm current figures with the Autoridade Tributária or a qualified adviser before relying on the exemption.
Other Exemptions Worth Knowing
Transfers of adjacent rural properties intended for land consolidation are exempt from both stamp duty and IMT, provided the parties apply for and receive prior recognition from the relevant authorities before the transfer. This targets agricultural efficiency rather than residential buyers, but it matters if you are acquiring rural land to merge with an existing holding.
Properties inside designated Áreas de Reabilitação Urbana (ARUs) may qualify for stamp duty relief when the buyer commits to renovating within a set timeframe. Conditions and availability vary by municipality and by the specific rehabilitation program, so verify eligibility with the local câmara municipal before counting on the savings.
Gifts and Inheritances
When property changes hands through a gift or inheritance rather than a sale, stamp duty is 10% of the property’s value, valued on the same VPT basis used for purchases.4gov.pt. Tax Liability on the Transfer of Property Through Inheritance
Close family are fully exempt. The exemption covers a surviving spouse or life partner, ascendants (parents and grandparents), and descendants (children and grandchildren). Most family inheritances therefore pass without stamp duty. Siblings, nieces, nephews, and unrelated beneficiaries face the full 10%, which can be significant on a high-value property.4gov.pt. Tax Liability on the Transfer of Property Through Inheritance
Rental Agreements
Registering a lease costs stamp duty of 10% on one month’s rent. Verba 2 of the Tabela Geral covers leases, subleases, and any contractual changes that raise the rent.5Portal das Finanças. Tabela Geral do Imposto do Selo For short-term leases of less than one month that cannot be renewed or extended, the 10% applies to the total rent for the whole lease rather than one month’s rent.
The landlord declares the lease with the Autoridade Tributária by the end of the month following the lease’s start date. A lease beginning on October 1 must be declared by November 30. The tenant has no direct liability for stamp duty on the lease itself.
How and When to Pay
Stamp duty must be paid before the public deed (Escritura) is signed. First-time buyers often get caught out here: you cannot pay at the notary’s office on the day. The tax authority generates a payment document, and you need the receipt proving payment before the notary will proceed. The same rule applies to IMT.
The Autoridade Tributária offers three channels:
- Portal das Finanças, the online tax portal, where you generate the payment document and settle electronically.
- E-balcão, the electronic service desk, where you submit a completed and signed declaration.
- Your local tax office, by prior appointment.
Every buyer needs a Portuguese Tax Identification Number (NIF). Non-residents can obtain one through a fiscal representative. The Caderneta Predial supplies the VPT for the taxable base comparison, and if you are financing, your bank’s formal loan offer confirms the credit amount and term for the mortgage stamp duty calculation. Gather these in advance. The notary appointment is usually already booked, and a missed payment deadline can force everything to be rescheduled.
Penalties for Late or Missing Payment
The Autoridade Tributária does not treat late stamp duty as a minor administrative slip. Fines for failure to pay or delayed payment range from 30% to 100% of the tax owed, with a minimum floor of €50 for cases involving negligence. Two layers of interest accrue on top: 4% a year for delays in the assessment of the tax due, and a compensatory rate of roughly 7.2% a year for delays in paying tax already assessed. Both are calculated daily, so even short delays add up quickly on a large transaction.
Landlords who miss the lease declaration deadline face the same regime. Because the tax authority cross-references lease declarations with rental income reported on annual returns, undeclared leases tend to surface eventually, often carrying accumulated interest that dwarfs the original 10% stamp duty charge.
