Premium Processing Time: Fees, Deadlines, and Upgrades

USCIS premium processing time is 15, 30, or 45 business days depending on the form and visa classification, and the agency’s commitment is to take some formal action within that window, not necessarily to approve the case. If USCIS misses the deadline, it refunds the fee and keeps working on the case at the expedited pace.

Timeframes by Form and Classification

Most premium processing requests fall inside a 15-business-day window. That covers every Form I-129 nonimmigrant worker petition, including H-1B, L-1, O-1, TN, E-1, E-2, and E-3, along with most Form I-140 employment-based immigrant petitions such as extraordinary ability, outstanding researchers, and skilled workers.¹

Two categories get a 30-business-day window. Form I-765 employment authorization is available only for F-1 students filing for pre-completion OPT, post-completion OPT, or the 24-month STEM OPT extension. Form I-539 change of status is limited to applicants moving to F-1, F-2, M-1, M-2, J-1, or J-2 nonimmigrant status.

Two Form I-140 classifications sit at 45 business days: the EB-1C multinational executive and manager category, and the EB-2 national interest waiver. Both involve heavier documentation and a longer review by the adjudicating officer.¹

These are business days. Weekends and federal holidays do not count. Fifteen business days is at least three calendar weeks, and a holiday-heavy stretch can push it further.

What USCIS Has to Do Within the Window

Premium processing guarantees action, not approval. The agency meets its obligation by issuing any of the following before the deadline: an approval notice, a denial notice, a request for evidence, a notice of intent to deny, or the opening of a fraud investigation.¹

An RFE landing on day 14 of a 15-business-day window still counts as a timely action. What premium processing prevents is a case sitting untouched for months, and that is the real value.

When the Clock Resets

The clock starts the day USCIS receives a properly completed Form I-907 with the correct fee. Online filings register immediately; paper filings register the day the package arrives at the designated service center.¹

An RFE or NOID stops the clock completely. Once you respond, the clock resets to day one and a full new processing period begins. An H-1B petition that receives an RFE on day 12 gets another full 15 business days after the response is filed. There is no cap on how many times the clock can reset, though multiple rounds are rare outside complex EB-1 or national interest waiver cases.

Premium Processing Fees as of March 2026

USCIS adjusted all premium processing fees effective March 1, 2026, to reflect inflation from June 2023 through June 2025. Any Form I-907 postmarked on or after that date must include the updated amount, or USCIS will reject the filing.²

$2,965 for Form I-129 in most classifications (H-1B, H-3, L-1A, L-1B, blanket L, O-1, O-2, P-1 through P-3, Q-1, TN, E-1, E-2, E-3) and all Form I-140 employment-based classifications.
$1,780 for Form I-129 covering H-2B temporary workers and R-1 religious workers, and for Form I-765 OPT and STEM OPT filings.
$2,075 for Form I-539 change of status to F, M, or J classifications.

These fees are on top of the underlying petition’s filing fee, and the premium processing fee cannot be waived under any circumstances.³

If USCIS Misses the Deadline

When USCIS fails to take any adjudicative action within the applicable timeframe, the agency must refund the premium processing fee. The case continues to receive expedited handling after the refund, so you get the money back and keep the faster processing.³

There is one exception. If USCIS opens an investigation for fraud or misrepresentation on the petition, the agency can keep the fee and is not bound by the processing deadline.³

Refunds sometimes issue automatically when the deadline lapses. If yours does not, submit a written request to the USCIS office handling the case. Include the Form I-907 filing date, the fee payment date, and the adjudication decision date, and mark the request “ATTN: Refund Request.”

Upgrading a Pending Petition

You do not have to request premium processing at the original filing. If a petition is already pending, you can file Form I-907 separately to upgrade it any time before a final decision. The processing clock starts fresh when USCIS receives the upgrade request with the correct fee.¹

Upgrading is most useful when standard processing times spike after you file. If a petition submitted months ago is now sitting behind a longer queue than posted times originally suggested, an upgrade puts you back on a defined timeline. The filing address for an upgrade may differ from where the original petition was sent, so check the specific form’s page on uscis.gov before mailing.⁴
