If you file personal bankruptcy, federal law requires two separate courses: an approved credit counseling briefing in the 180 days before you file, and a debtor education course after your case is filed but before the court will grant your discharge. Both apply in Chapter 7 and Chapter 13, and on a joint petition each spouse has to complete them individually. The bankruptcy credit counseling and debtor education requirements are strict, and missing either one can get your case dismissed or leave you without a discharge after doing all the work.
The Pre-Filing Credit Counseling Briefing
You have to complete the briefing with an approved nonprofit agency within 180 days before you file your petition.1Office of the Law Revision Counsel. 11 USC 109 – Who May Be a Debtor It can be done in person, by phone, or online. A counselor reviews your income, expenses, and debts, helps you sketch a basic budget, and looks at whether a repayment plan outside bankruptcy could work.
Bring your numbers. Pay stubs, bank statements, a list of monthly bills, and a summary of what you owe will make the session useful instead of generic. A typical briefing runs about an hour, though no federal minimum length applies.2U.S. Department of Justice. Frequently Asked Questions (FAQs) – Credit Counseling
At the end, the agency issues a certificate of completion. You need that certificate in hand before your petition goes to the court. Filing without one almost always results in dismissal.
When You Can Delay or Skip the Briefing
The pre-filing requirement has a few narrow exceptions. They don’t come up often, but they exist.
- Exigent circumstances. If an emergency makes it impossible to complete the briefing first, you can ask the court for a temporary waiver. You have to show you contacted an approved agency and couldn’t get an appointment within seven days, and that the emergency justifies filing first. If the court grants it, you still complete the briefing promptly after filing.3United States Bankruptcy Court for the District of Columbia. - Incapacity. If a mental illness or cognitive impairment prevents you from making rational financial decisions, the court can permanently waive the requirement after a hearing.4Legal Information Institute. 11 USC 109 – Who May Be a Debtor
- Disability. If a physical impairment makes it impossible to participate by phone, internet, or in person even with reasonable effort, the court can grant a permanent waiver.4Legal Information Institute. 11 USC 109 – Who May Be a Debtor
- Active military duty in a combat zone. Deployed service members can receive a permanent waiver.
The incapacity and disability standards are strict. Being stressed about money or dealing with a temporary illness won’t qualify. Expect to provide documentation, and for permanent waivers, expect a hearing.
The Post-Filing Debtor Education Course
After your case is filed, you complete a second course, debtor education, before the court will discharge your debts. The requirement sits in separate provisions for Chapter 7 and Chapter 13.5Office of the Law Revision Counsel. 11 USC 727 – Discharge6Office of the Law Revision Counsel. 11 USC 1328 – Discharge The content is practical: budgeting, tracking spending, building an emergency fund, reading a credit report, and understanding the real cost of high-interest debt.
The two courses are different in both purpose and timing. The pre-filing briefing is a snapshot and an alternatives check. Debtor education is forward-looking instruction for life after the case ends.
Deadlines by Chapter
In a Chapter 7 case, you must file the debtor education certificate within 60 days after the first date set for the meeting of creditors.7Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 1007 – Lists, Schedules, Statements, and Other Documents That window is tighter than most people expect, and Chapter 7 cases move quickly, so leave yourself room.
In a Chapter 13 case, where the repayment plan runs three to five years, the certificate has to be on file before the court enters your discharge at the end of the plan. Finish the course early. You don’t want the certificate to be the thing holding up your discharge after years of payments.
Approved Providers, Costs, and Fee Waivers
Both courses have to be taken through agencies approved by the U.S. Trustee Program. Fees per course typically run $10 to $50, with most providers charging near the top of that range. Online sessions are usually the cheapest option and are the most common format.

Filing the Certificates With the Court
Both certificates go into your court file. The process for the second one changed at the end of 2024, and older guidance online hasn’t caught up.
Official Form 423, which used to certify completion of the debtor education course, was discontinued effective December 1, 2024.10United States Courts. Certification About a Financial Management Course (Abrogated Effective December 1, 2024) You now file the certificate of completion issued directly by the course provider rather than a separate court form.7Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 1007 – Lists, Schedules, Statements, and Other Documents The requirement itself is unchanged; the paperwork is just simpler.
If you have a lawyer, they’ll submit certificates electronically. If you’re filing on your own, take or mail paper copies to the court clerk. Either way, do it as soon as you finish each course.
What Happens If You Miss Either Requirement
This is where avoidable damage happens.
File a petition without a valid pre-filing certificate and without qualifying for an emergency waiver, and the court will dismiss your case.3United States Bankruptcy Court for the District of Columbia. Notice to All Debtors About Prepetition Credit Counseling Requirement Dismissal lifts the automatic stay immediately, so creditors can resume collection, garnishment, and lawsuits. You’ve spent the filing fee and told your creditors what you’re doing, with no protection to show for it.
Miss the debtor education deadline and the court won’t grant your discharge.5Office of the Law Revision Counsel. 11 USC 727 – Discharge In a Chapter 7 case, the court typically closes the case without discharging anything. You went through the whole process and still owe the debts. Reopening a closed case takes a motion and an additional fee, currently $245 for Chapter 7 and $235 for Chapter 13, and approval isn’t guaranteed.11United States Courts.
