The Pivotal Home Solutions lawsuit record includes two headline cases: a federal disability discrimination suit brought by the U.S. Equal Employment Opportunity Commission that settled for $175,000 in October 2022, and a consumer class action alleging deceptive marketing of home repair plans through utility bills that settled for $12 million in December 2018. Additional employment cases have been filed against the company under both its Pivotal name and its newer Oncourse Home Solutions brand.
The EEOC Disability Discrimination Case
The EEOC sued Pivotal Home Solutions in September 2021 in the U.S. District Court for the Northern District of Illinois, alleging the company violated the Americans with Disabilities Act by firing a worker because of her mental health condition.1UniCourt. The employee worked as a dispatcher at Pivotal’s Naperville office through a staffing agency. She had been there nearly six months with no negative performance reviews and was under consideration for direct hire. In January 2018, she told her supervisor she had experienced a panic attack and was taking medication prescribed for anxiety and post-traumatic stress disorder. Instead of assessing whether her condition affected her work, the supervisor contacted the staffing agency to have her removed, reportedly citing a “nervous breakdown” and a belief that the work environment was too stressful for her. What the Settlement Required
On October 12, 2022, Pivotal agreed to pay $175,000 to the former employee under a three-year consent decree.3EEOC. Pivotal Home Solutions to Pay $175,000 to Settle EEOC Disability Discrimination Lawsuit The decree also required the company to:
- Revise its anti-discrimination policies to explicitly prohibit disability-based discrimination and confirm that protections extend to workers placed through staffing agencies.
- Provide annual ADA training to all managers and human resources employees, delivered by outside independent trainers.
- Refrain from retaliating against any employee who opposes discriminatory practices, files an ADA charge, or asserts rights under the decree.
The Plummer Class Action and $12 Million Settlement
Before the EEOC case, Pivotal Home Solutions was the target of a class action over how it sold repair plans through utility bills. Plaintiffs Kristyn Plummer, Donald Pyles, and Susan Schroeder filed the 2017 suit against Nicor Energy Services, which did business as Pivotal Home Solutions.4Evansville Courier & Press. The complaint alleged that Nicor used deceptive telephone marketing to enroll customers in what it called “essentially valueless repair plans,” relying on the billing infrastructure of Indiana utility Vectren so the charges appeared to be routine utility fees. Court documents cited in local reporting stated that 220,446 Indiana Vectren customers were enrolled between June 2011 and June 2017, generating $38.27 million in payments to Nicor, with Vectren receiving a 10 to 15 percent share of those revenues.5Evansville Courier & Press. A federal judge in Indianapolis approved a $12 million settlement in December 2018. Nicor Energy Services did not admit wrongdoing. The total included attorney fees and administrative costs. Eligible customers who had paid for the plans in Indiana from June 2011, or in Ohio from January 2012, through October 10, 2018, received settlement checks automatically from the “NES Settlement Fund” without filing a claim. Tiffany Santiago filed an employment civil rights lawsuit in the Northern District of Illinois in 2025, naming Pivotal Home Solutions and four individual defendants. The case, before Judge Sara L. Service and repair issues drive the largest category at 267 complaints, followed by 84 billing disputes and 70 product-related complaints. Common themes include coverage denials for items customers believed were included in their plans, continued billing after cancellation, and steep rate increases. Pivotal Home Solutions was an indirect, wholly owned subsidiary of American Water Works Company, Inc., operating within American Water’s Homeowner Services Group.10SEC EDGAR.
