An inaccurate job description or worksite location produces a wrong wage determination, and a wrong prevailing wage can sink the case months later when the Department of Labor reviews the file. Three More Steps for Professional Jobs
Professional positions require three additional recruitment methods chosen from a list of ten. The options are the employer’s website, a third-party job search site, job fairs, on-campus recruiting, trade or professional organizations, private employment firms, an employee referral program with incentives, campus placement offices, local or ethnic newspapers, and radio or television advertising.6eCFR. 20 CFR 656.17 – Basic Labor Certification Process Only one of the three additional steps may consist solely of activity within 30 days of filing.
Recent Layoffs Complicate the Process
If the employer laid off workers in the same or a related occupation within six months before filing, it must directly notify each affected worker about the PERM position by email or certified mail, provide the full job description, and genuinely consider applications. A generic direction to check the company careers page is not enough. Rejections must be documented with specific, job-related reasons.
Step Four: Evaluate Applicants, Then Wait

After recruitment ends, the employer must wait at least 30 days before filing. Who Pays
The employer pays for everything involved in preparing, filing, and obtaining the labor certification. Shifting any of those costs to the foreign worker is prohibited. Audits

Supervised Recruitment
In more serious cases, the certifying officer can order supervised recruitment. Debarment
The most severe consequence is debarment from the PERM program for up to three years, which can apply to the employer, the attorney, or both. If the Case Is Denied

Only the employer can file these challenges; the foreign worker has no independent standing. If the employer does nothing within 30 days, the denial is final. After Certification: The 180-Day I-140 Window
A certified Form ETA 9089 is valid for 180 calendar days. Within that window, the employer must file Form I-140 (Immigrant Petition for Alien Workers) with U.S. Citizenship and Immigration Services. If the last day falls on a weekend or federal holiday, the deadline extends to the next business day.14USCIS. The I-140 requires proof the employer can pay the offered wage on an ongoing basis from the priority date through the worker becoming a permanent resident. Federal tax returns, audited financial statements, or annual reports all qualify.15USCIS. Ability to Pay
The date the PERM application was filed with the Department of Labor becomes the worker’s priority date, which fixes their place in line for a green card. For oversubscribed employment categories, particularly for applicants born in India and China, the wait between the priority date and receiving a green card can stretch for years. Only when a worker’s date is current can they file Form I-485 to adjust status or pursue consular processing abroad.
Schedule A: When PERM Is Not Required
Not every green card sponsor has to run through this process. The Department of Labor maintains a short list called Schedule A of occupations where the shortage is considered so established that individual labor market testing is unnecessary. Group I covers physical therapists and professional nurses.
