The PERM labor certification process is the Department of Labor procedure an employer must complete before sponsoring a foreign national for most employment-based green cards. It has three phases: obtain a Prevailing Wage Determination, run a structured recruitment campaign showing no qualified U.S. worker is available, and file Form ETA-9089 through the DOL’s FLAG portal. As of April 2026, standard analyst review is averaging 501 calendar days, so timing matters as much as accuracy.1U.S. Department of Labor. Processing Times
Step One: Prevailing Wage Determination
Everything starts with a request to the DOL’s National Prevailing Wage Center. The PWD sets the minimum salary the employer must offer, based on the job duties, the geographic worksite, and the education and experience the role requires.2eCFR. 20 CFR 656.40 – Determination of Prevailing Wage for Labor Certification Purposes
The DOL assigns one of four wage levels. Level I is for entry-level work with limited independent judgment; Level IV is for the highest degree of expertise and responsibility. If the position is covered by a collective bargaining agreement negotiated at arm’s length, the CBA wage is treated as the prevailing wage.2eCFR. 20 CFR 656.40 – Determination of Prevailing Wage for Labor Certification Purposes
The PWD queue is its own delay. As of April 2026, the National Prevailing Wage Center was processing requests received in January 2026.1U.S. Department of Labor. Processing Times The wage level assigned governs every advertisement that follows, so getting it right before recruitment starts is essential.
Step Two: Fix the Job Requirements Before You Advertise
More PERM cases fail here than anywhere else. Two regulatory rules control what the employer can require: the Specific Vocational Preparation standard and the actual minimum requirements rule.
SVP and Business Necessity
Every O*NET occupation is assigned an SVP level representing how long a typical worker needs to learn the job, from 1 (a short demonstration) through 9 (over ten years).3U.S. Department of Labor. An Explanation of SVP If the employer’s requirements exceed the SVP for the occupation, the employer must prove business necessity: that the extra requirements bear a reasonable relationship to the job in the context of the employer’s specific business and are essential to perform the work in a reasonable manner.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process
Requiring a master’s degree for a software developer when O*NET supports a bachelor’s is fine only if the employer can document why the advanced degree is genuinely necessary. Requirements padded to match the sponsored worker’s resume are one of the most common denial grounds.
Actual Minimum Requirements
The DOL also tests whether the stated requirements are the employer’s true minimums. Two checks apply. The employer cannot have previously hired anyone with less education or experience for a substantially comparable position. And if the sponsored worker is already at the company, the DOL looks at what qualifications that worker had when originally hired. Domestic applicants cannot be required to bring qualifications the sponsored worker lacked on day one.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States
There is a narrow exception. If the sponsored worker gained additional experience in a role at the same employer that is not substantially comparable to the PERM position, that experience can count. “Substantially comparable” means performing the same duties more than 50 percent of the time. A worker who moved from quality assurance to software engineering at the same company can potentially use the QA experience toward the software engineering PERM requirements.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States
Step Three: Run the Recruitment Campaign
The recruitment campaign is the heart of PERM. All mandatory steps must occur at least 30 days but no more than 180 days before filing the application.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process
Steps Required for Every Position
Two recruitment steps apply to every PERM, professional or not. First, a job order with the State Workforce Agency serving the worksite area, kept active for 30 days. Second, two advertisements on different Sundays in the newspaper of general circulation best suited to reach qualified workers in the employment area; if the worksite is rural and lacks a Sunday edition, the widest-circulation edition can be used instead.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process Ads must name the employer, describe the duties, and explain how to apply. For positions requiring experience and an advanced degree, one Sunday ad may be swapped for an ad in a professional journal normally used for that occupation.
Separately, the employer posts an internal notice at the worksite for ten consecutive business days, informing current employees of the opening and their right to send feedback to the DOL. The internal notice also has to fall in the 30-to-180-day window before filing.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States
Three More Steps for Professional Occupations
Positions that normally require at least a bachelor’s degree need three additional steps drawn from this list: job fairs, employer’s own website, a third-party job site, on-campus recruiting, trade or professional publications, private employment firms, an employee referral program with incentives, campus placement offices, local and ethnic newspapers, or radio or television ads. Only one of the three may consist entirely of activity that occurred within 30 days of filing, and none may have taken place more than 180 days before filing.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process
The Recruitment Report and Records to Keep
After recruitment ends, the employer prepares a written recruitment report covering how many applicants responded, how they were evaluated, and the specific, job-related reason each unsuccessful applicant was rejected. Rejections must rest on objective criteria such as missing credentials or lack of required technical skills. Vague reasoning like “not a good fit” invites denial.
The employer keeps the recruitment report, every advertisement, and every resume received for five years from the filing date.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States None of it is submitted with the application. It goes to the DOL only if the case is audited.
Layoffs in the Last Six Months
If the employer has laid off workers within six months before filing in the same or a related occupation in the same area, additional obligations apply. Every potentially qualified laid-off worker must be notified about the PERM opening and genuinely considered. A “related occupation” is any job that shares a majority of the essential duties with the PERM position.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process A company that laid off business analysts and then files PERM for a data analyst with overlapping duties needs documentation that each affected worker was contacted. Layoffs are also a known audit trigger.
Who Pays
The employer bears every cost of the PERM process. Federal regulations prohibit requiring the sponsored worker to pay any expense related to the labor certification, including attorney fees for preparing and filing the application. “Payment” is broadly defined and includes wage concessions, salary deductions, kickbacks, and in-kind payments.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States
Consequences are serious. The DOL can deny the application, revoke a certification already granted, or debar the employer from PERM for up to three years, and debarment can be initiated up to six years after filing.6U.S. Department of Labor. Labor Certification for the Permanent Employment of Aliens in the United States – Reducing the Incentives and Opportunities for Fraud and Abuse and Enhancing Program Integrity The one exception: the worker may hire and pay their own separate attorney for independent legal advice. If a single attorney represents both sides, the employer pays the full cost.5eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States There is no government filing fee for the PERM application, though legal and advertising costs commonly run between several thousand and ten thousand dollars depending on complexity and local ad rates.7U.S. Department of Labor. Permanent Labor Certification
Filing Form ETA-9089
Once recruitment is complete and the report is written, the employer files Form ETA-9089 through the DOL’s Foreign Labor Application Gateway. Before using the system, the employer sets up a Login.gov account and registers for a FLAG account.8U.S. Department of Labor. Permanent Labor Certification (PERM)
The form gathers three blocks of information. Employer details include the Federal Employer Identification Number, business address, total number of employees, and the specific worksite. Job description covers duties, education, training, experience, and special skills. Worker information covers full educational history with institutions and degrees, every prior job relevant to the position with exact start and end dates, current immigration status, and country of birth.
Consistency is what the DOL is watching for. The job requirements on the 9089 must mirror the prevailing wage request and every advertisement. If the ads said “bachelor’s in computer science and two years of experience” but the form says “master’s preferred,” the application will be denied. Any sign that requirements shifted after the employer saw who applied is fatal.8U.S. Department of Labor. Permanent Labor Certification (PERM)
Processing Times and Audits
As of April 2026, standard analyst review averaged 501 calendar days, and cases in audit review averaged 343 calendar days.1U.S. Department of Labor. Processing Times These numbers move, and the FLAG portal shows current figures.
Some audits are random. Others are triggered by specific patterns: a foreign language requirement, a family relationship between the employer and the worker, an ownership interest held by the worker, recent layoffs in the same or a related occupation, and positions requiring a degree but no experience. Cases previously denied or withdrawn after an audit may face both audit and supervised recruitment on refiling.
An audit begins with a request for the recruitment report and supporting documents. If problems surface, the DOL may order supervised recruitment, in which the employer redoes the whole campaign under a government officer who approves each advertisement and reviews every applicant interaction. That adds substantial time and cost.
If the Application Is Denied
A denied employer has two options and must pick one in writing.9U.S. Department of Labor. 2019 PERM FAQs Round 14 – Withdrawals, Requests for Redetermination or BALCA Review, and Pay Differentials
A request for reconsideration goes back to the same Certifying Officer, must be filed within 30 calendar days of the denial letter, and generally cannot introduce new evidence. There is a narrow exception for documents that existed at the time of filing but were not previously provided, so long as they do not change the Form ETA-9089.
A request for review by the Board of Alien Labor Certification Appeals must also be filed within 30 calendar days of the denial letter, or within 30 calendar days of a reconsideration decision if the employer tried reconsideration first. BALCA review is limited to legal arguments and evidence already in the record. A submission that does not clearly identify the chosen path is treated as a request for reconsideration by default.9U.S. Department of Labor. 2019 PERM FAQs Round 14 – Withdrawals, Requests for Redetermination or BALCA Review, and Pay Differentials
After Certification: The 180-Day Clock
A certified PERM is valid for exactly 180 calendar days.10U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 – Immigrants Part E – Employment-Based Immigration Chapter 6 – Permanent Labor Certification Within that window, the employer must file Form I-140, Immigrant Petition for Alien Workers, with USCIS. Miss the window and the certification expires; the process restarts at the prevailing wage stage.
USCIS looks at different questions than the DOL. It confirms the worker meets the requirements on the certified ETA-9089, and it examines the employer’s ability to pay the offered wage from the priority date forward, drawing on tax returns, audited financial statements, or annual reports. USCIS considers the full picture of the employer’s finances, not a single metric.11U.S. Citizenship and Immigration Services. When PERM Does Not Apply
Not every employment-based green card requires the full recruitment campaign. Two categories work differently, and assuming the standard process applies to them wastes months.
Schedule A occupations are pre-certified by the DOL because it has determined there are not enough qualified U.S. workers. Group I covers physical therapists and professional nurses. Group II covers immigrants of exceptional ability in the sciences or arts, including college and university teachers, and immigrants of exceptional ability in the performing arts. For these occupations, the employer files the labor certification directly with USCIS alongside the I-140 rather than going through standard PERM.14U.S. Citizenship and Immigration Services. College and university teachers selected through a competitive recruitment and selection process follow a separate track under 20 CFR 656.18 rather than the standard recruitment rules, with its own documentation and timing.4eCFR. 20 CFR 656.17 – Basic Labor Certification Process
